Australia is set to recall both houses of parliament ahead of schedule to legislate so-called hate speech and gun laws in the wake of last month’s Bondi Beach massacre, AFP reported on Monday.

Australian Prime Minister Anthony Albanese said he would summon the parliaments for a sitting on Jan. 19-20 to pass the new bills and offer condolences to the 15 victims of the Dec. 14 terrorist attack carried out against attendees of a Chanukah candle lighting event, the report said.

Australian authorities say a father-and-son pair, inspired by Islamic State ideology, opened fire on crowds gathered for a celebration of the Jewish holiday, killing and wounding dozens in a premeditated, antisemitic terrorist attack. ...

The legislation will consist of new offenses for “hate preachers,” toughen hate crime penalties, expand a list of proscribed symbols “and set the framework for a new list of banned hate groups,” according to AFP.  ...

Sad, really. As a geologist, I had considered moving there (tremendous mineral wealth) before the Port Arthur Massacre led to insane gun laws (and a firearm destruction that was enough to make one cry). Unfortunately, since then the whole commonwealth has gone mental, and they are spiraling tighter around the bowl, even if the circle goes the other way down under. (Coriolis effect)

A draft of the Combating Antisemitism, Hate and Extremism Bill, seen by the ABC, creates a new federal offence making it illegal to publicly promote or incite racial hatred where the conduct would cause a reasonable person to feel intimidated, harassed or fear violence.

The legislation includes a narrow defence where the speech, writing or other form of public gesture was solely quoting religious texts for the purpose of religious teaching or discussion.

Prime Minister Anthony Albanese on Tuesday used the Old Testament of the Bible to explain the carve out, saying the laws would set a "principles-based test" for conduct and speech that incited racial hatred toward another person or group.

Mr Albanese has recalled parliament to sit for two days next week to debate the wideranging bill that would also create new aggravating factors in existing hate speech laws and establish a listing regime for groups espousing hatred, as well as a national gun buyback scheme and stricter firearm import controls.

The omnibus bill also significantly expands federal firearms background checks, allowing intelligence agencies to provide information relevant to assessing whether a gun licence applicant poses a risk to public safety.

"The terrorists at Bondi Beach had hatred in their minds but guns in their hands. This law will deal with both, and we need to deal with both," the prime minister said.

The new federal hate offence would apply broadly to speech, symbols, gestures and online communication intended to promote or incite hatred "because of the race, colour or national or ethnic origin of the target".

It does not require proof that hatred was generated or that anyone felt fear, only that the conduct would cause a reasonable person to be intimidated, to fear harassment or violence, or to fear for their safety.

Maximum penalties of up to five years imprisonment apply, with higher sentences available where offences are aggravated.

This could include where a religious official or preacher is involved, or where children are targeted.

The bill also establishes a prohibited hate-group listing regime to designate organisations that have "engaged in, prepared or planned to engage in, or assisted … or advocated engaging in" a hate crime.

A group could be listed if the relevant minister believed it "reasonably necessary to prevent harm".

This can be based on intelligence assessments, though no procedural fairness is required.

The leader of the opposition must be briefed on a listing, but would have no veto, and parliament review is available only afterwards.

Penalties will range from up to seven years' jail time for being a member of a listed group to up to 15 years for directing, funding or recruiting for the organisation.

The draft legislation deals with a range of gun control measures, including the creation of a national buyback scheme.

It also tightens or newly restricts importation of a range of assisted-repeating and straight-pull firearms, belt feeders, magazines of more than 30 rounds, firearm suppressors and speed loaders.

The bill would allow ASIO and the Australian Criminal Intelligence Commission (ACIC) to provide intelligence where that information was considered relevant to assessing whether a person posed a risk to public safety.

The threshold is risk, rather than guilt, meaning a person can be deemed unsuitable to hold a firearm without having been charged or convicted of any offence.

Bondi local member to push for laws to be broadened

Independent MP Allegra Spender, whose electorate of Wentworth includes Bondi Beach, has welcomed the new hate speech offence, but raised concerns about its limited scope.

She is pushing for it to go further and cover all minority groups, such as LGBTQ+ Australians and people with disabilities.

Ms Spender said her priority was the Jewish community, but argued it did not make sense for new vilification laws to exclude other minorities.

"Neo-Nazis target the Jewish community, and they target the Muslim community and they target the LGBTQ community, but only one group at this stage will be protected by race laws," she told ABC.

"This is also about consistency."

Ms Spender said she would seek to amend the proposed laws next week, but would ultimately support the legislation in its current form if necessary.

You cannot eradicate hate from the minds of those who are determined to hate someone, anyone, anything with a piece of legislation.

You already had laws against shooting people. What good did they do?

No damned good at all.

Do any Australians, for even a minute, think that passing a law will stop people from killing other people?

In America, numerous such events, both large, and intimately small, have been stopped by armed citizens, carrying their weapon of choice. Please take note of that. It has been estimated that potential victims being armed has stopped over 2 million crimes from being committed every year for some time.

While opinions may differ in political discourse, the harsh reality is that even those who choose not to have arms (and brazenly advocate against other citizens having them), depend themselves on those who are armed to keep them safe from criminals and terrorists. They hate the idea that ordinary people might have the same protection, provided by themselves.

In America, we still have the option, actually, the Right to choose to defend ourselves, others, and if need be, our community, from those who would so us harm (in violation of all those other laws which preclude doing us  harm).

You had no such. No armed citizens--even the man who disarmed the terrorist did not take that weapon and turn it on the terrorists, so heavily have you ingrained the notion of not defending self and community.
 
Where are the men who stood against the Japanese, who fought in Korea, in Vietnam? Mostly, if not all, dead, as is the fundamental right to defend one's self with the best tools available, denied your population because of the acts of an insane few, who, incidentally, still hate you.

And you continue to pursue a policy which has clearly failed.

When you have destroyed all the guns that were privately held (which have not been hidden away in violation of your sensibilities and laws), who will defend you when the Chinese invade, or some Islamic cleric gets a notion to do away with the kaffirs? Just 80 years ago, a hostile Army (and Navy) was bearing down on you, but Australia was better armed, and Australians were made of sterner stuff.
