MSNBC legal analyst Danny Cevallos refuted claims that President Donald Trump’s executive actions amount to a “constitutional crisis.”

Several liberal legal scholars argued in The New York Times on Monday that Trump’s efforts to reform the federal government have caused a “constitutional crisis,” with one characterizing the president’s actions as “lawless.” After “Morning Joe” host Mika Brzezinski read from the NYT article and asked for his take, Cevallos urged caution when uttering “constitutional crisis,” asserting that executive orders alone cannot meet that threshold.
 

“I think we need to be careful with the term constitutional crisis because, as I define it, that would be a situation where the Constitution doesn’t have an answer and there is a pressing conflict. The flurry of executive orders, the chaos, that I think doesn’t get us to crisis yet. It is irritating for the courts,” Cevallos told Brzezinski. “It is challenging. It could lead to a serious problem if, as you said, they become too congested with dealing with these orders. The crisis occurs, and we’ve already talked about it, at the moment when there is a court order and the president or the administration refuses to follow it, because historically, we don’t really have a clear answer for what to do in that situation.”

The Dems are lost in the wilderness.  For Dems to resort to filing lawsuits for everything Trump and Musk are doing is a losing strategy.  First off, the president has the right to run the executive branch of government.  If there is waste and fraud existing in any branch of government, he not only has the right but the responsibility to end the abuse.

And I believe he has the right to instruct the DOJ to investigate and possibly indict those acting with criminal intent.

The hole is getting deeper for the Dems.

Show us the line item in the appropriations bills that explicity allocate specific amounts of funds for FEMA to pay for illegal immigrants and USAID to buy Politico subscriptions?

If Congress makes the mistake of giving the Executive piles of money without line item appropriations, that gives the Executive much discretion for disbursement of those funds.

If Dems in Congress don't like it, they can learn to pass proper bills of appropriation and budget bills.  Unfortunately, many of the Pelosi budgets were just abstract framework spending bills which allowed Biden discretion to spend money and Trump discretion to not spend money for specific line items.

The Imperial Presidency is the creation of a Congress that does not want to do its job to act as an independent branch of Government and as a check on Executive Power.

Too many Congress' have acted as extensions of the Executive and carried water for DNC and RNC executive agendas.

Congressional Republicans need to be able and willing to tell a Republican Executive 'no'.  Congressional Dems need to be able and willing to do tell a Dem Executive 'no'.  Otherwise Congress will not be a check and balance upon executive power.

Without passing proper legislation, Congress cedes its powers and authorities to act as a check and balance on the Executive and Judicial branches.

Presidents and Judges do not pass laws and do not pass budgets.

Congress needs to put on big boy pants and fulfill its Constitutional role to check and balance the other two branches of Government.

Congress has long abdicated its responsibility to do its job for decades.

I think Trump should issue an Executive Order that requires any regulation /law created by the bureaucracy to be reviewed and voted on by Congress.  Put an absolute halt to the bureaucracy imposing anything upon the American people.  PERIOD!!!

Perhaps if Congress started doing their job, life would be better in the USA.  Far less frivolous regulation that is suffocating business, etc.

Maybe it's just me, but the Dem's shouting and singing about the end to waste in the government seems like a losing strategy. :shrug:
