Don’t Freak Out When We Lose the Birthright Citizenship Case

Are you ready to be sad? Because I’m not going to sugarcoat it for you. I’m not going to whistle a happy tune as I blow sunshine up your Schumer. We are not going to win the birthright citizenship case at the US Supreme Court.

It’s not going to happen for a number of reasons. I wish it would happen. I also wish I could get a unicorn for my birthday. It’s not going to happen, and I want to let you know why so you don’t freak out. It’s not the result of a conspiracy. It’s not because everybody else is stupid, one justice notwithstanding. It’s because that’s how the legal system works. You don’t have to like it. You do have to understand it if you don’t want to be emotionally incontinent every time something in a courtroom doesn’t go your way.

I respect you enough to tell you how it’s going to be. And it’s not going to be what you hope.

Lazy ass GOP Congress could start work on writing a new Constitutional Amendment.  If they are still afraid of their own shadows, they could do the work on moonless nights in the dark ... after they come back from vacation, of course.

Kurt makes a compelling case here, and I agree with him.  If @Kamaji had stuck around, and not flipped the chessboard over and stomped off, he might have found out I agreed with his assessment of how this case is going to go!

They don't even have to do an Amendment, a Statute would do the job.  It's in the article.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.

The text "and subject to the jurisdiction thereof" is too damn vague.

Does an Executive Order from Biden or Obama suffice to make illegal aliens "subject to the jurisdiction thereof"?

Does a state issuing a drivers license to an illegal alien make them "and subject to the jurisdiction thereof"?

Does enrollment of an illegal alien child in a public school make him "subject to the jurisdiction thereof"?

"and subject to the jurisdiction thereof", on its own, is too vague and open to too many interpretations to be sufficient to nullify birth right citizenship for criminal illegal alien foreigners.

I'm not the only one.
Many Briefers for the past six weeks have all noticed a difference in the tone of @Kamaji 's posts.

Told him months ago, that certain members of THIS Supreme Court have already stated in years' old published interviews that they would certainly consider the 'Current' society's "TAKE" on hot button issues such as a woman's right to choose motherhood themselves and now "Birthright Citizenship".

As a subtext to that most Conservative Republicans find it hard to understand GWB nominated John Roberts' rulings since 2005.  Occam's Razor suggests that there is something out there which was discovered by Obama's "SS", which Roberts doesn't want made public.

Kamaji continues to use his favorite emoji...surprised it hasn't been added to the main page.   :facepalm2:

As well as one poster on this board who believes the Iranians who invaded our Iranian embassy(and killed/kidnapped our citizens) are also subject to our jurisdiction, and can have kids at the taken-over embassy that become American citizens as they were born on American soil.

Anyone else believe this lunacy exists on what is supposed to be a conservative forum?
