It makes the stakes even higher for Trump...he either wins the Presidency and goes back to the White House or he loses and goes to jail. It's pretty obvious that that's what Merchan's planning to do, but was probably talked out of it by NY Dems who understand that doing so now would rile up the Republican base and ensure a Trump victory by making him a martyr.
