No, @GtHawk is correct.  If Biden is deemed mentally incompetent in a civil court, then this order goes away.  No Congressional approval needed.  It kills all birds with a single stone.

...and exactly who is going to implement the proceedings and how long would it take?  Joe's medical doctor is the first one that they're going to question and how do you think he's going to react?

Time is of the essence as Trump knows how important his first 100 days in office is.

There is nothing to be lost by beginning the process.

This is true. Nothing ventured...nothing ventured.

Sure that's true, however; delay, delay, delay the court case is in the best interest of the DEMS. Who knows what all Joe and cronies are doing before he leaves office.

So ... Trump's first 100 days are going to be tied up with the crappola that Joe leaves behind??

GOP Congress can pass Outer Continental Shelf Lands Act of 2025 or amend Outer Continental Shelf Lands Act of 1953 ... just words on paper.

Trump's Executive Branch can also change or 're-interpret' the definition of Outer Continental Shelf Lands.

"Political correctness is a doctrine fostered by a delusional, illogical minority, and rabidly promoted by an unscrupulous mainstream media, which holds forth the proposition that it’s entirely possible to pick up a turd by the clean end." - Alan Simpson, Frontline Video Interview

The Constitution isn't 'just words on paper'.  The Constitution is our country's 'Rule of Law' and should be seen, interpreted, and adhered to as such.

The rule of law is over.  It died when Joe Biden pardoned Hunter.  The charade is over.

Rule of law for some ... but not for others.

The Outer Continental Shelf Lands Act of 1953 is just a law; not a Constitution.

Laws are written by Government.

Constitutions are written by the People to form a Government.  No Constitution = No Goverment

The Rights of Man come from God.

The Rights of Government come from Man.

Men enumerate the Rights of Government in the Constitution.

Government is an instrument of the People to govern themselves.

If the People want to drill for oil and natural gas on the Outer Continental Shelf, the Government does not have the unilateral right nor the authority - independent of the will of a majority of the People - to deny them that opportunity in perpetuity without an amendment to the US Constitution.

Even the Constitution is changeable via the amendment process.

Laws are words on paper.

The will of the majority, with minority rights, is the will of the Federal Government of the United States of America.

Biden's crap has been via unilateral Executive mechanisms, not by a vote of Congress nor a vote by the People.  One man does not have the Right to deny the will of the majority.

RINO huffs and snorts:
"GOP Congress can pass Outer Continental Shelf Lands Act of 2025 or amend Outer Continental Shelf Lands Act of 1953 ... just words on paper."

Not without nuking the filibuster first, they can't.

...and it's gonna go the same way for just about everything else on Mr. Trump's agenda.
It's called... Realpolitik.
