The Georgia Court of Appeals has officially disqualified Fulton County DA Fani Willis from prosecuting President-elect Donald Trump and his remaining co-defendants in the crumbling 2020 election interference case.

According to the 31-page decision handed down Thursday, the state's appeals court ruled that there was, in fact, a conflict of interest that arose when Willis hired special prosecutor Nathan Wade and proceeded to have an undisclosed affair with him during the prosecutorial process.

Applying the "appearance" standard, the three-judge panel—comprised of all GOP appointees—concluded that the "significant" "appearance of impropriety" was indeed "improper."

"While we recognize that an appearance of impropriety generally is not enough to support disqualification, this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings," the ruling reads, finding that the lower court's "remedy" was insufficient.

Willis had been under scrutiny over her relationship with a special prosecutor on the case, Nathan Wade.

The court said that the previous ruling by Fulton County Superior Court Judge Scott McAffee, who allowed Willis to remain on the case as long as Wade left it, did not prevent the "appearance of impropriety."

"The remedy crafted by the trial court to prevent an ongoing appearance of impropriety did nothing to address the appearance of impropriety that existed at times when DA Willis was exercising her broad pretrial discretion about who to prosecute and what charges to bring," the court said. "While we recognize that an appearance of impropriety generally is not enough to support disqualification, this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings."

That last part means none of the other Prosecutors in her office can prosecute this either.  This may be a death blow to the flimsy case.

The Court also disqualified her entire office's Prosecutors.  There is nobody left to Prosecute this case!

Fulton County District Attorney Fani Willis and her entire office was disqualified from prosecuting Trump in their lawfare RICO case.

The appeals court did not throw out the charges, however, Fani Willis and her office have “no authority to proceed.”

The Georgia Appeals Court disqualified Fani Willis because of an appearance of impropriety.

President-elect Donald Trump chimed in on the news that Fulton County District Attorney Fani Willis has been disqualified and her team from the prosecution effort against him.
 
In an exclusive interview with Fox News, the president-elect slammed the entire case, saying it should be dismissed. He lashed out at Willis for engaging in “corrupt” behavior and demanded an apology for himself and others who have been caught up in the proceedings.

“It was started by the Biden DOJ as an attack on his political opponent, Donald Trump,” he said, “They used anyone and anybody, and she has been disqualified, and her boyfriend has been disqualified, and they stole funds and went on trips.”

Trump said the case “should not be allowed to go any further.”

Can co-defendant Harrison Floyd now sue for false imprisonment for spending six days in Fulton County Jail?

And Kudos go out to co-defendant Michael Roman and his attorney Ashleigh Merchant for blowing the lid off this whole case.
