DOJ Moves To Block Vermont’s Climate Superfund Act Targeting Energy Companies
The Justice Department argues Vermont’s law unlawfully punishes energy producers for alleged causation of extreme weather.
by Scott McClallen  September 19, 2025, 12:48 PM

The Justice Department’s Environment and Natural Resources Division has filed a motion for summary judgment in its challenge to the State of Vermont’s “climate superfund” law. [emphasis, links added]

The law aims to impose liability on foreign and domestic energy companies for their alleged past contributions to climate change.

The complaint was filed in May.

“The [Climate Superfund] Act imposes retroactive strict liability and severe monetary penalties on foreign and domestic energy companies that allegedly contributed to global greenhouse gas emissions over the course of nearly three decades,” the motion said.

“In so doing, the Act seeks to extend Vermont’s regulatory reach far beyond the State’s borders, purporting to police nationwide airspace and, indeed, the entire world.”

Sometimes I just wish that the energy companies would abandon a place like this and see if its citizens can stand life without energy.

Vermont would be a perfect place to do so during the upcoming winter season.

  • I was a "conspiracy theorist". Now I'm just right.

Seventeen Techniques for Truth Suppression

Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. It would be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end for they do so with the approval of their own conscience.
