Two months ago, I watched a video of a woman who said to a man in his twenties hopping over the turnstile in a New York City subway, "That's not how we do things in New York."    He followed her as she got on to the escalator, ran up past her, turned around, put his hands on the rails, and kicked her backwards down the escalator with both of his feet.  Well down the moving stairs was another man, who instead of catching the poor tumbling woman, simply moved aside and let her continue to bounce to the bottom.

 Jordan Neely’s father sues Daniel Penny as NYC jury deliberates verdict for subway chokehold death

Jordan Neely’s father is suing Daniel Penny over his son’s chokehold death on a New York City subway car as the jury still deliberates whether or not to convict Penny of manslaughter.

The suit, filed in New York Supreme Court on Wednesday, accuses the Long Island Marine veteran of negligent contact, assault and battery that caused injuries and Neely’s death last year.

Neely’s father, Andre Zachary, “demands judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower Courts which would otherwise have jurisdiction,” according to the lawsuit.
It was filed Wednesday as jurors in Penny’s four-week-long Manhattan trial broke for a second time without reaching a verdict.

It is an embarrassment that New Yorkers haven’t been rallying en masse to support Daniel Penny. Instead most of the protesters outside the courthouse have been calling for his conviction. Obviously the charges never should have been brought.  If he gets convicted, it will accelerate the flight of productive citizens to other places.  And if this legal abuse continues, I think you are going to find other jurisdictions refusing to extradite residents to New York.

Be careful... They may drop the first charge so that they can continue with the lesser charges instead of getting a hung jury and a mistrial for all of it.

"We the jury request further clarification in the determination of whether a person reasonably believes physical force to be necessary. The two part test mentions reasonable person. We'd like to better understand the term 'reasonable person.'"

An honest judge would have to reply, "Not a Democrat."
