SURPRISE, Ariz. — A Surprise woman was escorted out of a city council meeting and arrested on Aug. 20 after attempting to speak about the city attorney's salary.

In the city council meeting video, 32-year-old Rebekah Massie told the council she would address agenda item six, regarding the city attorney's contract.

Massie told council members she had concerns with the city attorney's contract being renewed with a raise.

"Recent months have uncovered numerous violations or alleged violations in blatant disregard, I would say, for not only the Arizona Revised Statues, the State Bar rules of professional conduct but also the Arizona State Constitution and the Bill of Rights at the federal level," Massie said at the meeting.

Massie went on to explain some of the alleged violations but was interrupted by Surprise Mayor Skip Hall.

"Ms. Massie, I've got to interrupt you here because this is the public meeting forum you agreed to when you speak and I want to read this to you," Hall said. "That there are 'Oral communications during the City Council meeting may not be used to lodge charges or complaints against any employ of the city, or members of the body, regardless of whether such person is identified in the presentation by their name, or by any other reference that tends to identify him or her."

Massie immediately told Hall that he was violating her First Amendment rights. Hall disagreed.

"This is your warning," Hall said.

"Warning for what?" Massie said.

"Warning for attacking a city attorney personally," Hall said.

"This is factual information," Massie said. "You are violating my First Amendment rights."

"It doesn't matter," Hall said. "This is what you agreed to for speaking, this is the form."

Massie signed the form that stated the rules for the public forum, but she said the rules were unconstitutional and said she could curse at them for three minutes straight and it would be protected speech. Hall again disagreed.

After a verbal exchange continued, the mayor ordered police to escort Massie out.  .  .

Yeah, this is a clear violation of her 1st Amendment rights, form or no form.  The city attorney is a public official, paid for with taxpayer funds, so he is NOT immune to public criticism during public meetings.  Surprise is going to be in for a surprise when it has to write this lady a big check with lots of zeroes.

While I don't know what her actual "rights" are here, given the rules of speaking to the council....seems like she might not want to make known her crusade just yet.

While I don't know what her actual "rights" are here, given the rules of speaking to the council....seems like she might not want to make known her crusade just yet.

Her actual rights are enumerated in the Constitution. What part of it is unclear to you? The Right to Petition Redress seems abundantly clear to me.

Also, crusaders often smite their enemies.

If she didn't agree with the form she signed, why did she sign it.

She should have sued or asked  that it be eliminated claiming it is a violation of 1st amendment rights. 

However, her claim she can curse at them for 3 minutes is not valid.

Has there been an update to this story since it happened?  I'm interested to see if the local DA actually will try to prosecute her, or just quietly drop the charges and memory hole the episode.

Heh, so the city attorney quickly realized how badly they had screwed up and then had council repeal the unconstitutional policy quickly and quietly at the end of that meeting, in the hope that it would moot the case and forestall the inevitable lawsuit.

It looks like the council members of Surprise are the ones who decided to change the rules midstream when they chose to go against the State Constitution.

Yeah, the sign-up form, in and of itself, was unconstitutional from the get-go.  I bet the city lawyer did a little research and learned, to his horror, that the mayor, in having her arrested and dragged out of the meeting, had just opened the town up to a multimillion dollar lawsuit.

On Wednesday, an Arizona judge dismissed the criminal case brought against a state resident who was arrested after criticizing her city government during a public meeting.

“The Defendant should not have faced criminal prosecution once for expressing her political views,” Justice of the Peace Gerald Williams wrote.

The entire saga began on Aug. 20, when resident Rebekah Massie spoke before the Surprise City Council during a public meeting. The Arizona mother was criticizing the conduct of the city attorney when she was abruptly cut off by Mayor Skip Hall, who accused her of “attacking” the city official “personally” and violating rules governing public meetings.

Massie claimed the rule was “unconstitutional” and that by limiting her testimony, the city was violating her First Amendment right to free speech. Following a short exchange of words, Hall called on a law enforcement official to have Massie removed from the meeting.

The Arizona mom was subsequently detained and charged with trespassing.

Writing on behalf of the Maricopa County Justice Courts, Williams dismissed the charge against Massie with prejudice, meaning the state cannot bring the case back to his court. The judge noted that “[n]o branch of any federal, state, or local government in this country should ever attempt to control the content of political speech,” and that, in Massie’s case, “the government did so in a manner that was objectively outrageous.”  .  .  .

Seem like they need to fire the city attorney for letting them think they could do something like this. 

At the same time, what about time limits.

In most council meetings, you are allowed a certain amount of time to speak. 

What if you go over....is that a violation.
