Virginia prosecutor declines to bring charges against woman accused of threatening Stephen Miller

No federal charges have so far been brought against activist Barbara Wien either.

A Virginia prosecutor determined Tuesday not to bring criminal charges against a resident who has been accused of threatening White House Deputy Chief of Staff for Policy Stephen Miller and his family.

The case centers on whether Barbara Wien, a political activist in the state, engaged in a doxing and intimidation scheme against Miller and his wife, Katie Miller, last year, after she posted flyers in northern Virginia that depicted Miller's face and address. She has also been accused of attempting to intimidate Miller's wife at their Virginia home.

Arlington and Falls Church Commonwealth Attorney Parisa Dehghani-Tafti said in a 166-page court filing that she reviewed the case against Wien and found "nothing in the proceeds of the search warrant supports criminal prosecution," according to CBS News.

"It would neither accomplish the ends of justice nor discharge the Commonwealth's ethical obligations of fair prosecution to initiate any charges," Dehghani-Tafti wrote. "The conduct initially investigated cannot support a charge. In short, Ms. Wien is not likely to be found guilty, and her speech is likely to be found to be constitutionally protected.

"The sole call to action was to a traditionally and clearly protected political activity, encouraging residents to petition Congress to investigate Mr. Miller's actions based on the wanted flyer's allegations," she also wrote.

Wien has been the subject of a state and federal investigation since last year over the distribution of the flyers. Dehghani-Tafti said the flyers did not call for "any action at or near his residence, nor for any action by the viewer against Mr. Miller."

The decision comes as Dehghani-Tafti has been accused of "stymying the investigation" after she allegedly sided with Wien's defense team's request that the judge overseeing the case limit the information police could share with the FBI.

No federal charges have been brought against Wien so far, and a federal judge has rejected the FBI's attempt to obtain a search warrant for Wien's phone twice.
