GOP House Oversight Committee Chairman and other Republicans are raising concerns about whether former President Joe Biden's cognitive functions were good enough to authorize aides to use an autopen tool to sign important documents on his behalf.

On Friday evening, Axios released exclusive audio footage of Biden's interview with Special Counsel Robert Hur, which reveals clues about Biden's cognitive functioning while president that the interview's transcript did not elucidate. Biden can be heard slurring his words, muttering and taking long pauses. Meanwhile, he failed to recall the date of his son Beau's death or the year Trump was first elected. 

"It questions who was actually making the decisions," Rep. James Comer, R-Ky., said Friday night on Fox News Channel's "Hannity."

 "Clearly, from that interview, which was many, many months prior to the heavy use of the autopen, Joe Biden wasn't capable of making decisions. He wasn't coherent."

The Biden administration’s alleged use of an “autopen” is growing into a much larger scandal, President Donald Trump claimed on Saturday.

The president’s comments come after a Heritage Foundation report said in March the majority of official documents signed by former President Joe Biden were done so by using an autopen signature, raising many questions, per Breitbart News.

Trump’s post on Truth Social read:

    “Whoever had control of the “AUTOPEN” is looking to be a bigger and bigger scandal by the moment. It is a major part of the real crime, THAT THE PRESIDENTIAL ELECTION OF 2020 WAS RIGGED AND STOLEN! Former President Joe Biden’s use of an “autopen” to sign last-minute pardons looks like a much “bigger scandal” after the full audio of his scattered interview with special counsel Robert Hur was released Saturday, President Trump said.

“Whoever had control of the ‘AUTOPEN‘ is looking to be a bigger and bigger scandal by the moment,” Trump posted on his Truth Social before launching into a tirade against the “thugs” on the House Select January who all were granted preemptive pardons from prosecution by Biden.
 
Members including former Rep. Liz Cheney (R-Wyo.) and Sen. Adam Schiff (D-Calif.) were granted the blanket clemency during his final days in office in what appeared to be autopen-authorized documents, according to a subsequent Heritage Foundation analysis.

Raid their homes before dawn and take them into custody...like Jan 6th 'perps'.  Hold them WITHOUT bail as potential flight risks.  As it is technically/legally "treason", immediately set up military tribunals...while they stew for a couple of months in solitary confinement.

In a TruthSocial post time-stamped 3:55 PM EDT, President Donald Trump accused staffers in the Biden administration of “treason at the highest level” for assuming what should have been the president’s responsibilities by utilizing the “the Autopen.”

Earlier on Tuesday at a press conference, Trump said his administration will probe the use of the autopen during while Biden was in the White House. In March, Trump posted that some of the pardons Biden allegedly signed in the last days of his presidency were in fact not signed by Biden and “he did not know anything about them!”

The policy decisions made over the Biden years, Trump said, were not his. “Joe Biden was not for Open Borders, he never talked about Open Borders, where criminals of all kinds, shapes, and sizes, can flow into our Country at will,” Trump wrote. “It wasn’t his idea to Open the Border, and almost destroy our Country, and cost us Hundreds of Billions of Dollars to get criminals out of our Country, and go through the process we are going through now…”

Prior to serving as president from January 20, 2021 to January 20, 2025, Biden had been known as politically “moderate” and ran against Trump under that banner.

While in the U.S. Senate in 2007, Biden said, “No great nation has uncontrolled borders” and supported building a fence along the southern border.

In an article dated May 13, 2021, The Los Angeles Times made the case that Biden campaigned as a “progressive.”

“Biden never concealed his big-government goals; they were all in plain sight in his platform,” the paper wrote, “…Candidate Biden called for more than $4 trillion in new federal spending, beginning with an immediate stimulus to help the economy recover from the COVID-19 pandemic. It included massive proposals to combat climate change, rebuild infrastructure, reduce poverty, subsidize child care and provide universal pre-K education.”

However, the outlet recounted Biden’s previous “moderate” stance as compared to Sen. Bernie Sanders (I-VT), a self-declared socialist who initially appeared likely to win the 2020 Democrat presidential primaries. After Rep. James Clyburn (D-SC6) endorsed Biden, he was jettisoned to victory, handily becoming the Democrat presidential nominee.

U.S. House Republicans are zeroing in on the use of an autopen by former President Joe Biden that is believed to have been used for sensitive pardons and executive orders signed in the final days and hours of his administration, including several for his closest family members.

New revelations about the declining mental acuity of Biden have prompted House Oversight Chair James Comey (R-KY) to deepen his investigation into whether Biden was lucid and approving of the pardons and orders, or whether those around him forged ahead to protect Hunter Biden, James Biden, Dr. Anthony Fauci, and others from future criminal prosecution.

For the past year, many of the players involved were saying “they had just talked to Biden, [and] he was tip-top, great physical condition, he was at the top of his game,” Comey said in a recent interview. “Now they’re coming back saying, ‘Yeah, looks like he was in mental decline.'”

Central to the investigation will be who in the Biden White House authorized the use of an autopen, a tool traditionally utilized by heads of state for the signing of less prominent resolutions, executive orders, or legislation requiring an official signature. Comey and other critics say that, given Biden’s declining mental health, it’s very likely he was unaware of how his signature was being used by others.

How can it be legal if the President did not personally sign it? ... That's the whole point of a signature - authentication.  Auto-Open defeats that.

The answer is YES. Everything that Biden(?) did now has to be reviewed and authenticated. I think they will find most, if not all, of the so called "preemptive pardons" (which does not exist in law) were autopen by Hunter, Jill, or possibly just random staff. Who knows?

And, who knows if those pardons were bought with bribes?

Since Biden was out of the loop AWOL, the kids just went crazy and did whatever they wanted to do. With Biden, the power of the Presidency was with whomever claimed it, e.g. Jill, Hunter, Mayorkas, Fauci, Pelosi, Schumer, random staff members, among others.

Perhaps the time is right to introduce a brief Constitutional amendment that requires any legislation or order from the president to be personally signed by same in the presence of at least three witnesses.

And that also forbids the use of any electronic, mechanical or combined electrical/mechanical device to be used to reproduce the president's signature, with the exception of documents that convey no legal actions or policies (such as personal letters).

The Pubbies in Congress would support this.
Not sure about the dem-communists (although with ol' white joe gone, I see little downside for them to oppose it).

The amendment would sail through the state legislatures.

I wouldn't count on the current brouhaha to result in anyone being charged.
