WASHINGTON, D.C., July 13, 2021 (Children’s Health Defense) – On Monday, Children’s Health Defense (CHD) and the Parental Rights Foundation filed a lawsuit in the U.S. District Court for the District of Columbia, seeking a court order to declare that the D.C. Minor Consent for Vaccinations Amendment Act of 2020 is unconstitutional. Plaintiffs are four parents of minor children who attend public school in the District of Columbia. They seek a preliminary injunction to prohibit the Mayor, the D.C. Department of Health, and the D.C. Public School System from enforcing the Act.

The D.C. Minor Consent for Vaccinations Amendment Act of 2020 (D.C. Act) allows children eleven years of age and older to consent to the administration of any vaccine recommended by the Advisory Committee on Immunization Practices (ACIP), including COVID shots, without parental knowledge or consent, if the medical provider believes “the minor is capable of meeting the informed consent standard.”

The D.C. Act contains several provisions designed to deceive parents and hide that the child has been vaccinated against parental judgment, authority or religious convictions. The D.C. Act mandates that if a minor has a religious exemption from vaccines or has opted out of the HPV vaccine based on documents filed by parents, the health care provider should leave those parts of the student’s immunization record “blank.”(Sec. 3(b)(2)). To further deceive parents, the D.C. Act requires healthcare personnel to provide accurate immunization records to the Department of Health and to the student’s school, but not to parents. It also contains subsections authorizing healthcare personnel to “seek reimbursement, without parental consent, directly from the insurer,” noting that “insurers shall not send an Explanation of Benefits for services provided.”

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Minor Consent for Vaccinations Amendment Act of 2020".

Sec. 2. Chapter 6 of Title 22-B of the District of Columbia Municipal Regulations (22-B DCMR § 600) is amended by adding a new subsection 600.9 to read as follows:

"(a) A minor, 11 years of age or older, may consent to receive a vaccine if the minor is capable of meeting the informed consent standard, the vaccine is recommended by the United States Advisory Committee on Immunization Practices ("ACIP"), and will be provided in accordance with ACIP's recommended immunization schedule.

"(b) For the purposes of this subsection, a minor shall be deemed to meet the informed consent standard if the minor is able to comprehend the need for, the nature of, and any significant risks ordinarily inherent in the medical care.

"(c) The Department of Health shall produce one or more age-appropriate alternative vaccine information sheets, which shall be made available before vaccination of minors to support providers for use in the informed consent process.

"(d)(1) Providers who administer immunizations under the authority of this subsection shall seek reimbursement, without parental consent, directly from the insurer, which may be Medicaid, Alliance, or private insurance. The provider shall notify the insurer that the immunization has been provided under the authority of this section.

"(2) Insurers shall not send an Explanation of Benefits for services provided under the authority of this subsection.

"(e) A minor who receives services provided under the authority of this subsection shall have access to the minor's immunization records without parental consent.".

1. Given the process necessary under this ordinance for such a minor to receive a vaccination, concealing the process from parents would be all but impossible.

2. Children’s Health Defense is RFK Jr.'s anti-vax group who have demonstrated that they will tell any lie that will further their anti-vax crusade. CHD is not "parents", a lie CHD told in their article title.

I do NOT approve of mandatory vaccination laws, and never have. Nor, absent due process in rare instances, do I approve of laws allowing an unemancipated minor to get a medical procedure without parental approval. I'm just calling out Children’s Health Defense's lies and misrepresentations.

1. Given the process necessary under this ordinance for such a minor to receive a vaccination, concealing the process from parents would be all but impossible.

How so?  Seems pretty clear to me that the conformed consent standard is arbitrarily left up to the entity giving out the vaccine.  And it explicitly states that 11-year-olds are viable candidates for "conformed consent".

(a) A minor, 11 years of age or older, may consent to receive a vaccine if the minor is capable of meeting the informed consent standard

(1) Providers who administer immunizations under the authority of this subsection shall seek reimbursement, without parental consent, directly from the insurer, which may be Medicaid, Alliance, or private insurance.

(e) A minor who receives services provided under the authority of this subsection shall have access to the minor's immunization records without parental consent.
