A federal judge on Friday ordered Virginia to halt its removal of potential non-citizens from state voter rolls, a decision expected to restore the voting rights to some 1,600 residents ahead of Election Day.

U.S. Judge Patricia Giles issued a preliminary injunction Friday to reinstate all voters that had been removed from state voter rolls in the state in the last 90 days, finding that the removals had been in fact "systematic," not individualized, and were thus a violation of federal law.

The news comes just weeks after the Department of Justice sued Virginia over its program, arguing the removals were conducted too close to the Nov. 5 elections and violate the National Voter Registration Act– a federal law that requires states to halt all systematic voter roll maintenance for a 90-day "quiet period" before an election.

Justice Department officials also cited concerns that eligible votes may have incorrectly been removed from the rolls without adequate notice, or enough time to correct the mistake.

"States may remove names from official lists of voters in various ways and for various reasons, but they may not carry-on this kind of systematic removal program so close to a federal election," DOJ officials wrote in filing their Oct. 11 lawsuit.

The injunction upholds this line of thinking, and is likely to be met with fierce pushback from Gov. Glen Youngkin, who has insisted the voters were removed legally and has himself objected to a court ruling less than two weeks before a federal election.

This tells me that Virginia is a lot more in play than the dims and MSM pollsters are letting on.

Also, if Trump wins as big as I think he will and the Pubs win the House & Senate the Pubs better push through federal election rules that eliminate as much of the fraud as possible. I would love to see a 4 day weekend instituted with hand counted ballots, no drop boxes and absentee ballots only allowed for illness. The voter rolls can be cleaned in a matter of days with the computing power that exists.

This judge, a Biden appointed judge, simply does not mind violating federal law.  She should be removed from the bench, for she is incompetent!

Morons like this is the simple reason why judges should face regular competitive elections and not have life appointments.

I don't get the logic behind the 90 day quiet period.  That would allow 3 months for any number of illegals to register and vote.  Seems the law needs to be revisited as soon as possible.

Almost all these individuals had previously presented immigration documents confirming their noncitizen status, a fact recently verified by federal authorities.

"This is a Virginia law passed in 2006, signed by then-Governor Tim Kaine, that mandates certain procedures to remove noncitizens from the voter rolls, with safeguards in place to affirm citizenship before removal–and the ultimate failsafe of same-day registration for U.S. citizens to cast a provisional ballot. This law has been applied in every Presidential election by Republicans and Democrats since enacted 18 years ago.

"Virginia will immediately petition the Fourth Circuit Court of Appeals and, if necessary, the U.S. Supreme Court, for an emergency stay of the injunction."
