NASHVILLE, Tenn. (WZTV) — Kilmar Abrego Garcia has been freed from Putnam County Jail and is on his way to reunite with his family in Maryland, his lawyer confirms to FOX 17 News.

This comes after a U.S. magistrate judge was expected to grant the release Friday as he awaits trial on federal human smuggling charges.

Kilmar Abrego Garcia was released Friday from Putnam County Jail in Tennessee and is traveling to Maryland to reunite with his family as he awaits trial on federal human smuggling charges, his attorney told Nashville's Fox 17 News.

The Salvadoran man, who was mistakenly sent to the high-security CECOT prison in El Salvador by the Trump administration in March, was returned to the U.S. in June following a lengthy court battle.

"Today, Kilmar Abrego Garcia is free," Abrego Garcia's attorney, Sean Hecker, told Fox 17. "He is presently en route to his family in Maryland, after being unlawfully arrested and deported, and then imprisoned, all because of the government's vindictive attack on a man who had the courage to fight back against the administration's continuing assault on the rule of law. He is grateful that his access to American courts has provided meaningful due process."

Newsweek reached out to the Department of Homeland Security (DHS) for comment via email Friday afternoon.

Alleged MS-13 gangbanger and accused human smuggler Kilmar Abrego Garcia was released from a Tennessee jail Friday and is bound for his family in Maryland, his lawyer said.

Abrego Garcia walked out of the Putnam County Jail after the Trump administration deported him and then facilitated his return to the US for prosecution on human smuggling charges.

NASHVILLE, Tenn. (AP) — Immigration officials said they intend to deport Kilmar Abrego Garcia to Uganda, after he declined an offer to be sent to Costa Rica in exchange for remaining in jail and pleading guilty to human smuggling charges, according to a Saturday court filing.

The Costa Rica offer came late Thursday, after it was clear that the Salvadoran national would likely be released from a Tennessee jail the following day. Abrego Garcia declined to extend his stay in jail and was released on Friday to await trial in Maryland with his family. Later that day, the Department of Homeland Security notified his attorneys that he would be deported to Uganda and should report to immigration authorities on Monday.

His attorneys declined to comment on whether the plea offer had been formally rescinded. The brief they filed only said that Abrego Garcia had declined one part of the offer - to remain in jail - and that his attorneys would “communicate the government’s proposal to Mr. Abrego.”

Kilmar Abrego Garcia, an illegal alien from El Salvador, was taken into custody by Immigration and Customs Enforcement after arriving for a check-in with the field office located in Baltimore, Maryland. Officials have revealed they are starting removal proceedings to send him to a third-world country. One such option on the table is Uganda.

Abrego Garcia’s attorney, Simon Sandoval Moshenberg, spoke with reporters outside the ICE office, saying officials had declined to inform them where they were detaining his client prior to his removal or tell them why he was being arrested.

“As of the last five minutes, Mr. Abrego Garcia has filed a new lawsuit in the federal district court for the District of Maryland challenging his confinement and challenging his deportation to Uganda, or to any other country unless and until he’s had a fair trial— as in, an immigration court, as well as his full appeal rights,” Sandoval-Moshenberg told the press.

Abrego Garcia’s legal battles have been headline news worldwide after being deported from the United States by the Trump administration to El Salvador for violating a 2019 court order.

A federal judge in Maryland blocked the Trump administration on Monday from immediately deporting Kilmar Abrego Garcia to Uganda after he was arrested by Immigration and Customs Enforcement officials hours earlier, delivering a temporary blow to the government's efforts to remove the Salvadorian migrant at the center of a months-long court fight.

Simon Sandoval-Moshenberg, Abrego Garcia's attorney, said Monday that he filed the emergency motion after his client was taken into immigration custody at the ICE Field Office in Baltimore, after he appeared there as a condition of his pretrial release from criminal custody.

The new filing asks a judge to block Abrego Garcia's removal from the U.S. until his immigration case can play out via the proper channels, ensuring due process protections — including the right to a reasonable fear interview before being removed to a third country.

Judge Paula Xinis said that she planned to move quickly in weighing the emergency request, telling both Justice Department lawyers and attorneys for Abrego Garcia to confer privately to hash out a proposed briefing schedule, with an eye towards Friday as a possible date for an evidentiary hearing. The judge said she would hold off on any decisions until after the hearing.
