Departing President Joe Biden is expected to permanently ban new oil and gas drilling in large sections of the Atlantic and Pacific oceans, in a move designed to foil the ambitions of President-elect Donald Trump to make the U.S. entirely self-sufficient in energy supplies.

The New York Times reports Biden intends to invoke an obscure provision of a 1953 law, the Outer Continental Shelf Lands Act, that would give him wide latitude to withdraw federal waters from future oil and gas leasing and choke off the prospect of any further exploration for the essential energy supplies.

The outlet made the claim via attribution to unnamed sources. The NYT spelt out exactly what is at stake for both men behind an order that could come as soon as Monday:

    The ban would be a significant victory for environmental advocates who have long argued that new drilling is inconsistent with the need to sharply reduce greenhouse gas emissions from burning oil and gas that are dangerously warming the planet. The year that just ended was the hottest in recorded history.

    The move would also cement Mr. Biden’s legacy on climate change as he prepares to leave the White House after a single term. President-elect Donald J. Trump has pledged to reverse virtually every law and regulation aimed at curbing carbon dioxide emissions, and to make it easier for companies to produce and burn more coal, oil and gas.

The NYT report added further detail by noting while section 12(a) of the Outer Continental Shelf Lands Act gives a president wide leeway to bar drilling, it does not include language that would allow Trump or any future president to revoke a ban.

Yeah, that's a good question.  I know they can slow down any reversions using the Administrative Procedures Act, but without legislation, nothing a President orders as an "Executive Action" can be considered as 'permanent.'

That depends on whether Congress in handing-off some of its power by allowing the executive to make regulations of some sort or other, did so with wording which created a sort of legal ratchet-mechanism, allowing the executive only to create regulations of a certain sort, not revoke them.

WASHINGTON — President Biden is moving to ban new offshore oil and gas drilling in most US coastal waters, a last-minute effort to block possible action by the incoming Trump administration to expand offshore drilling.

Biden, whose term expires in two weeks, said he is using authority under the federal Outer Continental Shelf Lands Act to protect offshore areas along the East and West coasts, the eastern Gulf of Mexico and portions of Alaska’s Northern Bering Sea from future oil and natural gas leasing.

“My decision reflects what coastal communities, businesses and beachgoers have known for a long time: that drilling off these coasts could cause irreversible damage to places we hold dear and is unnecessary to meet our nation’s energy needs,” Biden said in a statement.

This is the part that I want pursued.  I want Chevron, Shell, BP, Noble, Inven, etc.,  to file suits in federal court challenging this order based solely on mental competency.  When Biden's mental capacity is ruled unfavorably upon in a court of law, that right there tosses the Hunter Biden pardon along with the 37 federal death row inmates.

President-elect Donald Trump on Monday vowed to quickly reverse President Joe Biden’s lame-duck push to ban oil and gas drilling along most of the U.S. coast.

Trump said in a radio interview that he plans to undo Biden’s policy “immediately” after he takes office later this month, although doing so would likely require help from Congress.

The incoming president slammed Biden’s offshore drilling ban Monday in an interview with radio host Hugh Hewitt. Biden announced earlier Monday — two weeks before Inauguration Day — that he was banning new offshore oil and gas drilling along most of the U.S. coastline.

“It’s ridiculous. I’ll unban it immediately,” Trump said. “It’ll be changed on Day One. I can change it immediately.”

Reversing Biden’s move would likely require an act of Congress, where Republicans hold majorities but where a reversal could face opposition from coastal lawmakers who oppose drilling off their home states’ shores.

Yes, it appears that it's going to take Congress to rescind what Biden as inacted. With such a very slim majority, he may not be able to overturn what Biden did. 

Brandon & Company are trying to ensure that Trump's first 100 days = failure.

Trump said that he "has the right" to reverse such an action, but given that Biden issued the order under a 1953 law that allows the president to enact bans on oil and gas development, he would not be able to simply reverse it.

In 2019, during Trump's first term, a federal judge ruled that OCSLA does not permit presidents to overturn bans established by previous administrations. This means Trump would need congressional approval to reverse Biden's decision............
