Trial will not be held in Latah County, where University of Idaho student murders took place

An Idaho judge has granted suspected quadruple murderer Bryan Kohberger's request to have his trial moved out of Latah County, where he is accused of killing four college students in an early morning home invasion attack.

Judge John Judge's order was unsealed Monday, moving the trial to an unspecified new location, possibly the larger Ada County -- and finding that massive media coverage of the case could taint the local jury in and around Moscow, where the attack took place.

Ada County also has a larger courthouse to accommodate more members of the public and what is expected to be a large contingent of journalists.

Prosecutors sought to have the trial held at the courthouse in Moscow, next to the jail where the 29-year-old Kohberger has been held without bail since shortly after his arrest in Pennsylvania at his parents' house, roughly seven weeks after the Nov. 13, 2022 slayings.

Kohberger's lawyers argued that the suspected quadruple murderer cannot get a fair trial in Latah County due to "extensive, inflammatory pretrial publicity."

Judge wrote that he based his decision on the "totality" of factors, including legal and logistical concerns, expert testimony and the concerns of lawyers on both sides.

Idaho student murders suspect Bryan Kohberger has accepted a plea deal to spare his life in exchange for a guilty plea in the murders of four University of Idaho students, two sources close to the case told Fox News Digital Monday.

Kohberger, 30, is accused of killing Madison Mogen, 21, Kaylee Goncalves, 21, Xana Kernodle, 20, and Ethan Chapin, 20, in a 4 a.m. home invasion attack on Nov. 13, 2022.

Goncalves' family, in a Facebook page her parents created after the murders, condemned the deal, which spares Kohberger's life.

"We are beyond furious at the State of Idaho," a new post reads. "They have failed us. Please give us some time. This was very unexpected."

All four had been stabbed multiple times with a large knife. Police recovered a Ka-Bar sheath that they allege had Kohberger's DNA on it near Mogen's body.

Kohberger was studying for a Ph.D. in criminology at Washington State University in Pullman, Washington. That's 10 miles up the road from Moscow, Idaho, where all four victims were undergrads at the University of Idaho.

The plea deal came as a surprise – prosecutors had not telegraphed the move and fought hard to keep the death penalty on the table in pretrial proceedings.

Kohberger's defense failed repeatedly to have it removed, revealing his autism diagnosis and crying foul over discovery deadlines it claimed that prosecutors missed.

As disappointed as the parents are that their child's murderer will not be executed, I have to believe the prosecution told them at some point that it was a possibility he'd get only a life sentence.

I would like to clarify a couple of things...we DID talk to the prosecution on Friday about the POSSIBILITY of a plea deal and it was a HARD NO from our family. It was very nonchalant and barely discussed as the majority of the conversation was surrounding the upcoming trial. NOTHING in our conversation prepared us for the next steps. Sunday night we received an email that sent us scrambling. We immediately jumped into panic mode and started making phone calls and sending emails. We met with prosecution AGAIN today to reiterate our views on pushing for the death penalty. Unfortunately all of our efforts did not matter. We DID OUR BEST! We fought harder then anyone could EVER imagine. Please do not argue or try to tell us that we should have done this or that. We gave it 200% for the last 2 years and 7 months.  One day we will tell you all what we have really been through from day one. You will all be shocked. We fought a  long battle, but we lost the war. We did gain an army of love that we know will always stand by us! We have so much love for each and every one of you. You all gave us strength when we felt like we couldn't take another step, called us off the ledge when we were ready to wave the white flag, and most importantly prayed for us when we were in utter despair and hopeless. Fox News legal analyst Gregg Jarrett said Monday on “Hannity” that he believes 30-year-old Bryan Kohberger pleaded guilty to the murders of four University of Idaho students because the evidence presented by prosecutors effectively convicted him.

Reports broke Monday that Kohberger accepted a plea deal on all counts tied to the 2022 murders of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Kernodle’s boyfriend, Ethan Chapin. The Goncalves family expressed disappointment that Kohberger would avoid the death penalty. Host Sean Hannity asked Jarrett for his reaction.

“Yeah, it’s understandable, but the government always has the final say,” Jarrett said. “Kohberger, he knew what he did. He knew he was headed for a very quick conviction and the death penalty. So after this two-and-a-half-year charade, he finally confessed to save his own life.”

“A credit, I think, is owed to the prosecutors and investigators. They methodically assembled a very powerful case. No defense could overcome it. They forced Kohberger to accept their terms. No possibility of parole on a life sentence, waive all rights to appeal. Philosophically, life in prison or death, that’s a Hobson’s choice.

Thanks.  Listening to Nancy Grace, I thought maybe the death penalty was automatic, but only for guilt at trial.

Nancy Grace was very upset yesterday, and I'm not sure why.  I would think since she won't allow herself to remember, even now, the details she heard at the trial of her fiance's murderer -- the details were that painful --- that she'd be relieved for the families of Kohberger's victims. But, she's furious.

I completely agree. Sitting thru a trial of that nature would have been excruciating. And there was no guarantee of a death penalty. Let's face it...a lot of juries are squeamish about that. As it stands he's in prison for life with no appeals available. He might as well be dead.
