Like I have said many times on many threads, this precedent would allow us to dig up FDR, and put him on trial. His antics did more damage by far than any other POTUS.

GOP senators criticize Trump legal defense as 'unfocused' and 'weaker'
A number of Republican senators criticized Trump’s legal team Tuesday for lacking focus and making “weaker†arguments than the House impeachment managers on the first day of former President Trump’s impeachment trial.
“Anyone who listened to those arguments would recognize that the House managers were focused, relied upon and trusted upon the opinion of legal scholars,†said Sen. Bill Cassidy (R-La.) after joining with five other Republican senators in voting that the trial was constitutional and should proceed.
“Anyone who listened to President Trump’s legal team saw they were unfocused, they attempted to avoid the issue. And they talked about everything but the issue at hand,†he added.
Cassidy’s vote on Tuesday was a surprise after he voted last month in favor of a motion by Sen. Rand Paul (R-Ky.) declaring the trial unconstitutional.

The only thing missing from it was any evidence that President Trump incited violence, which I would think would be crucial in any trial where the defendant is being prosecuted for inciting violence.

Trump expressed frustration with his defense's strategy right out of the gate Tuesday, according to a report in Politico.
"President Trump was not happy with the performance of his legal team in action," a person familiar with Trump's evaluation of the day told the outlet.
CNN reported that Trump and his team were confused by his team's last-minute change in speaking order, and that the former president was "borderline screaming" as attorney Bruce Castor delivered his opening argument, which was criticized by people on both sides of the aisle as rambling.
Castor also said during his comments that he was impressed with what the Democratic representation had presented, a remark unlikely to make the former president happy.

Deliberate or not @XenaLee --- all that's being talked about is them. They're panicked with good reasons. They felt the power to destroy them sitting in that chamber. I half expect them to recommend conviction in their closing remarks.
And look at what we're NOT talking about ....
Are we discussing where the Senate gets the authority to determine the Constitutionality of anything? No. Are we discussing the new, diminished role of our Supreme Court? No. Do Americans know jurors sitting as judges is a new and troubling precedent? No.
Are we discussing the Marxists' doctored evidence? No. Are legal analysts explaining that the video would not be permitted in a court of law because it is an emotional appeal and does not present a shred of evidence that the President was involved, in any way, in this so called "insurrection"? No.
My prediction: This trial is just a stepping stone for the Marxists to refer this to the DOJ for criminal investigation and trial. I expect Donald Trump will be convicted.

The conspiracy’s “work touched every aspect of the election,†Ball writes. “They got states to change voting systems and laws and helped secure hundreds of millions in public and private funding. They fended off voter-suppression lawsuits, recruited armies of poll workers and got millions of people to vote by mail for the first time.â€

Through all the fancy hollywood prepared biased film clips, and power points there are two simple facts that can't be overlooked and basically trump any double and triple speak rhetoric being spewed:
1- The House dims have narrowed their scope to one charge of "Incitement of Insurrection" (sans January 6th Capitol event, since no other evidence of violence can be attributed to Trump's speeches.
2- POTUS Trump very very specifically stated quote in that January 6th speech as follows- "I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard."
Every democrat, and republican that votes for conviction are basically subjuagting the justice system into a political witch hunt and lynching. There are 75M people watching as the lying depsicable MSM paints this picture of deceit and trickery.
If former POTUS Trump is convicted it will have ramifications on the same level of Fort Sumpter.

The House case today has resonated with many of us who remain angry over this attack on our Capitol. However, it is more emotive than probative. It is like showing the remnants of a fire. That does not materially show that the accused is guilty of the arson.

...What is missing is a real effort to show Trump's intent and the glaring failure of the House to have called any witnesses for the last four weeks to lock in such testimony. He was impeached for incitement to insurrection, not negligence.

I can’t imagine how much more the story of the Capitol hill riot will evolve over the coming months. I saw some people scrapping with cops, but most were scampering through the Capitol like children turned loose inside an empty church sanctuary on Saturday afternoon. The worst atrocity I saw was committed by a cop.

After the House managers announced they were wrapping up for the day, Lee stood at his desk on the Senate floor and asked to strike comments made by the House lawmakers that related to him.
"Statements were attributed to me moments ago by the House impeachment managers. Statements relating to the content of conversations between a phone call involving President Trump and Sen. A group of GOP senators met with former President Trump's legal team on Thursday to discuss strategy as they prepare to present their opening arguments in the impeachment trial.
Sens. Ted Cruz (Texas), Mike Lee (R-Utah) and Lindsey Graham (R-S.C.) were spotted entering the meeting, which took place in a room near the Senate chamber that Trump's team is using as a workspace.
Cruz told reporters after the meeting that they were talking strategy for the defense's opening arguments on Friday.
"We were discussing their legal strategy and sharing our thoughts," Cruz said.
Asked to elaborate, Cruz added that they were talking "in terms of where the argument was and where to go."

Counsel Van Der Veen just denied that the President's speech was an "incitement to resurrection." In fairness, Sen. Schumer referred to the "incitement to erection." But some senators are likely more concerned with Trump's resurrection than other misplaced alliterations.

A group of GOP senators met with former President Trump's legal team on Thursday to discuss strategy as they prepare to present their opening arguments in the impeachment trial.
Sens. Ted Cruz (Texas), Mike Lee (R-Utah) and Lindsey Graham (R-S.C.) were spotted entering the meeting, which took place in a room near the Senate chamber that Trump's team is using as a workspace.
Cruz told reporters after the meeting that they were talking strategy for the defense's opening arguments on Friday.
"We were discussing their legal strategy and sharing our thoughts," Cruz said.
Asked to elaborate, Cruz added that they were talking "in terms of where the argument was and where to go."

"The answer is no," Michael van der Veen said flatly on the Senate floor. "At no point was the president informed the vice president was in any danger."
The remarks came in response to a question from two Republican senators, Mitt Romney (Utah) and Susan Collins (Maine), who had broken with most in their party earlier in the week in supporting the trial's constitutionality.

Heard horn guy's lawyer last night - horn guy is saying he was there because Trump wanted him there. Horn guy was at another Trump rally, different state, and Trump liked him. Horn guy was called to be at this one.
Today, House managers wanted witnesses to get the testimony of the person who spoke to Trump during the riot when he (Trump) knew Pence was in danger, and he did nothing to stop it - rather, immediately after the phone call, Trump went to twitter and slammed Pence again. Rioters were getting those tweets. Again, it is a miracle Pence is alive. After the riot, Trump did not speak to Pence for five days. No message from him to see if Pence and family were okay.
So, this morning, the phone call was admitted as evidence; that is what the House managers wanted; they had to have that vote to get a witness statement into evidence. They did not want witnesses in person, just get the phone message into evidence.
At this time, Pence and wife are living with family. They have no house as they were living in the governor's mansion, then Pence was VP. They will buy a house in the summer. Pence gets gets two Secret Service men for six months after being VP, however, that can be extended if necessary.
I think Graham changed his vote to "yea" so he would have a leg to stand on to call witnesses for the defense.
