The War Powers Mirage: How a President Walks Around the Law Without Breaking It

The Last Wire

They call it “not war.”

That’s the trick.

From Lyndon B. Johnson and the Gulf of Tonkin incident… to Barack Obama redefining “hostilities” in Libya… to modern drone strikes, naval buildups, and even cyberattacks—

Presidents haven’t avoided war.

They’ve avoided calling it war.

And that single distinction changes everything:
Who gets a say.
Who gets blamed.
And how far it can go before anyone stops it.

If the definition of war keeps shrinking… what exactly is Congress supposed to control anymore?

— Gonzo

Of course, there being evidence that Iran harbored al Qaeda operatives, the 2001 AUMF resolution can be applied to war with Iran with far better justification than it can be applied to drug smuggling in the Caribbean.
And when they behead your own people in the wars which are to come, then you will know what this was all about.

How the law walks around the Constitution while denying that it is breaking it.
If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.     -Dwight Eisenhower-

"The [U.S.] Constitution is a limitation on the government, not on private individuals ... it does not prescribe the conduct of private individuals, only the conduct of the government ... it is not a charter for government power, but a charter of the citizen's protection against the government."     -Ayn Rand-

The WPR itself tiptoes around the Constitution.

  • I was a "conspiracy theorist". Now I'm just right.
Just call it a "Police Action". It worked for Truman.

Seventeen Techniques for Truth Suppression

Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience.
