Hawaii Dems Have Cooked Up New Climate Lawfare Scheme Targeting ‘Misinformation’
The Aloha State advances bill allowing lawsuits for climate misinformation.

Hawaii Democrats have advanced a bill that would clear the way for individuals and insurers adversely affected by an “event attributable to climate change” to sue companies and other entities for spreading climate “misinformation.” [emphasis, links added]


S.B. 1166, introduced by Democratic Hawaii State Sen. Chris Lee, aims to “provide a new, specific cause of action for any person other than an officer or employee of a state or local governmental entity” and insurers to file suit against companies or other entities that supposedly misinformed the public about the nature of climate change.

Lee introduced the bill on Jan. 17, and it is currently in the hands of the Hawaii House, according to LegiScan.

“The legislature finds that for decades, certain people and entities have spread intentional lies, misinformation and disinformation, and misrepresentations about the connection between climate change and fossil fuel products, as well as how climate change has caused injuries in the State,” the bill’s text reads.

Those of the authoritarian persuasion in government have historically and often used the same modes of false argumentation to justify the silencing of dissenting opinions:

  • All experts agree with "X", and it is therefore established wisdom.
  • There is no legitimate disagreement from "X", whose truth has already been established beyond a doubt.
  • Those who claim to disagree with "X" are liars motivated by bad intentions.
  • All disagreement with "X" is therefore harmful to the public interest, and must be silenced for the public good, before the liars do any harm.
  • Those who persist in opposing "X" are a danger to the public at large, if they cannot be silenced, their behavior ought to be criminalized.
Those of you schooled in logical fallacies will recognize several of them contained within the examples above, including the appeal to authority, the "bandwagon" fallacy, the ad hominem attack, the Slippery Slope and the False Dilemma.

Hawiian independence.
Hasn't there been a movement for this, for years?

We'll keep Pearl Harbor and some surrounding territory.
