Should this NJ native be let back into the U.S.?
« on: February 23, 2019, 09:31:30 am »
Here’s the backstory. Young woman born in Hackensack back in 1984. She’s the daughter of a Yemeni diplomat.

She leaves her home in Alabama in 2014 to become an ISIS bride. After 3 husbands, and two failed pregnancies she wants to come back to the states with her 19 month son. She left her latest husband after being disenchanted with the marriage.

This has caused a lot of debate on the radio. Curious to see what you all think. If you look at the poll
On their site the overwhelming response is something like she made her bed, she should lie in it.

There is a similar case in England right now where a teenager who I think was 15 or 16 left for the same and is now wanting to come home after several years as well.

That's a easy question to answer.

NOBODY from New Jersey should be allowed to enter the US.

@Freya, framing it as a "NJ native" prejudices the question.  She may have been born there, but her parents' diplomatic position at the time of her birth negates the "native" part.  She is a Yemeni citizen.

@Sanguine I went with the title from the article. I thought that was correct.

If a mod wants to change the titles and move it to polls that’s fine.

There is some ambiguity over that since he was apparently terminated several weeks before she was born.

Not really.  His presence and his permission to be here were predicated on the fact that he was a diplomat.

And, remember, she also has Yemeni citizenship.  Not having American citizenship does not leave her stateless.

Supposedly her case is partly based on her birth coming after her father's diplomatic status expired.

ONOH her passport is said to have been issued in error (during Obama).

My position is: There either are, or should be, legal bases for revokation of citizenship and/or passports in these types of instances.

She was a fully formed adult, when she left America to wage war on America.

This decision cannot be made using emotions.  The law is what matters here.  The father, I believe, is taking it to court and the ruling will be using the laws regarding diplomats and their family.

I agree with that.  Since it will be eventually decided by a Court, there are liable to be some pretty emotional reactions.

Not just no... but HELL NO.   There are consequences to such actions... and to let her come back after her treason against the US and Americans, American soldiers, etc.... would set a really bad precedent.  Plus, she could still be so brain-washed that she might commit a terrorist act at some point.  I wouldn't trust her AT ALL.

Doesn’t matter.  He was no longer a diplomat at the time she was born. At that point, if he didn’t have residual permission to be in the US, then he was here illegally, and just as the children of illegal aliens who are born here have birthplace citizenship, so would she.

Why would statelessness be of the slightest interest?

I think the "illegal alien" part may not come into play.  The Treason argument may render that moot.  I don't know, IANAL.

At issue is whether she was “subject to the jurisdiction of the United States” at birth, a status that her father claims she holds and that the federal government, starting in 2016, has claimed she does not.

Hoda Muthana told NBC News that her citizenship has never been questioned before, and that “[w]hen I tried filing for a passport it was very easy. It came in 10 days.”

But that’s not true.

Muthana was issued a passport as a US citizen, that’s true. But the government challenged her citizenship before giving her a passport. And in 2016, after she’d burned her passport upon joining ISIS — “Bonfire soon, no need for these anymore, alhamdulliah [thanks be to God],” she tweeted, with a photo of her and several other women’s Western passports — the Obama administration officially declared the passport and her citizenship had never been valid to begin with.

The 14th Amendment to the US Constitution provides birthright citizenship to everyone born on US soil and “subject to the jurisdiction of” the United States. While there’s an argument (somewhat on the fringe) that “jurisdiction” doesn’t apply to unauthorized immigrants living in the US, everyone agrees that it doesn’t apply to babies born to foreign diplomats.

Diplomatic immunity exempts the diplomat — and, generally, his or her family — from US jurisdiction, the argument goes, so children born in the US to foreign diplomats are citizens of their parents’ home countries, not US citizens.

Hoda Muthana’s father, Ahmed Ali Muthana, came to the US from Yemen in 1990 to serve as a diplomat representing his home country at the United Nations, whose headquarters are located in New York City.

[...]

In January 2016, the US government sent the Muthana household a letter addressed to Hoda officially revoking her US passport. The letter claimed that the passport had been issued in error, because there was “no evidence” that she was actually a US citizen by birth. The government asserted that, contrary to the testimony provided in 2004, the US Mission to the UN’s records showed that Muthana’s father didn’t lose diplomatic status until months after Hoda was born.

Duh.

If they can blame Virigina's Governor's (et al) on Trump's time travel machine, Obastard's lock-up of children on the Border, and Smollett on him, they can blame anything on him.  The sky's the limit.

There is some ambiguity over that since he was apparently terminated several weeks before she was born.
Here's what I see.

Either she is the daughter of a diplomat, and not a US citizen, and thus not entitled to reenter the country...

Or...

She is an American citizen, who has given aid and comfort to the enemy in time of war. (Treason, prima facie).

She might be better off seeking residence elsewhere.

And probably... more deaths due to radical Islamic "domestic terrorism".  That's what happens when you import cretins like this and allow them to live freely along with civilized folks.  I probably could overlook a young, naive woman getting involved with one ISIS scumbag, finding out the reality of what she got herself into and THEN wanting to leave or escape to the US.  But this idiot married three of them, had a kid and only now .... now that ISIS is being defeated... does she want to leave them.  Nah. She can go to any pro-muzzie nation over there and live.  She doesn't deserve to live in America now.  She gave up that right when she joined jihad against us.

I recommend Saudi Arabia.  If she liked ISIS she'll love the Wahhabi sect.

You really think the Saudis will have her?  They are "supposedly" concerned about terrorism (roll eyes gif here).

Works for me.  It's like the line I always used when the Disco where I was the DJ closed at night:  "You don't have to go home, but you can't stay here!"

SA could handler her.  They believe in "The rule of thumb" when dealing with recalcitrant women.

That always came about 15 minutes before...and bar clocks are set ahead by another 15 minutes.

LOL!  I have that too.  I didn't like Disco DJ nearly as much as Radio DJ.  I had to deal with the drunks face-to-radio-face.

It will.  But...will the law be properly applied when a left-activist Judge is a Clinton or Obastard appointee?  It often doesn't even if it's a Bush "New Tone" appointee.

I know you don't want it to be, but it's pretty clear.

And here come the personal insults.  Those always seem to come out when a reasoned basis ceases to exist.  I don’t really care one way or the other; I simply acknowledge the ambiguity, and the need to clarify it.

No, it’s not clear because her father was no longer a diplomat when she was born.
