Brennan is scum and should be behind bars for any number of things he's already done, but advocating insubordination does not fit the definition of treason, to wit: "Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort." Even prosecuting him for these remarks on some lesser charge is probably not a good idea, since he can mount an affirmative defense by arguing that illegal orders have been given and that disobeying them would not, in fact, but insubordination, but rather constitute a duty.
