At the southern border: Dozens of migrants detained as Border Patrol contends with the nightly influx

MCALLEN, Texas – It was a routine evening for the U.S. Border Patrol in this town just across the border from northern Mexico. It was also a night filled with drama.

In the course of just a few hours on the southern border Thursday night, dozens of migrants were detained, clothes and personal items were left at a migrant landing spot on the Rio Grande and a drone likely belonging to a cartel could be seen apparently surveilling Border Patrol movements.

Embedded with a group that included Reps. Byron Donalds, R-Fla., Kat Cammack, R-Fla., and Stephanie Bice, R-Okla., Fox News Digital was on hand as National Border Patrol Council members shared what they experience on a nightly basis on the southern border.

Almost immediately after the tour began at 10:30 p.m., Border Patrol radio frequencies relayed that officers had pulled someone out of the Rio Grande. A few minutes later, radios went off again, alerting that different individuals had been detained near a Burger King just a few hundred yards from the border.

US-MEXICO BORDER CONTINUES TO BREAK RECORDS FOR MIGRANT ENCOUNTERS

Then, just before 11 p.m., several Border Patrol vehicles and officers stopped near a section of border wall to detain a large group of about 40 migrants. Migrants were handed masks and lined up before likely being taken to a nearby processing center.

Yet Cammack said that the group was not even close to the largest she'd seen in previous visits to the border.

At another stop on the tour, south of the border wall on the banks of the Rio Grande, National Border Patrol Council (NBPC) members spotted red and green flashing lights hovering on the Mexican side of the border.

Those lights were from a drone likely belonging to a cartel, the NBPC officials said. They added that the drones are a common sight, used by the cartels to monitor the movements of Border Patrol and other law enforcement agencies and to guide people crossing each night.

VP Kamala Harris inactive on border crisis as migrant surge continues, Title 42 end looms

Vice President Kamala Harris was tasked by President Biden with leading the administration’s efforts to combat "root causes" of the crisis at the southern border more than a year ago. But now, with massive numbers again amassing at the border, the matter is barely appearing on her schedule.

Harris was assigned by Biden in March 2021 to lead diplomatic talks with Mexico and the Northern Triangle countries of Honduras, Guatemala and El Salvador to tackle the "root causes" such as poverty, violence and climate change.

It proved a politically tricky assignment for Harris, who was quickly dubbed "the border czar" at a time when the border was undergoing a major crisis, with spiking migrant encounters that critics have blamed on the administration’s liberal immigration policies. The administration has instead said that a combination of "root causes" and the shutting of legal asylum pathways by the Trump administration is to blame.

Harris soon took off on a trip to Guatemala and Mexico, where she touted U.S. investments in agribusiness, affordable housing, worker protections and women’s empowerment and education, while also calling for anti-corruption efforts from those countries. However, issues like Mexico’s refusal to take back migrant families were not discussed.

She immediately faced pressure on why she hadn’t been to the U.S. border (to which she quipped that she also hadn’t been to Europe) A border visit to the relatively quiet sector of El Paso soon followed in the last days of June. She had also announced a "Call to Action" for private sector investment in Central America, in which companies like Mastercard, Microsoft, Nespresso and the World Economic Forum – have made commitments to "support inclusive economic development" in the region.

At that border visit in June, she said the administration had made "extreme progress" in tackling the crisis.

But after that border visit in June, events related to the issue dried up -- even as the border crisis continued to rage through the rest of the year. An L.A. Times tracker notes two limited press events that mention immigration in August, and nothing since.....

DHS erases barrier to legal status for some illegal immigrants

Making it back into the U.S. after being ousted is “irrelevant” to an illegal immigrant’s eligibility to apply for a new legal status, the Homeland Security Department’s citizenship agency says in a new policy.

In the past, U.S. Citizenship and Immigration Services would have denied the application under a law that required onetime illegal immigrants to wait outside the country for up to 10 years before they would be eligible to apply to come back legally.

Experts said the policy now says the law doesn’t require a wait elsewhere as long as the immigrant doesn’t pop up on Homeland Security’s radar during the waiting period.

“This is like the ‘don’t ask, don’t tell.’ We won’t ask you where you’ve been during your inadmissible period, and you don’t tell us. It’s sheer craziness,” said Emilio Gonzalez, who ran USCIS during the George W. Bush administration.

At issue is the three-year/10-year bar to admissibility, which is supposed to deter immigrants from trying to live in the country illegally....

Mexico announces 'historic' fentanyl bust, seizing over a half-ton of deadly drug from warehouse

Mexican authorities carried out a "historic" drug bust this week, seizing more than a half-ton of fentanyl from a warehouse in the northern city of Culiacan, officials said.

The Mexican Army and National Guard announced Thursday that on July 2, law enforcement located a property that had been used by criminals to smuggle drugs and had arrested 10 individuals found there. Authorities discovered an incredible 542.72 kilograms (1196.49 lbs) of fentanyl valued at nearly $230 million, the Associated Press reports.

"This is the largest seizure in history of this lethal drug," said Assistant Public Safety Secretary Ricardo Mejia.

Fentanyl is a deadly synthetic opioid that was responsible for more than 70,000 overdose deaths in the U.S. last year. It is 100 times more potent than morphine; just two milligrams of fentanyl can be enough to kill a person. ............

Any day now, U.S. Customs and Border Protection will release the number of people it encountered entering this country illegally in the month of June. The May number -- 239,416 -- set an all-time monthly record, and no one knows how many illegal entrants got away.

Biden Halts Prosecutions for Most Illegal Border Crossings

The Biden administration dramatically reduced migrant prosecutions by nearly 80 percent in the 2021 fiscal year, even as illegal crossings skyrocketed.

Just 2,896 migrants apprehended on the southwest border were transferred into U.S. Marshals Service custody in the 2021 fiscal year, according to an internal Department of Homeland Security memo obtained by the Washington Free Beacon. In the 2020 fiscal year, 13,213 migrants were transferred to federal authorities for prosecution.

The precipitous drop in migrant prosecutions illustrates President Joe Biden’s break from prior administrations’ policies toward illegal immigration. Refraining from bringing criminal charges against the vast majority of individuals entering the country illegally also provides evidence for critics who say the White House is exacerbating the migration crisis on the southern border.

The decline in prosecutions for illegal border crossings also happened amid the worst border crisis in U.S. history. Migrant encounters on the southern border exceeded two million in 2021.

Under federal law, it is a misdemeanor crime to illegally cross the border. A second arrest for illegally crossing the border can be prosecuted as a felony. According to federal law, those found guilty of an illegal border crossing face fines and up to two years in prison.

"The lack of accountability from this administration encourages the worst people flooding our borders, criminals, to keep violating our laws until they finally commit a crime so egregious that the Department of Justice is forced to prosecute," a senior DHS official told the Free Beacon............

Sen. Joni Ernst, R-Iowa, says border agents are concerned by the alarming number of young girls who are being "brutally" raped and assaulted by human smugglers as they trek across the southern border, and is demanding the Biden administration to take immediate action to stop these "heartbreaking" crimes.

Ernst detailed the "appalling" actions of cartel-backed "coyote" smugglers during an interview with Fox News Digital Tuesday. The senator traveled down to the Texas-Mexico border over the weekend with a delegation led by Sens. John Cornyn, R-Texas, Ted Cruz, R-Texas, Chuck Grassley, R-Iowa and other leading lawmakers.

Ernst said the senators were told that human smugglers and coyotes assisting the cartels are perpetuating these horrific crimes of sexual abuse toward over half of young girls as they make the journey, often unaccompanied, across the southern border to the U.S.

"The Border Patrol, they told us that about 30% of the women and girls that are being trafficked by the cartels up to the border are being sexually abused along the way. Sen. Ted Cruz, R-Texas, released a graphic video highlighting the brutality of what he calls the "Narco slave trade" at the U.S.-Mexico border.

The video begins with Cruz and border officials tending to a group of migrants who crossed the border late in the night. He highlights that the vast majority of migrants are being economically exploited by the drug cartels bringing them into the U.S.

"These children come in in debt to vicious cartels thousands and thousands of dollars. The teenage boys work for the gangs in every city in America, and the teenage girls experience a hell worse than that, with far too many of them human trafficked into sex slavery," Cruz says in the video. "Joe Biden and Kamala Harris are responsible for the worst plague of slavery in America since the Civil War."

El Paso Border Patrol identifies 665 adults posing as minors while attempting to cross the border illegally

Since October, El Paso Border Protection has identified 665 adults posing as children illegally attempting to cross into the United States.

U.S. Customs and Border Protection reported on Friday that another 10 adults posing as children had been identified at the southern border.

El Paso Sector Border Patrol Chief Gloria I. Chavez stated that transnational criminal organizations convince adults to lie about their age because minors who cross the border cannot be immediately deported. In addition, she said, “Identity fraud is a common tactic used by TCOs to take advantage of migrants who do not know the legal consequences of their actions as they attempt to deceive authorities.”

U.S. Department of Health & Human Services stated that unaccompanied minors are placed in the care of the Office of Refugee Resettlement. By law, ORR must provide children with food, shelter, and medical care while officials attempt to find a parent or guardian. While they await immigration proceedings, authorities place the children with a sponsor, most often a family member living in the United States.

More than half of all Americans believe the United States is facing an invasion at the southern border, according to a recent survey from NPR.

According to the poll, 54 percent of Americans, including 40 percent of Democrats, say it is "completely true" or "somewhat true" that the border crisis is an "invasion." Nearly three-quarters, 73 percent, of respondents said they believe the "large number of migrants apprehended at the southern border is a problem."

The results come as the United States sees the largest influx of illegal immigrants in history. More than 1.8 million migrants have been apprehended by Border Patrol on the southern border since October 2021, a new annual record. The previous record was held by the 2021 fiscal year.

Moreover, the results demonstrate a shift in how Americans view illegal immigration as an active threat to the nation’s sovereignty as news organizations such as NPR make a concerted effort to sanitize the border crisis. The Associated Press in its style guide bars news organizations from using the term "invasion" when reporting immigration-related stories. News organizations that follow the AP style guide, or base their guides on the AP's, include NPR and Politico.

The AP did not respond to a request for comment.

Americans are also significantly less likely to say that "immigrants are an important part of our American identity" than they were in 2018, according to the poll. In that year, 75 percent of Americans said they agree with the statement. Today, 56 percent of Americans agree.

Support for DACA, which gave legal status to illegal immigrants brought into the United States as minors, dropped to 51 percent. In 2018, support was at 65 percent.....

The Biden administration on Wednesday finalized a rule to transform the Deferred Action for Childhood Arrivals (DACA) immigration policy for more than 600,000 so-called "Dreamers" into a federal regulation, a move aimed at protecting the program from legal challenges that imperil its existence.

The 453-page rule by the Department of Homeland Security (DHS) is set to take effect on Oct. 31 and will codify the Obama-era program, which has been governed by a 2012 memo for a decade, into the federal government's code of regulations.

Since its inception, DACA has allowed hundreds of thousands of unauthorized immigrants who arrived in the U.S. as children to live and work in the country legally without fear of deportation.  As of March 31, 611,270 immigrants were enrolled in DACA, government data show.

While technical in nature, the change announced Wednesday is designed to address some of the Republican-led legal challenges against the DACA, which a federal judge in Texas last year closed to new applicants.

Texas Attorney Who Allegedly Claimed to Be Federal Immigration Judge Arrested for Smuggling Migrants

A Texas attorney, who reportedly told officers he was a federally appointed immigration judge, was arrested on Aug. 13 in Kinney County, Texas on four counts of human smuggling as a part of Republican Gov. Abbott’s Operation LoneStar.

The attorney, Timothy Daniel Japhet, told CNS News that he never identified himself as an immigration judge. However, the police affidavit says that, “Japhet stated he was an appointed Judge in Nueces County, and his State Bar number is 24038976.”

Japhet, like all persons, is considered innocent of all charges unless found guilty in a court of law.

According to an affidavit provided to CNS News by the Texas Department of Public Safety, on Aug. 13 State Trooper Wanda Wolfe “observed a Black BMW passenger car […] fail to drive in a single lane.” After pulling the car over, the driver identified himself as Timothy Daniel Japhet..................

Border Patrol chief says border crisis a result of Biden's 'no consequences' policy for illegal migrants

EXCLUSIVE: Border Patrol Chief Raul Ortiz said under oath that President Biden's border policies have "no consequences" for illegal migrants traveling into the U.S. and are to blame for the unprecedented surge at the border and release of hundreds of thousands into the interior of the country.

Fox News Digital first obtained a video of Ortiz's assertions, which came during a recorded deposition from July 28 as part of discovery in a lawsuit by Florida Attorney General Ashley Moody against the Department of Homeland Security and other border agencies.

Ortiz, who has more than 31 years of experience in law enforcement, told attorneys representing Florida that he believes migration will increase at an exponential rate at the southern border because there are no "consequences" in place to curb the tide of migrants flooding into the U.S.

"In my experience, we have seen increases when there are no consequences," said Ortiz during the deposition...............

The White House on Monday claimed that illegal immigrants are not just "walking" across the southern border -- a statement that contradicts footage captured at the border daily that shows migrants walking across the border and into the United States.

White House press secretary Karine Jean-Pierre was pressed by Fox News White House Correspondent Peter Doocy about why migrants are allowed to illegally enter the U.S. without being vaccinated for COVID-19 but an unvaccinated foreign national traveling on a plane cannot.

"Somebody unvaccinated comes over on a plane. You say that's not OK. Somebody walks into Texas or Arizona unvaccinated, they're allowed to stay? Why?" Doocy asked at the White House press briefing.

"But that's not how it works," Jean-Pierre said.

"It is not that simple. It’s not just that people are walking across the border," she said. "We have a plan in place."

The denial that people are walking across the border illegally sparked outrage from border officials, Trump administration officials and Republican lawmakers -- who noted that hundreds of thousands of migrants are walking across the border each month.

"This is a coordinated disinformation campaign by this administration.  To claim illegal aliens are not walking across the border or to infer that they are tested for COVID is absurd," former acting DHS Secretary Chad Wolf tweeted. "And they know better."

The claim is also in sharp contrast to footage taken by Fox News since the beginning of the border crisis last year -- including in recent months where Fox has filmed multiple groups of illegal immigrants walking into the United States...............

The "just" qualifier allows just enough wiggle room around the truth.  She "just" thinks she's being an artful liar.
