10 days too late: AG Pam Bondi prevails as Fifth Circuit enforces strict deportation deadline

A Chinese national’s fight to avoid deportation hit a permanent roadblock Wednesday, not based on the merits of his asylum claim, but because his paperwork arrived in the mail ten days after the buzzer sounded.
In a 2-1 decision, the United States Court of Appeals for the Fifth Circuit sided with U.S. Attorney General Pamela Bondi, ruling that strict filing deadlines must be enforced when the government promptly objects to a late arrival.
The case centers on Kun Liao, a detainee at the El Paso Service Processing Center. Liao was attempting to appeal a July 2, 2025, decision by the Board of Immigration Appeals regarding his removal order. Under federal law, he had 30 days—until August 1—to file a petition for review.
