Justice Amy Coney Barrett says there is no time limit for ballot counting

Democrats can continue counting, and counting, until they get the result they want.

Eric Utter | June 30, 2026

Supreme Court Justice Amy Coney Barrett authored the majority opinion ruling in favor of a Mississippi law allowing mail-in ballots to be counted even if they are received well after Election Day.

The Court was split 5-4 on the ruling with the turncoat Barrett, appointed by President Donald Trump, joined by Chief Justice John (“No Balls”) Roberts, as well as the usual Marxists in black, Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown-Jackson.

The sane minority, including justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Samuel Alito were almost certainly shocked and appalled by the outcome.

Incredibly, Barett’s opinion apparently acknowledged that federal law does mandate that Election Day is the deadline for voters to make a choice as to their preferred candidate, but that there is no standard for when ballots must be received to be considered valid. When the polls close? One week later? One month? A year? They came up with five business days. Meh. Que sera sera. It’s all good.

(This is like a sporting event where you have 90 minutes to determine a winner, yet goals continue to count for some time after. Oh wait, that’s soccer.)

In his dissent, Justice Samuel Alito stated that Justice Amy Comey Barrett's opinion was clearly inconsistent with the plain text of the laws and of historical practice and precedents, adding that it “risks further undermining Americans' confidence in election integrity."

Ya think?

But SCOTUS rulings are no longer about interpreting the Constitution, legal precedent — or right or wrong — but about advancing a political agenda.

This ruling is doubly damaging, as it calls into question the legitimacy of the Supreme Court itself, a disaster for the republic, but also further degrades any possible confidence in election integrity and results, the death knell for a “democracy.” Given the existing political climate and pervasive doubt about the validity of our elections, this ruling is an existential threat to the United States as it approaches its 250th birthday celebration.
(Moreover, it does nothing good for the reputation of “women in black.” Historical ignorance, flawed logic, and emotional, agenda-driven decisions do not reflect well on those who make them.)

But wait, there’s hope! In late-arriving news, it turns out President Trump has not, in fact, nominated Barrett for the Court. He subsequently decided on Ted Cruz! Barrett’s ruling will be expunged and America has been saved!

Yes, there is ... on the day that the Electoral College meets, at the very latest.
"Political correctness is a doctrine fostered by a delusional, illogical minority, and rabidly promoted by an unscrupulous mainstream media, which holds forth the proposition that it’s entirely possible to pick up a turd by the clean end." - Alan Simpson, Frontline Video Interview

I read that the decision says that the ballot must have a postmark on the election day..how long it takes to get there may take several days but to be counted....that is not included in this article so I am not sure about anything...

It's a tough day for believers in the Infallibility of the SCOTUS, but I think there are folks that are up to it!
