Supreme Court allows Trump to resume Education Department layoffs
by Zach Schonfeld and Lexi Lonas Cochran - 07/14/25 3:30 PM ET

The Supreme Court on Monday allowed President Trump to resume efforts to dismantle the Department of Education in an apparent 6-3 vote along ideological lines, lifting a judge’s order to reinstate hundreds of employees terminated in mass layoffs.

The administration’s victory enables the president to move closer to fulfilling of one of his major campaign promises to oversee the elimination of the Education Department, which was created in the 1970s.

The majority did not explain its reasoning, as is typical in emergency decisions. The court’s three Democratic-appointed justices publicly dissented, calling their colleagues’ ruling “indefensible.”

“It hands the Executive the power to repeal statutes by firing all those necessary to carry them out,” wrote Justice Sonia Sotomayor, joined by Justices Elena Kagan and Ketanji Brown Jackson.

“The majority is either willfully blind to the implications of its ruling or naive, but either way the threat to our Constitution’s separation of powers is grave,” they continued.

Since entering office, the administration has sought to lay off half of the Education Department’s workforce and move some of the agency’s core functions, such as managing student loans, to other federal departments.

U.S. District Judge Myong Joun blocked those efforts in May. Ruling that Trump needed congressional authorization, Joun ordered the administration reinstate the roughly 1,400 workers laid off in March.

The Supreme Court’s ruling lifts Joun’s injunction as the litigation proceeds in the lower courts, but it is not a final decision. The dispute could return to the justices.

Following the ruling, Education Secretary Linda McMahon vowed to carry out the layoffs once again.

The usual suspects.  At least they didn't let Kajenge write the decent.

Mighty nice of SCOTUS to allow the chief executive to run the executive branch!

  • Dems-greatest existential threat to USA republic!
I was never a supporter of the Dept of Education.  The results are clear.  Education quality has declined dramatically since the department was created.  So, they accomplished nothing of note.

But they do control student loans for those at colleges and universities across the nation.  With the department nixed, who picks up that process moving forward?  My understanding is that student loans could be disrupted causing hundreds of thousands of USA students to face not being able to continue their education.  If that happens, more votes lost by the Republicans for 2026.

I have an idea.  Why don't we just alienate every citizen in the USA?  Sure appears to be the Trump mission.  Ah yes, how to win friends and influence enemies.  Hmmmm!!!

Obama took government control over student loans.

Make private loans once again the standard and leave government out of it.

And a start is already made

Trump’s Big Beautiful Bill Obliterates Major Cash Cow For Universities

The newly passed “Big Beautiful Bill” made major changes to the higher education system, but probably the biggest win is the elimination of a little-known student loan program for graduate students.

The BBB rolled back or delayed many bad policies from the Biden administration, such as the SAVE student loan repayment plan and a couple of costly regulations. The new law also introduced a (pretty minimal) accountability system, expanded access to Pell grants, raised taxes on college endowments, and created a new student loan repayment program.

The elimination of Grad PLUS, however, is the true star of the bill’s higher education reform measures.

Grad PLUS was a type of student loan available for graduate students pursuing a master’s, doctoral, or professional degree. The program was a disaster, creating a gold mine for colleges while leaving students and taxpayers in the dust.
