 Bannon’s trial over defying Jan. 6 committee set to begin

Steve Bannon, ex-President Trump’s former White House strategist and campaign CEO, is headed to trial this week on two contempt of Congress charges, the first to result from a refusal to comply with a subpoena from the House select committee investigating the Jan. 6, 2021 Capitol attack.

The trial, which begins Monday morning with jury selection, falls amid the select panel’s series of public hearings, which have featured damning testimony and evidence about Trump and his inner circle during the riot and in the weeks leading up to it.

Bannon, who had vowed to turn the case into “a misdemeanor from hell” for Democrats, faces up to a year in jail on each count.

The trial will mark the first time a member of Trump’s inner circle has had to face a jury as a result of the Jan. 6 investigations. Trump’s former trade adviser, Peter Navarro, will go to trial in November in a similar case.   

The select committee had subpoenaed Bannon last year for documents and testimony as part of the investigation. When he refused to comply, the House voted to hold him in contempt, sending a criminal referral to the Justice Department.

Last week, U.S. District Judge Carl Nichols twice rejected Bannon’s requests to delay the trial over concerns about potential juror bias amid the public attention on the Jan. 6 committee.

Bannon’s lawyers on Wednesday said in a renewed motion to delay the trial that an hourlong CNN documentary airing Sunday could prejudice potential jurors.

I hope Bannon will move to dismiss charges on the basis that the body which subpoenaed him was not a properly constituted select committee of the House of Representatives, as its composition does not agree with that specified in the authorizing resolution, since Pelosi wouldn't seat the GOP members McCarthy put forward, and just picked the two resolutely anti-Trump members of the GOP caucus to "represent" the minority party. 
And when they behead your own people in the wars which are to come, then you will know what this was all about.

I hope Bannon will move to dismiss charges on the basis that the body which subpoenaed him was not a properly constituted select committee of the House of Representatives, as its composition does not agree with that specified in the authorizing resolution, since Pelosi wouldn't seat the GOP members McCarthy put forward, and just picked the two resolutely anti-Trump members of the GOP caucus to "represent" the minority party.

That would be my tactic as well.  Challenge the legitimacy of the committee, as its formation violates House rules.

Judge Denies Steve Bannon’s Request For Delay To Criminal Contempt Trial

The federal judge presiding over former White House chief strategist Steve Bannon’s criminal contempt trial denied his request on Tuesday to delay the trial for one month.

“The motion to continue is denied,” Nichols stated following a short recess after the motion was formally made.

Corcoran said there was a “seismic shift” in the parties’ understanding surrounding the judge’s past rulings.

“Tuesday morning, the former White House aide’s attorney Evan Corcoran asked Judge Carl Nichols for a one-month continuance following an argument between the parties over admitting into evidence letters between Bannon and the House Jan. 6 committee,” Fox News reported.

“Judge Nichols ultimately said that the letters could be admitted, although there were discussions about whether to redact portions of them to limit the scope of what jurors could see. The judge then called for a two-hour break, saying that at 1 p.m. the parties will reconvene on the record to finalize a decision on admitting the letters. Nichols also said he may agree to delay the trial by one day,” the report added.

VIVA FREI: Judge strikes FBI investigator's testimony - DAY 4 REPORT

"The defense has not called Steve Bannon, will not call any witnesses, and will just rely on the fact that the prosecution did not prove its case," Frei began, adding that as a result, there was no jury present in the courtroom.

"They filed two motions to dismiss," Frei continued, one urging the judge to "acquit Steve Bannon as is," and another known as a Rule Twenty-Nine arguing that the prosecution "did not meet the burden of proof and no reasonable jury could come to a conviction."

Frei explained that while the judge struck down the first motion, he took the second "under deliberation," stating that he would come to a conclusion following a verdict from the jury.

Perhaps the biggest story of Day Four was that the testimony of FBI investigator Stephen Hart had been struck, meaning the jury will be advised not to consider it while making their decision.

On Wednesday, Hart had cited posts made by Bannon on Gettr referencing the subpoena as the basis for his decision to investigate. The posts were intended to serve as "evidence" that Bannon refused to comply with the subpoena not because he thought he benefitted from executive privilege, but because he was "thumbing his nose at the authority of the committee."

"The only practical problem," said Frei of Hart's testimony being struck, "is that the jury's already heard it. So trying to scrub that from the brains of the jury members, good luck."

Frei then dove into the letter sent by former president Donald Trump to Steve Bannon waiving his executive privilege and allowing him to testify in front of the committee.

"This letter is a 4-D level chess troll," Frei said, calling "a thing of beauty."

"Bannon had a major legal error happen in his trial where the judge said he could not present evidence that Pres Trump exerted executive privilege. Pres Trump absolutely exerted exec privilege on a ltr dated 7/9/22. We’ve had executive privilege going back to Washington "  (Video)

Equal justice doesn't exist in DC. Democrats who commit actual crimes get let off scot free by DC juries while Steve Bannon gets convicted for a bs contempt charge from an illegitimate congressional committee.

Former Trump White House official Steve Bannon was found guilty of contempt of Congress after he ignored a subpoena from the House Jan. 6 committee.

Bannon faces 30 days to a year in prison for each of the two misdemeanor charges. The jury was ordered to begin deliberating Friday morning.

U.S. District Judge Carl Nichols discharged the jury after hearing closing arguments from both the prosecution and defense.


The Department of Justice charged Bannon with two counts of contempt of Congress after he ignored a subpoena from the House Jan. 6 committee. Bannon pleaded not guilty.

Bannon claimed executive privilege precluded him from appearing before the committee to talk about the Jan. 6, 2020, attack on the U.S. Capitol, though prosecutors noted that he left the White House in 2017.

The Justice Department began closing arguments Friday morning with prosecutor Molly Gaston telling jurors, "This is a man who didn’t show up."

"He didn’t want to recognize Congress’ authority or play by the government’s rules," Gaston said. "Our government only works if people show up and play by the rules and are held accountable when they do not."

"When he chose to defy a congressional subpoena, that was a crime," Gaston continued. "The defendant chose allegiance to Donald Trump over compliance with the law."

BREAKING: DC jury finds Bannon guilty in trial over contempt of Jan 6 Committee
