The court overrules its 1984 decision in Chevron v. Natural Resources Defense Council, which held that courts should defer to an agency’s reasonable interpretation of an ambiguous statute. In Loper Bright Enterprises v. Raimondo, the court rules 6-3 that courts may not defer to an agency interpretation of the law simply because a statute is ambiguous.

It is pretty strange that for the left big business is bad while big government is good. Generally, big anything turns bad. And I'll take the ones without the fines, guns and prisons to force me to comply with them...

When the Clean Air Act was reauthorized back in '90, the EPA imposed potential prison time for recordkeeping violations.  And folks like Plant Managers and we Environmental Managers lived in a state of paranoia of what could happen in a rogue EPA agent decided to take a personal vendetta. 

It got to the point, I was self documenting day to day conversations in response.  I knew of 5 of my colleagues with my exact same job in my company had Nervous Breakdowns. I have long known of the regulators who see the acts of compliance and enforcement as games to toy with their opponents.  Many of I hope burn in hell.

Will today's ruling fix all that?  I doubt it...  but its a start.

This decision is unlikely to have the sorts of far-reaching ramifications that its decriers have been wailing about.  For the most part, the courts will probably generally come to the conclusion that the agency's interpretation is sufficiently in line with the interpretation the court itself would have come to independently that the court will not disturb the agency's determination.

It will mostly have application in outlier cases where the agency's actions are clearly abusive or arbitrary.

That being said, it is also a good decision.

I have vetted new environmental regulations, where we came up with 15-20 different interpretations.  Pre-1990, the EPA was pretty cooperative on their tech hot lines on these matters.  Afterwards, outside anything simple, they asked that the inquiry be sent to General Counsel. 

I was and am convinced that the ambiguity put in these was intentional, just to give the agency flexibility and broad brushed enforcement powers to their advantage.

What kind of gets lost in this decison, is the amount of money (I am guessing $Trillions) that has been needlessly spent in regulatory control post the Chevron decison.  There was a point in about '88-'92 that there started being significant questioning of whether their was significantly deminishing environmental, health, and safety beneftis for the money spent.  Which btw, always was passed on to the consumer.

Government gone amok?  We all lose.

Cooke was a Freeper at one time. He didn't tow the JimRob line and went away if I remember correctly. He seemed pretty solid at the time.
