Cruz says he wants a court that is faithful to the Constitution and the law as it is written. And I couldn't agree with him any more!

Edit to add that if we had a court like that all these recent decisins would have been 9/0.

And, that means stare decisis is not a legitmate way to determine constitutionality.

But I've got this unease...gnawing at me.

Justice Kennedy's announced retirement is lighting that fuse we all talked about the other day. 

Just look anywhere on social media and cable news.

Going to be a violent, bloody Summer, IMO.

Agree. The extremes on both sides want to impose their ideologies on the rest of us, which was never the intent of the constitution. “All” men are created equal, even those with differing opinions, republicans and democrats, regardless of demographics. Thankfully, the founders gave us a working document, a blueprint for a civil society.

President Trump will make his selection based not on ideology, but on the candidate’s fidelity to the constitution. Of that I am certain.

At 72 years of age, I personally recall the segregation of African-Americans.  In fact, my point is that back then they weren't addressed as such.

It was wrong.  it was cruel.  But 9 SCOTUS judges, a House and Senate allowed it....until 'one day'.

For better or worse, there are laws on the books at all levels of public life that allow what one despises, or prohibit what one prefers; laws that allow what is unwise and prohibit what might be wise. They may not be wise or advisable laws but they don't always run afoul of the Constitution. (I hope I don't need to add that it would be far more beneficial to America and the several states to see myriad laws repealed, to say nothing of only one more law to emanate from Congress, which would say, No law passed by any Congress and/or signed by any President shall be considered legal and binding until or unless every member of the Congress in question plus the President in question can prove they've read it, in its entirety, at least once.) The Constitution was written to guarantee a free, not a wise society, alas.

Right now, we have 4 legislators on the Supreme Court, working for the Democratic Party. They vote in lock step with no interest in the Constitution. They vote against the First Amendment at every turn. They will be hard to overcome because they don't ever waver from the Party agenda. Even with Kennedy getting replaced, it will still be tough.

We are at least two more judges away from getting those Nazi death camps we covet so much.

Sotomayor is horrible.  Her opinions are full of discussion about what is "fair", and whether or not a particular policy "works" and leads to desirable outcomes.  She's the antithesis of what a Justice should be.

You said you are in your 70s and remember when blacks couldn't be with whites in normal living activities.  It was definitely not racist when you said that.  I am a few years older than you are, I was born in Texas but my parents were from Arkansas, and they brought to Texas the way they were brought up.

My parents were nice to blacks, but I recall my mother saying, "Blacks are all right as long as they stay in their place."  A black woman would come to our house on Mondays, which was wash day, and help my mother wash clothes.  I remember a large iron container outside where water was heated and clothes were washed in that, rinsed in another big container and put through a wringer, then hung on a clothes line.  Mother was nice to that black lady but she was considered to be less than a white.

That was also the days of hobos, who went to houses asking for food. My mother always gave them food no matter if they were white or black.

Here is a reason for that type behavior lasting so long:  A person is born into a social structure and thinks that is the way to live.  They don't know anything else and think that way of living is the way it is.  I knew my mother thought blacks were less than white people, and it took my growing to be an adult before I saw what was happening was wrong.

Back in that day, my mother also hated Jews because, as she said, "They killed Christ".  Now there were some "Jew" owned stores in the town we had to go to when we needed certain items.  She knew which stores were owned by them and would not go in them.  However, I came along and had very narrow feet - AAAA.  The only store that carried shoes that narrow was run by Jews.  My mother had to take me there to buy shoes that would fit me.  That was an upscale store and I loved it.  I never had a bad feeling about Jews as my mother did.

So, my parents were of a time when blacks and Jews were not equal to non-Jew whites.  You and I are the generation that eventually stopped that behavior toward those people.
