Senators agreed by unanimous consent early Friday morning to a proposal that funds the Transportation Security Administration (TSA) and other critical agencies in the Department of Homeland Security (DHS).

The late-night Senate deal left out funding for Immigration and Customs Enforcement (ICE) and the Border Patrol after negotiators failed to agree on reforms demanded by Democrats after federal immigration officers fatally shot two protesters in Minneapolis in January.

The deal came together swiftly after months of often-stalled negotiations and just before lawmakers were set to depart for a two-week recess — and as hours-long lines at airport TSA checkpoints put enormous pressure on them to act.

Senate leaders sent around a hotline request to senators early Friday morning to see if there would be objections to funding TSA, the Coast Guard, the Federal Emergency Management Agency (FEMA) and the Cybersecurity and Infrastructure Agency (CISA) by unanimous consent. The proposal also included funding for customs officers at border checkpoints.

When it returned without objection, Senate Majority Leader John Thune (R-S.D.) moved quickly to unanimously approve the funding that had been stalled for more than 40 days.

The speedy agreement was surprising given that Democrats had on several occasions this month requested unanimous consent on the Senate floor to fund TSA, FEMA, the Coast Guard and CISA with Republicans objecting each time.

Thune told reporters Friday morning that Republicans rejected those earlier efforts to fund DHS in pieces because they were hoping for a deal to fund the entire department.

But Thune said they abandoned that effort and “pivoted” to a new strategy when it became clear that Democrats would not accept the reforms Republicans were willing to make to ICE in exchange for passing the entire Homeland Security appropriations bill.

“This was all about reforms and they were all on the table,” he said. “Basically, that door kind of closed and they started to take the funding [for ICE] off the table. … I just think their base was demanding that they not fund ICE.

“We had hoped we would get a funding bill and we were trying to accommodate their requests for reform,” he added. “We couldn’t get any closer on it so you kind of pivot to the next strategy. But it’s unfortunate it didn’t get done because it’s not good for America.”

Senate Democratic Leader Chuck Schumer (D-N.Y.) declared victory on the Senate floor.

Speaker Mike Johnson (R-La.) has a tricky task ahead in quickly moving forward the Senate deal to fund most of the Department of Homeland Security (DHS), minus Immigration and Customs Enforcement (ICE) and Border Patrol.

It would be difficult to bring the legislation up under a regular rule, which typically passes with a party-line vote, due to conservative demands for the Senate to pass the SAVE America Act voting bill. Some conservatives have also said they don’t like the idea of breaking up the DHS bill.

The fast-track process of suspension of the rules, which would require substantial support from Democrats, would allow the measure to pass on a two-thirds vote of the House. That option, however, is only available on Mondays, Tuesdays, and Wednesdays, per the House rules — and it would take unanimous consent to change that, meaning leadership would be banking on no Republican or Democrat objecting.

House GOP leaders are assessing where members are and what is doable on Friday to pass the bill. The House gavels in at 9 a.m. EDT and votes are scheduled for 10 a.m. EDT.

The Senate has voted to fund DHS *except for* ICE and Border Patrol. This happened after a Trump threat, but how is it not a big Democratic win? In the past, the party that attached conditions to re-opening the government, or parts of the government, lost the shutdown. Now, Democrats have gotten away with attaching conditions to re-opening the government, and Republicans have agreed to a deal funding most of DHS, but not its immigration enforcement and deportation operations.

What was the big Republican mistake here? Negotiating. You don't negotiate with people who are shutting down all or part of the government. The proper response to a threatened shutdown is: "Re-open the government, and then we'll talk about your issue. But first the government has to be re-opened." That is always the public's view. Instead, the GOP agreed to start talks. Once that happened, it legitimized the Democratic position of shutting down part of the government, in this case TSA, while demanding changes in immigration enforcement. Instead of seeing Democrats shutting down TSA over an unrelated policy dispute, the public saw two sides negotiating and unable to agree. So they blamed everybody when this was, in fact, a Democratic move to cripple the administration's enforcement of federal immigration law.

Yes, although Democrats didn’t actually achieve anything. They caused a 40+ day shutdown & ended up getting zero policy changes to the agency they’re demonizing, which has been funded the whole time. And Rs say they’ll fund that agency further through reconciliation anyway. I guess the win was causing the harm and pain without really getting punished for it & showing unity in resistance.

🚨THE HOUSE is going to have big problems moving the DHS funding bill today.

In the rules for the 119th Congress, House Republicans handcuffed themselves.

The majority can not move bills under suspension of the rules on Thursdays, Fridays, Saturdays and Sundays.

Hardline conservatives hate moving bills under suspension because it bypasses the rule vote -- where they have the most leverage. Suspensions short-circuit that process but they need 2/3 majority.

So @SpeakerJohnson
 can go to the Rules Committee, where he can try to get a rule -- no sure thing. If he does get one, he can try to pass a rule on the floor -- no sure thing there either with his margins. Rules are party-line votes.

Or he can wait until Monday, where he can pass this on suspension.

Either way, suspension is going to be controversial.

Maybe Trump can convince HFC types to pass a rule. But I don't know that that will work. No SAVE America Act in this. And rules are hard in the best of times.

ICE is already funded but this is a chicken shit way out and letting the Dems off. Everyone wants their little vacation instead of doing their damn job. Talk about fumbling the ball at the 1 yard line.

I think every year I watch this Kabuki shit, my support for term limits doubles. 

I am now at the point of one term and done for all 535...  period, and to hell with continuity.
