He didn't just disagree. He defied a valid court order. Yes, the court did twist the establishment clause. That happens all the time these days. It's the theocrats are coming, the theocrats are coming! It's chicken little bullshit. But you can't defy a valid court order, especially if you're a chief justice.

I strongly disagree with you @corbe.  We all had plenty of skin in the game whether or not we realize it.

    AND I respect that @Bigun the Senate hasn't got crap done with 52 GOP'ers (other than Gorsuch) and I sincerely doubt that 1 less is gonna make a difference.  We share a significant problem and it doesn't seem to have an immediate solution ~ Removing Mitch.

Now the Machiavellian in me speaks..... drawing this out gives tax cuts one more vote until it is decided. The Judge is doing a service here. I expect a tax package, passed by both Houses ..next week.

My advice?  Gird your loins (Biden style) and prepare for disappointment.

His refusal to concede has nothing to do with the tax vote.  The SoS of AL had not planned on certifying the vote until after Christmas, anyway.  The new Senator wouldn’t be seated until 2018 no matter what.

I really do not care. It works both ways... see all votes counted, make sure they cannot seat the demposter until after crucial votes.

    Though I thoroughly enjoyed the back and forth here on TBR the last 2 months, I never lost sight that other than a few Briefers that actually live in Alabama (who I am appreciative of even Moore for their on the ground reports @Sighlass) None of us really had any Skin in the Game, unless we were donating and I know some of you did or doing phone banks for him.

Back in the beginning of this millenium Moore defied a Federal court order. I think the court order was stupid. It was an overreaching interpretation of  the Establishment Clause of the First Amendment. Nonetheless, it was a valid court order. He defied a valid court order and he was the Chief Justice.

I think the "kooks"  are people who accept utter garbage issuing out of the mouths of petty tyrants.  Judges *NEED*  to be defied.   They run their courts the way Obama ran his Presidency,  as a tyrant who was not constrained by mere law or legislative intent. 


Your argument is that "Might makes right",  and I say that is a morally bankrupt position.   The law is not embodied in a Judges personal preferences,  it is embodied in the intent of the legislators who created it.

It wasn’t just my opinion.  This was already decided and known.

State officials said certification of Tuesday's election would not happen until Dec. 26th at the earliest in order to ensure all counties have reported results. The Senate is only expected to be in session this year until Dec. 22 at the latest.

Point of order.  The "valid"  court order enjoined the Secretary of State.   The district courts are not controlled by the Secretary of State,  they answer to the Chief Justice of the Supreme Court.   


Not only is the Federal Judge f***ing ignorant (I mean *LYING*) about the law,  the stupid bastard didn't write the order to the correct chain of command.

Skin in the Game?  We've got all sorts of skin in the game.   That 1% of the power of the Senate can swing 100% of the results far more often than people realize.   Trump already announced he was dropping two of his federal Judge picks,  and I don't think it is a coincidence that it occurred right after Doug Jones was declared the winner. 


We've all got "Skin in the Game."   Senators don't really represent their own states anymore,  they are constantly meddling in affairs that effect all of us,  like "Obamacare"  or the "Ethanol mandate." 


People are saying we need to get that tax bill rushed through before Doug Jones can get seated and screw it up.

The nation was founded on this principle called "Consent of the Governed."  The premise is that all governing legitimacy emanates from the acquiescence of the people,  and these bastard Judges have completely turned that principle on it's ear.
