Question...When he was questioned by the police he waived his Miranda Rights...The police at the questioning never told Penny the perp died....did the police entrap Penny?...isn't there some recourse Penny can take?

BREAKING: Prosecutors just DISMISSED the manslaughter charge they brought against Daniel Penny after the jury couldn't come up with a unanimous verdict.

Penny is now one step closer to freedom.

He should not spend one day in prison.

Breaking: The judge in the Daniel Penny case has DISMISSED the first manslaughter charge against him.
But don't celebrate yet: This is actually a desperate bid to get him convicted on the second charge, and his defense team opposed it for that reason. The whole move may well be illegal.
New York is outrageously obsessed with putting an innocent hero in prison.

This was a mistrial. The jury was hung.
However, the Judge and DA just looped around it, trying to find him guilty of something.

This is simply the case of a bigoted, black DA attempting to get a white man convicted simply because the accused is white.
If Penny were black and Neely white, nothing would have been made of this case.
Time for prejudiced (and stupid) DAs like Bragg to be excised from the judicial system across the country.

As if the defense didn't already have innumerable grounds for appeal (assuming there's a conviction).

The max for the second, milder charge, is 4 years in prison. The first one would have been the 15 years. Neely's family is probably furious (get ready for protests regardless), and DA Bragg is livid.

There IS much to comment on the particulars of this case, as video shows that Penny could have released Neely without danger to himself and others as there were two grown men over Penny ready to help, and the subway car had emptied. (Even the prosecution commended Penny for his intentions.)  He may have simply held the strangle hold too long.  But hindsight IS 50/50. Penny may have been in "soldier mode" and not able to stand down easily.  It can be such a reflex reaction, I'd think.....

What is disgusting about the murder of the CEO is how many libs are rationalizing his murder.
"Well, what would you do if you were turned down?" wail many libs justifying his killing.
Or "I find it hard to feel sympathy for someone like him."
So, according to libs, if you don't get what you want, then it's perfectly alright to murder someone who might be responsible for turning you down. In short, healthcare providers should approve everybody who demands care whether they can pay for it or not. If not, they should be murdered.
The libs who are expressing implicit approval deny that they approve of murder. But they are approving of murder, they're just too gutless to admit it openly.
