I want burning the US flag to be treated the same as burning the trans flag

If 1 is a hate crime, they’re both hate crimes

While we're talking about flags, we should work to overturn every conviction for those arrested, fined, or otherwise harassed for the "hate crime" of doing donuts over Pride flags painted on public streets.

Yeah.  SCOTUS decided decades ago that burning a US flag is "protected speech."  That remains the state of the law.  Burning any flag should apply to all flags as protected speech, including the rainbow flag, but currently it does not and that needs to be addressed.

That may be the point, aside from a little grandstanding. If burning ANY flag is protected speech, then burning the tranny/pride/communist etc. flags is also.

It's a weird issue, because burning anything in public, other than like a cigarette, is a big no no right? Burning all flags should maybe be banned in public because it's dangerous. Reasonable IMO.

I had no idea that burning a trans flag was a hate crime. Ya learn something new every day.


That being said...I would never burn Old Glory and would probably give someone engaged in the act a piece of my mind...but it's not illegal.

Exactly.  Despicable as it is, flag burning is NOT a crime, so how can the Executive branch simply throw people in jail and even unilaterally set penalties for it?  That requires legislation from Congress, and even then it's unconstituional.

Test case.  Probably be thrown out of court when the probable cause hearing takes place since it's not a crime.  They *might* be able to charge him with disorderly conduct but that's only a misdemeanor without jail time.

It's a crime, in that there are laws against vandalism, disorderly conduct or setting fire to things in an unsafe manner. Leave criminalizing conduct to lawmakers, not EOs.
