To SAVE a nation — or not

The SAVE Act requiring voters to present identification to ascertain their right to vote, must be passed in Congress.

Eric Utter | February 4, 2026

Nations, like people, typically face a handful of inflection points in their lives. Pivot points. Turning points. A time when it is realized, perhaps even belatedly, that what transpires now will echo through time and possibly change things forever. That what we choose to do now is of great — perhaps existential -- importance.

The Boston Tea Party. The Declaration of Independence. The Civil War. World Wars. To drop “the bomb” or not to drop the bomb. The 1960s. The 1980 presidential election.

We are at another inflection point now. Today. One that we can’t deny, and ignore only at our great peril. And this inflection point is perhaps more multifaceted than any that has come before.

I say that because we, as a nation, have to simultaneously decide several overarching issues.

The SAVE Act requiring voters to present identification to ascertain exercise their right to vote, must be passed in Congress.

The US Constitution provides qualified persons the right to vote in Federal elections.

There needs to be greater legal clarification of Federal voter 'qualifications' and a remedy for ballots cast by 'unqualified' persons.  Maybe Federal ballots should be separate from state and local ballots.

What makes an immigrant legal and eligible to vote in a Federal election?  A visa issued by the US State Department?  Adjudication by an administrative judge?  Federal Laws contained in the U.S. Code (of Laws)?  A Presidential Executive Order?  A wave of a magic wand to designate someone,  who entered or remains in the US illegally (as defined by US Code), as a 'Refugee' or 'Assylum Seeker'?
