Chief Justice John Roberts became the target of the latest batch of leaks related to the Supreme Court this week, prompting criticism from center-left commentators about Roberts’s apparent efforts to find consensus on cases involving former President Donald Trump.

Last February, Roberts reportedly sent his eight colleagues a confidential memo critiquing a lower appeals court for failing to “grapple with the most difficult questions altogether” in Trump’s bid to claim presidential immunity against at least some of the 2020 election subversion indictment brought by special counsel Jack Smith, according to the New York Times.

The New York Times piece primarily focused on Roberts going to great lengths to try to secure unanimity on three cases involving Trump: an effort to disqualify him under the 14th Amendment’s insurrection clause, the immunity case, and a lawsuit that sought to trim the sails of Jan. 6 indictments involving an obstruction statute the Biden Justice Department had applied broadly.

In Trump v. Anderson, the court ruled 9-0, albeit for different reasons, that Trump can remain on the ballot in all 50 states. The justices ruled 6-3 to find that presidents and former presidents maintain some level of immunity from criminal indictments in Trump v. United States, and they also ruled 6-3 to narrow the application of the obstruction statute in Jan. 6 cases in Fischer v. United States.

Nope.  But I have no doubt that it was Sotomayor.  And she's probably the leak on this one too.

At the justices’ private conference meeting that day, Justice Sotomayor protested that she did not see how the court could reverse the appellate decision. It would look like the Supreme Court was being used to delay the trial, she said, according to someone with knowledge of the proceedings.

So how would the New York Time reporters know what Sotomayor was thinking if she did not tell them?

I cannot possibly convey horror of this development which is entirely predictable given nothing happened re Dobbs. I served for ~25 years as career law clerk for federal appellate judge on 7th Cir. I was privy to so much information & confidential communications b/w judges and about other judges. Thought of disclosing any of it is of a repulsiveness exceeded only by a priest disclosing confidences of a confession. This breach will truly threaten independence of judiciary, with lower courts likely seeing same w/ it turning into political warfare

For the second time in two years, a leak of an internal Supreme Court document has occurred, this time noting Chief Justice John G. Roberts Jr.’s communications with his colleagues.

The New York Times reported Sunday that it had obtained a Feb. 22 memo written by the chief justice to his eight colleagues about a ruling by the U.S. Court of Appeals for the D.C. Circuit on the federal election interference case against former President Donald Trump.

Chief Justice Roberts called it “inadequate and poorly reasoned,” the Times reported.

“I think it likely that we will view the separation of powers differently,” he wrote, according to the newspaper.

It is the second leak of internal high court documents. ...

The New York Times recently wrote that Chief Justice John Roberts "deployed his authority to steer rulings that benefited" Donald Trump in "a momentous trio of Jan. 6-related cases." AP

In an ugly escalation of the left’s war on the Supreme Court, The New York Times last week offered up a hit on Chief Justice John Roberts, falsely charging him with “deploying his authority to steer rulings that benefited” Donald Trump in “a momentous trio of Jan. 6-related cases.”

Plus, the story relied in part on leaks of confidential court documents — which means court staff, and possibly one of the justices, are actively helping the progressive attack on the institution.
