Biden commutes roughly 1,500 sentences and pardons 39 people in biggest single-day act of clemency
Story by COLLEEN LONG • 1h

WASHINGTON (AP) — President Joe Biden is commuting the sentences of roughly 1,500 people who were released from prison and placed on home confinement during the coronavirus pandemic and is pardoning 39 Americans convicted of nonviolent crimes. It's the largest single-day act of clemency in modern history.

The commutations announced Thursday are for people who have served out home confinement sentences for at least one year after they were released. Prisons were uniquely bad for spreading the virus and some inmates were released in part to stop the spread. At one point, 1 in 5 prisoners had COVID-19, according to a tally kept by The Associated Press.

Biden said he would be taking more steps in the weeks ahead and would continue to review clemency petitions. The second largest single-day act of clemency was by Barack Obama, with 330, shortly before leaving office in 2017.

“America was built on the promise of possibility and second chances,” Biden said in a statement. “As president, I have the great privilege of extending mercy to people who have demonstrated remorse and rehabilitation, restoring opportunity for Americans to participate in daily life and contribute to their communities, and taking steps to remove sentencing disparities for non-violent offenders, especially those convicted of drug offenses.”

“America was built on the promise of possibility and second chances"

I don't remember seeing anything like this in the Constitution or Federalist Papers. :pondering:

"remove sentencing disparities for non-violent offenders," This either.

"restoring opportunity for Americans"  I take it, then, his pardons and reductions won't include illegal immigrants.

What I remember seeing in the Federalist Papers and Constitution are respect for, and adherence to the law, that breaking the law was a crime against all Americans who ultimately make the laws.

Reminds me of an Obama document dump, only it's Thursday.

Might be interesting to see who is on the list and how they ended up there.

Between this and trips to the beach, he might become known as The Great Commuter...

Biden pardons for gay military veterans fall short of expectations as demands grow louder for more

.

President Joe Biden’s past efforts to pardon specific groups of people en masse have fallen short of expectations, a reality the White House is declining to address in the waning hours of his presidency.

Biden in 2022 and 2023 issued presidential proclamations designed to pardon “thousands” who were convicted in federal courts of simple marijuana possession offenses and its use. As of this December, the Office of the Pardon Attorney has issued only 257 certificates of pardon to applicants for relief.

Biden most recently in June launched a new application program to wipe clean the records of veterans expelled from the military due to their sexual preferences from a period spanning World War II through the ending of the Pentagon’s “Don’t Ask, Don’t Tell” policy in 2011.

At the time, the White House had estimated the executive forgiveness would pardon thousands, but a Sept. 26 report from The War Horse indicated that just eight veterans — six from the Air Force and two from the Army — had applied for the program.

Biden slammed for commuting sentence of notorious ‘Kids-for-Cash’ judge convicted of imprisoning juveniles for $2.1M kickbacks

The corrupt former Pennsylvania judge convicted of funneling juveniles to for-profit detention facilities in exchange for $2.1 million in kickbacks had his lengthy prison sentence commuted Thursday by President Biden.

Former Luzerne County Judge Michael Conahan, the jurist at the center of the so-called “Kids-for-Cash” scandal, was among 1,499 commutations the 82-year-old lame-duck president granted in the larges

“I am shocked and I am hurt,” Sandy Fonzo, whose son committed suicide after he was locked up as part of the scheme orchestrated by Conahan and former judge Mark Ciavarella, said in a statement.

This makes me think - nah - a man with his integrity would never just be given names to pardon after certain honorarium are provided to his bank account.

The Federalist by Brianna Lyman 12/12/2024

President Joe Biden announced on Thursday that he was granting 39 pardons and 1,499 commutations in what his administation called the “largest single-day grant of clemency in modern history.” But it’s not Thursday’s set of commutations that have caught the attention of concerned Americans — it’s those that were quietly given weeks ago to Chinese spies.

X user Nick Sortor posted that “Joe Biden just pardoned multiple Chinese spies and an individual convicted of possessing child p*rnography. WHY?”

But the thing is, Biden didn’t “just” commute the sentences for these criminals — he did it quietly only days before Thanksgiving.

While most Americans were finalizing their menus and getting into the holiday spirit, Biden commuted the sentence of Yanjun Xu on November 22. Xu was convicted in 2022 for “conspiracy to commit economic espionage; conspiracy to commit trade secret theft; attempted economic espionage by theft or fraud; attempted theft of trade secrets by taking or deception.”

But according to Biden’s pardon, “it is in the national interest that the term of imprisonment related to the aforesaid conviction not be served in its entirety.”

No, a man with his integrity would be removed from the process of funneling the funds through multiple shell corporations, likely owned by someone(s) close, before a dime ever got to him. Someone else handed him the list.

What's the nightly rate for the Lincoln Bedroom these days?

What's the price of a Pardon vs Commuting a Sentence?  Which online auction site is Biden using to sell these?

Drug traffickers, crack dealers, cartel leaders and fraudsters appear on President Joe Biden’s list of nearly 1,500 individuals who he granted clemency Thursday, court records reveal.

As part of his record-setting clemency grant, Biden announced Thursday he would commute sentences for individuals “who were placed on home confinement during the COVID-19 pandemic and who have successfully reintegrated into their families and communities.” The list of commutations released by the White House includes several high-profile criminals.

One individual, Francesk Shkambi, was initially sentenced in July 2014 to 27 years in prison for leading a criminal organization to “smuggle cocaine and marijuana into the United States from Albania,” according to court records.

“Shkambi also negotiated with a foreign source to traffic cocaine from Mexico to Europe,” the records show. “The jury found Shkambi responsible for trafficking 85 kilograms of cocaine, 4 kilograms of heroin, approximately 122 pounds of marijuana, and 4,000 pills of Ecstasy.”

Biden pardons Chinese spies convicted of stealing American tech secrets
Story by Isabel Vincent • 15h

President Biden pardoned two Chinese spies and the relative of a high-ranking member of the Chinese Communist Party who was caught with tens of thousands of images of child pornography on his computer last month in a prisoner swap between the two countries that was made public Thursday when the three received clemencies.

Yanjun Xu and Ji Chaoqun, who were both convicted of espionage, were granted clemency last month, along with Shanlin Jin, who was convicted of possession of more than 47,000 images of child pornography while a doctoral student at Southern Methodist University in Dallas in 2021.

Their clemencies, signed by President Biden, are dated Nov. 22

Five days later, on November 27, the Chinese government released three Americans who were serving prison sentences in the Communist country: Mark Swidan, a businessman from Texas, who was arrested in 2012 and accused of drug related offenses; Kai Li, who had been held since 2016 on espionage charges; and John Leung, who was sentenced in 2023 to life in prison on spying charges.

Editorial: There is no justice in Biden's commutation of Kids for Cash judge
Tribune-Review | Saturday, Dec. 14, 2024 6:01 a.m.
Quote
Michael Conahan should be familiar with what goes into difficult decisions about crime and punishment and their effect on a person’s life.

Conahan was a Temple-trained lawyer who spent 13 years as a Luzerne County Court of Common Pleas judge. ... In 2009, he pleaded guilty to a scheme in which he and another judge, Mark Ciavarella, funneled children as young as 8 years old into for-profit juvenile detention for crimes including smoking and skipping class. The two judges netted $2.8 million in kickbacks.

Conahan subsequently would withdraw that plea, then enter another. In 2011, he was sentenced to 17½ years in federal prison and penalized almost $1 million in fines and restitution. Ciavarella’s sentence was 28 years.

Ciavarella has stayed in custody. The Bureau of Prisons lists him as an inmate at a federal facility in North Carolina. But in 2020, Conahan was released to home confinement because of covid-19. On Thursday, the now 72-year-old disbarred and disgraced former judge was included in a wide net of about 1,500 federal prisoners whose sentences were commuted. Like him, they were serving their sentences at home since the pandemic. ...

There is no “great privilege” in extending mercy to a judge who sold out children to acquire wealth. Conahan already was out of prison. Would 20 more months of the minimal confinement of his own home be an onerous burden? ...

Biden commutes 20-year sentence of former Latrobe beverage company CEO who pleaded guilty to fraud
Quincey Reese | Saturday, Dec. 14, 2024 2:55 p.m.
Tribune Review

President Joe Biden on Thursday commuted the sentence of Gregory J. Podlucky, former chairman and CEO of a now defunct Latrobe beverage and bottling company who was sentenced to 20 years in federal prison in 2011 for his role in a multimillion dollar fraud scheme. ...

Podlucky, a former Ligonier resident, started LeNature’s Inc. in 1989.

He pleaded guilty about 13 years ago to swindling the company’s investors out of more than $629 million. Podlucky siphoned $37 million in loans that he spent on cars, precious gems, jewelry and toy trains.  ...

Why is anyone surprised.  At face value, Biden is the biggest criminal ever to sit at the Resolute Desk.

Emptying the jails for him seems par for the course.

If he had pardoned people sitting in jail for nothing more than possession of a joint (probably put there by Kamala Harris), that would be one thing. But spies and criminals who abused children or defrauded people out of tens of millions? Where's the justification? You're right, Joe is as sleazy and slimy as those he pardoned.
