Texas Moves To Oust Dem Lawmakers Who Fled State

Texas Attorney General Ken Paxton announced Tuesday that his office would be formally moving to oust Democrat lawmakers who fled to blue states in order to sabotage a vote on GOP-led redistricting, which is set to draw out five Democrat-controlled districts ahead of the 2026 midterm elections.

The controversy erupted earlier this week when Democrat lawmakers in the Texas state house fled to a number of blue states, mostly Illinois, in an effort to block the vote.

The Texas House – which is currently comprised of 88 Republicans and 62 Democrats – cannot vote on the proposed redraw unless two-thirds of its members are present. “This is not a decision we make lightly, but it is one we make with absolute moral clarity,” Gene Wu, chair of the House Democratic Caucus, said in a statement.

Under Texas law, the House sergeants-at-arms and the state Department of Safety have legal authority to locate and retrieve absent members within Texas borders, State Rep. Nate Schatzline explained.

Texas Democrats previously broke quorum in 2003 and 2021. In 2003, they attempted to stop a mid-decade redistricting, while in 2021 they tried to block an election bill with sweeping voting restrictions. Both efforts were unsuccessful.

“By removing themselves from the State for the explicit purpose of interfering with the proceedings of the Texas Legislature, Democrats are refusing to perform their duties in a manner that amounts to abandonment of office,” the release continued. “If the runaway members of the legislative minority do not return to the House and resume performance of their duties by the deadline, Attorney General Paxton will seek judicial relief confirming that their office is vacant.”

If their seats are legally declared 'abandoned' and vacant, Texas may be able to hold special elections to replace them.

Two panicked Democrat state reps returned to the Texas Capitol on Tuesday after Governor Abbott threatened to have them arrested and removed from office for fleeing the state to block GOP redistricting efforts.

The 5th Circuit in New Orleans ruled that the "Coalition Districts" in Texas violated the Voting Rights Act.

Trump won in four of the five currently Democrat held districts last time around and they are apoplectic over it. The proposed new map actually looks like Texas votes.

A group of Democratic legislators spent roughly four times that amount to take a private jet to Illinois in an attempt to block their Republican counterparts from passing a new congressional map. But they didn’t have to worry about the price tag—because Beto O’Rourke’s PAC picked it up.

That’s according to a report in the Texas Tribune, which cited two people involved in the effort to raise funds for Texas Democrats’ walkout. O’Rourke’s PAC, Powered by People, is “armed with a $3.5 million war chest” and has covered most of the costs associated with the walkout so far, including “air transport, lodging, and logistical support,” the outlet reported. Every dollar the group receives going forward will go toward supporting the walkout.

O’Rourke’s emergence as the walkout’s financier could land him in legal trouble. Lawmakers who flee Texas to prevent the state legislature from having enough members to pass laws are subject to $500-a-day fines under Texas house rules, which also prevent walkout participants from soliciting political contributions to pay those fines. Republican governor Greg Abbott has said that “any other person who ‘offers, confers, or agrees to confer'” such contributions to the “fleeing Democrat House members” may be in violation of state bribery laws.

FBI granted request to locate fleeing Texas House Democrats, Sen. Cornyn says

ABC News ByBrittany Shepherd and Isabella Murray

Sen. John Cornyn, a Texas Republican, said on Thursday that FBI Director Kash Patel has granted his request for the federal government to assist with locating Texas House Democrats who fled the state in protest of GOP-led redistricting efforts.

Cornyn's letter requesting federal help with locating and investigating the state legislators was sent on Tuesday.

"I thank President Trump and Director Patel for supporting and swiftly acting on my call for the federal government to hold these supposed lawmakers accountable for fleeing Texas. We cannot allow these rogue legislators to avoid their constitutional responsibilities," Cornyn said in a news release.

If the seats are vacated, do they count against a Quorum?  It may be they don't need to have bodies in them for the purpose of defining a Quorum.

   If Gov Abbott declares the seats vacant then they automatically reach the quorum necessary to vote on the redistricting plan.

This is the second investigation launched by Paxton in as many days seeking information from groups alleged to be supporting the Texas House Democrat quorum break.

Texas Attorney General Ken Paxton has announced the launch of a formal investigation into Texas Majority PAC—funded by leftist billionaire George Soros—for its “role in potentially unlawful financial coordination and bribery of Democratic legislators who fled Texas to break quorum.”

The Texas Majority PAC was founded by former staffers from Robert “Beto” O’Rourke’s unsuccessful campaign for governor and has since gained national attention. The PAC is largely funded by leftist billionaire George Soros. Latest reports indicate it has around $600,000 cash-on-hand.

Paxton described the PAC as “radical,” with a mission aligned with other left-leaning organizations aiming to influence Texas politics.

Paxton alleges that the PAC played a “coordinating role” in assisting with illegal fundraising operations and possibly bribing Texas House members. These actions, Paxton maintains, may have incentivized lawmakers to abandon their legislative responsibilities, an act that—if financially rewarded—could constitute bribery under state law.

NO QUORUM: House Speaker Hits Fleeing Texas Dems in Pocketbook, Paychecks Held at Capitol, Budgets Cut

As the 1 p.m. deadline for a quorum call came and went, Texas Speaker of the House Dustin Burrows announced a series of actions to hit House Democrats in their pocketbooks.

Speaker Burrows announced 96 members of the Texas House clocked in for duty Friday at 1 p.m.  The roll call board showed 95 members present. One other member was on the House floor but did not activate his light. This means eight Democrats were present. The House rules require 100 members to be present to conduct business.

Burrows declared a series of actions designed to hit the quorum-busting Democrats financially.

First, Burrows stated that members who were absent without an excuse to break quorum would no longer receive their paychecks or per diem payments via electronic deposit. Instead, the speaker said, the members will have to pick up their checks in person at the Capitol.

He also announced the withholding of 30 percent of the absent member’s monthly operating budgets. These funds “will be reserved and made unavailable for expenditure,” he stated.

Furthermore, members must be present in person to make specific requests. These include requests for travel reimbursement, changes to staff salaries, and approval of newsletters.

The speaker ordered all members to be present on Monday and be ready to conduct the business of the House.

The speaker, in conjunction with Texas Attorney General Ken Paxton, took additional actions to compel the presence of the jet-setting Democrats who fled to Illinois, California, and other states.

“Yesterday, Attorney General Ken Paxton and I took action to domesticate the civil arrest warrants in the state of Illinois seeking to make them enforceable beyond Texas state lines. I expect suits in other states will be forthcoming,” the speaker announced during the brief pro forma session of the Legislature.

He added that the Sergeant of Arms of the Illinois House of Representatives for their help in returning absent members of the Texas House. He said that additional suits will be filed in other states where the Democrats are hiding out.

The order came at the request of Attorney General Ken Paxton, who O’Rourke accused in a separate lawsuit of going on a “fishing expedition, constitutional rights be damned.”

Former U.S. Rep. Beto O’Rourke cannot financially support Texas Democrats who left the state to delay passage of a new congressional map, a Tarrant County judge ruled Friday evening.

O’Rourke and his political group, Powered by People, were sued by Texas Attorney General Ken Paxton Friday afternoon. Paxton argued that the group was deceptively fundraising for and illegally helping support Texas Democrats as they fanned out to Illinois, Massachusetts and New York to deny the House the headcount needed to pass legislation.

Tarrant County District Judge Megan Fahey granted Paxton’s request for a temporary injunction, barring O’Rourke and Powered by People from fundraising for the Democrats or spending money to cover their expenses. The order came less than four hours after Paxton’s office filed the petition.

Fahey, a Republican, was appointed by Gov. Greg Abbott in 2019 and has twice been reelected to the bench.

In her ruling, Fahey agreed with Paxton’s contention that Powered by People engaged in false, misleading or deceptive fundraising practices, and by distributing funds to Texas Democrats, writing in the ruling that the group either “directly violates or causes Texas Democratic Legislators” to violate state law and House procedures.
