Hunter Biden drove Joe Biden's Cadillac to store to purchase gun, defense says

During opening statements, Hunter Biden's defense attorney said that Hunter Biden drove his father's Cadillac to the gun store to purchase the firearm in question in his criminal trial.

Abbe Lowell on Tuesday morning said that Hunter drove the car to a cell phone store and while there, he went across the street to the gun store and ended up purchasing the gun.

Lowell argued that Hunter was abusing alcohol and not drugs when he purchased the gun and when he said he was not a user, his understanding was that he was not at that point. The defense also argued that Hunter Biden was rushed into the gun sale by a salesperson that wanted to make the sale.

The defense also argued that the prosecution will not adequately establish chain of custody re: gun pouch with cocaine residue. They argue that Hallie Biden “freaked out” when she found Hunter’s gun in the console of his car, put it in that pouch, threw it in a garbage can outside a grocery store, and that someone rummaging through garbage found it. Then the police tracked it down and it’s been sitting in evidence for five years.

Hunter is charged with one count of making false statements in a firearm purchase, another count of making a false statement related to information required to be kept by a licensed firearm dealer, and one count of possession of a firearm by a person who is an unlawful user of or addicted to a controlled substance.

If he is found guilty on all charges, he could face a maximum sentence of 25 years in prison. Each count also carries a maximum fine of $250,000 and three years of supervised release.

INSIDE THE COURT: Jurors appear bored at ongoing evidence of Hunter Biden's addiction

Jurors appear increasingly bored with first witness testimony, which has largely focused on Hunter Biden's audio book version of Beautiful Things. Some jurors are slumped over in their chairs, have their heads in their hands as Hunter's narration of the book is heard in court.

Biden has periodically looked over to study the jurors, most notably when they enter and exit the courtroom.

Biden has been engaged throughout court proceedings - whispering to defense team, reading along with excerpts of Beautiful Things while taking his light orange framed reading glasses on and off. He sometimes appears tense as he fidgets with pen and runs his hands through his hair.

First Lady Jill Biden is sitting in the front row, with her daughter Ashley and daughter in law Melissa sitting on either side of her. Jill keeps her focus towards the judge and defense team - seldom looking around the court. She also has a small booklet of papers folded over that she has taken out at least twice to read/write notes. The papers are returned to her clutch handbag.

Hunter Biden’s memoir recalling ‘crackhead wisdom’ played in court, Ashley Biden in tears

The prosecution played excerpts of Hunter Biden's memoir, "Beautiful Things," in court Tuesday morning read in Hunter's voice.

The excerpts include references to "crackhead wisdom," “the ability to find crack in any town," "crack takes you into the deepest recesses of your soul and the worst parts of town.”

“When I could, I tried to buy from a user instead of a dealer," Hunter Biden said in another part of the audiobook. "I could get off a plan in Timbuktu and find some crack."

Ashley Biden, Hunter's sister, was seen patting her face with a tissue while the audiobook was read. First Lady Jill Biden then put her arm around Ashley.

Matt Whitaker: How can Hunter Biden's lawyer defend this?
Former acting Attorney General Matt Whitaker on the details of the Hunter Biden gun trial and Letitia James previously campaigning on going after former President Donald Trump.

"It's going to be a compelling story for this jury," Whitaker said. "Essentially the elements of the crime are very simple, and that's one of the things about this case... this is a well-worn path to justice in this case. Compare that to what happened in New York City where they're still debating over what crime Donald Trump was convicted of."

Whitaker also touched on First Lady Jill Biden being in court, noting that the Biden family is likely well-known by many of the jurors.

"This is very much a home court advantage for the Biden family and having Jill Biden as the first lady walk into court and sit behind Hunter. It sends a very clear message to that jury, who are again, citizens of Delaware," Whitaker said.

Prosecution's first witness is sworn in for testimony

FBI agent Erika Jensen, the prosecution's first witness, took the stand shortly after 11:30 a.m.

Prosecutor Derek Hines asked Jensen a handful of biographical questions at the beginning of her testimony.

Jensen said her duties are to investigate violations of federal criminal law and that she was assigned in fall 2023 to investigate Hunter Biden.

Paper copies with excerpts of Hunter Biden's book, "Beautiful Things," were shown on the screen. The prosecution also played audio from Hunter’s audiobook - of Hunters own voice - for the court as they go through the pages.

Jensen confirmed that she and other agents picked these pages as evidence of addiction and use of drugs - specifically during a four-year period from 2015 to 2019. Jensen said she focused on mentions in the book from 2015 to 2019 to find admissions of guilt about an addiction to drugs.

The prosecution can produce incontrovertible evidence that Hunter did everything he was charged with, and this jury will still find him innocent.

Hunter Biden's laptop introduced as evidence in gun crime trial

The prosecution has introduced Hunter Biden's infamous laptop as part of electronic records to be entered into evidence. FBI special agent Erika Jensen is on the witness stand verified the laptop belonged to Hunter Biden

The FBI obtained the laptop from the Mac store in Delaware based on a tip they were given. was on a tip that they were given. It is a small silver Mac laptop, and the FBI agent saying "this is the laptop recovered from the store." The FBI confirmed this because the serial number of the laptop found matches the initial subpoena they requested in 2019.

In terms of content from the laptop, the FBI special agent testified the evidence of addiction was recovered from the electronic records found.

The device is not being turned on, just physically present in the courtroom. They are not going through any of the records directly from the laptop.

Prosecutors present evidence Hunter Biden smoked crack days after buying gun

Prosecutors presented evidence that Hunter Biden attempted to buy and smoked crack in the days after he purchased the gun.

Prosecutors shared a text message exchange from October 13, 2018 that featured Biden sending a message to Hallie Biden indicating that he was "waiting for a dealer named Mookie."

The next day, two days after the gun purchase, prosecutors presented evidence that Biden sent another text message to Hallie Biden that said he was recently sleeping on a car while smoking crack.

Prosecutor: Hallie Biden to Testify About ‘Embarrassing’ Use of Crack with Hunter Biden

Wendell Husebø 4 Jun 2024

Hallie Biden, the ex of Hunter Biden and widow of his brother, will testify about her use of crack with Hunter, prosecutor Derek Hines said during Tuesday’s opening statements of the gun trial.

Hallie, 50, dated Hunter in 2018 and found a Colt Cobra .38 handgun in Hunter Biden’s truck outside her home, prosecutors say. Hallie dumped the gun in a nearby grocery store trash bin, according to prosecutors.

Hunter used crack when he purchased the firearm, a wide variety of photos from the time on his abandoned laptop show. The Secret Service allegedly intervened in the investigation of that incident.

Hunter Biden is charged with one count of false statement in the purchase of a firearm, one count of possession of a firearm by a person who is an unlawful user of or addicted to a controlled substance, and one count of false statement related to information required to be kept by a federal firearms licensed dealer.

Hines said Hallie’s testimony would be “embarrassing” but necessary, according to court reporters.

The prosecution will call several additional witnesses, including Gordon Cleveland, who sold the gun to Hunter Biden at Starquest Shooters, NBC News reported:

Hines revealed that both Hallie Biden and Zoe Kestan, a woman who was romantically involved with Hunter Biden, will be testifying under immunity agreements.

The prosecution will also call Kathleen Buhle, the ex-wife of Hunter Biden who shares three daughters with him and who did not use drugs herself. Kathleen will not be testifying under any immunity agreement.

Laying out the three charges against Hunter, Hines emphasized that on the third count, concerning his possession of the gun for 11 days, Hunter did not get rid of the gun by choice. “The only reason he had the gun for 11 days is because Hallie took it from him,” he said.

The judge barred TV, audio, and Slack messages at Hunter’s trial, so court reporters have to rely “on notes, runners, or for reporters to come out of the courthouse in person,” CNN reported.

The case is United States v. Hunter Biden, No. 24-1703 in the United States Court of Appeals for the Third Circuit.

Is Hunter Biden Pursuing a Jury Nullification Strategy?
June 5, 2024

Below is my column in The Hill on the start of the Hunter Biden trial and the elements of a classic jury nullification strategy by the defense. It is not clear that it will work in an otherwise open-and-shut case, but it might. What is clear is that it may be all that Biden has short of the Rapture.

Here is the column:
Quote
There was an interesting development this week in the Hunter Biden gun trial: the fact that there will indeed be a Hunter Biden gun trial.

That development is surprising only because there do not appear to be any facts in dispute in this case. And the primary witness against Hunter Biden will be Hunter Biden himself.  ...

While Hunter could always throw in the towel before the start of testimony, there is currently no discernible strategy beyond hoping that a pending case in the Supreme Court might undermine the indictment.

There may also be another possible strategy in play: jury nullification.

Unlike Donald Trump in Manhattan, Delaware is Biden country. The chance that he will get strong supporters of his father on the jury is an almost statistical certainty. In 2020, Joe Biden received roughly 60 percent of the vote over Donald Trump in the state. Having first lady Jill Biden, who is extremely popular, at the trial will only reinforce the connection.  ...

Hunter Biden's attorney Abe Lowell began his cross-examination of FBI agent Erika Jensen by going back to Hunter Biden's memoir, "Beautiful Things".

Lowell asked Jensen about how she noted the drug binges that he talked about in chapter 7, 8 and nine from his period in 2016 to 2019 and how she noted every instance of a drug binge during this period

Lowell then asked if she noted in the book of a similar drug binge when he returned it to the East Coast in the fall of 2018 something a kin to needing to be on crack, or searching for drugs constantly. This was during the time of gun purchase.

FBI agent Jensen says she couldn't recall any similar binges that she noted in the book during this time period.

Lowell then went to proceed to go through the bank records that the government introduced yesterday as exhibits

In particular, he noted during the month of October 2018, that Hunter made eight purchases at liquor stores or alcohol related grocery stores during that time. Lowell seems to be trying to indicate that Hunter Biden was using alcohol at the time when the decision to purchase the gun was made.

Lowell noted on Tuesday that the gun application form Biden is accused of lying on had a section to declare addiction to drugs, but not alcohol.Jill Biden is in court wearing her bright pink suit is sitting right behind Hunter. Hunter's current wife, Melissa Cohen is sitting to her right.

Hunter has a similar demeanor as he had yesterday. He goes switches between looking the screen in front of him to looking at Lowell, who is questioning the witness, to staring straight ahead.

Defense attorney casts doubt on drug references in Hunter Biden texts

Hunter Biden's defense team attempted to cast doubt on Biden's references to drugs in text messages around the time of the purchase of the gun.

In cross examination of FBI Agent Erika Jensen, the defense pointed to two texts from October 13 and 14, 2018, the first and second day following the gun purchase, in which Biden texted Hallie Biden that he was "waiting for a dealer named Mookie." The defense asks Jensen whether she knows where Biden was when the message was sent or if she knows Mookie exists, garnering a response of "no" from Jensen on both questions.

The defense then turns to the October 14 text in which Biden tells Hallie Biden he was :sleeping on a car smoking crack." The defense asks Jensen whether she knows where Biden was when he sent that message, garnering another "no" response from Jensen.

The defense then points to all text messages between October 8th and October 24th, 2018, and asks Jensen whether there were any other references to drugs in this time period, with Jensen once again responding with "no."

Defense attempts to argue that Hunter Biden's cash withdrawals weren't tied to alleged crimes

The defense team attempted to throw cold water on the prosecution's suggestion that Hunter Biden's cash withdrawals were tied to alleged crimes, such as the drugs and gun purchase.

While questioning FBI special agent Erika Jensen under cross-examination, defense attorney Abbe Lowell went back to the bank records and transactions of the government that were introduced yesterday.

Lowell suggested that some of the cash from the withdrawals Jensen tried to link to the October 2018 gun purchase were spent by Biden on rehab, rent, and tuition for his daughter. He insisted the money was withdrawn for lots of reasons.

Jensen previously testified that Biden withdrew cash on October 12, 2018, to pay for the gun.

Lowell then returned to the ATF form about the gun purchase at the center of the case. They went through the handwriting on the form, noticing distinctions. Lowell asked Jensen if she was actually there observing who actually checked the boxes, etc. She responded she wasn't. Jensen also made clear said that she is not handwriting expert.

One notable distinction was that there were slashes on the zeros in some parts of the form but not other parts Biden would have filled out.

FBI agent testifies that Hunter Biden's laptop was not tampered with

After the defense's cross-examination of FBI special agent Erika Jensen concluded Wednesday, she was asked by prosecutors during redirect whether the contents of Hunter Biden's laptop had been tampered with.

Prosecutor Derek Hines began the redirect of Jensen by asking her if she had seen any evidence of tampering on Biden's laptop when the FBI obtained it. She responded, “No."

Hines also went to Biden's bank records from August 2018 and showed that they were not cash payments, but visa check card payments to the rehab facility, Airbnb, and to Sober Companion.

Additionally, Hines reviewed liquor store receipts. There were eight separate transactions from Oct. 1 to Oct. 30, 2018. They were all check cards, not cash.

Hunter Biden attorney Abbe Lowell previously suggested that some of the cash from the withdrawals Jensen tried to link to the October 2018 gun purchase were spent by Biden on rehab, rent, and tuition for his daughter. He insisted the money was withdrawn for lots of reasons.

Following the redirect of Jensen, court took a short break.

Kathleen Buhle, Hunter Biden's ex-wife, takes stand in gun trial

Kathleen Buhle, Hunter Biden's ex-wife, has taken the stand as the prosecution's second witness following a brief break by the court on Wednesday.

Biden and Buhle were married from 1993 to 2017. Buhle has spoken publicly about Biden's drug addiction and many affairs, including his sister-in-law and widow of his late brother, Beau, Hallie Biden, who is also a witness for the prosecution.

Buhle detailed difficulties in her marriage to Biden in a 2022 memoir titled, "If We Break: A Memoir of Marriage, Addiction, and Healing."

Prosecutors said that throughout 2018, Buhl would search Biden's car because "she did not want their children in a vehicle with drugs." She found drugs or drug paraphernalia about a dozen times, according to court documents. A 2018 text message exchange with Biden said, "I also found a few crack pipes. I took them out because our daughter was driving the car," according to prosecutors.

Hunter Biden's ex-wife testifies she learned of drug use after finding crack pipe on the porch

Hunter Bidens ex-wife, Kathleen Buhle, said during Wednesday's testimony she discovered Hunter Biden was using drugs when they were married and that she found a crack pipe on an ashtray on the side porch of their D.C. home on July 3, 2015.

She asked him about the pipe, to which he said he “acknowledged smoking crack."

Buhle said, however, that she was suspicious he was using drugs ahead of finding the crackpipe because she suspected Hunter was “kicked out of the Navy for testing positive for cocaine.”

She then recalled feeling “worried” and “scared” for him.

Buhle said when Hunter was using he was “not himself” and “angry, short tempered, and acting in ways he didn’t when he was sober.”

She also said he was “smoking crack the day after our anniversary.”

Buhle said she found a “broken pipe” “white powder” and “white crystals” in his car. She said from 2015 to 2019 she would search his car for drugs when he would lend his car to her daughters because “she wanted to make sure they weren’t driving with drugs.”

Wise asked if she would confirm she was checking his car for drugs in 2018, she said, “yes.”

Wise asked if Hunter hid the drug use from family and friends, to which Buhle responded, "yes."

Buhle was called to the stand and was sworn in at 11:34 am. Prosecutor Leo Wise is doing the questioning.

Biden and Buhle were married from 1993 to 2017. Buhle has spoken publicly about Biden's drug addiction and many affairs, including his sister-in-law and widow of his late brother, Beau, Hallie Biden, who is also a witness for the prosecution.

Hunter Biden's stripper ex-girlfriend testifies he smoked crack 'every 20 minutes' during 2018 trip

Zoe Kestan, Hunter Biden's ex-girlfriend, testified Wednesday under immunity that Biden would smoke crack "every 20 minutes" during a 2018 trip.

Kestan said she met Biden in December 2017 while working at a gentleman's club. It was late at night and she was offered to do one more private, 30-minute dance. She said she went into the room with another dancer and Biden was already in there, but she noted she didn't not know who he was at the time. Kestan said there was no music playing in the club since it was late, so Hunter pulled out his phone and started playing music. Kestan said they went into another room and Hunter pulled out a pipe and started smoking. She described it as "a type of pipe I'd never seen before," having a weird smell, and that she "assumed it to be crack cocaine." Kestan said Hunter was also drinking alcohol.

Kestan said after he started smoking that "he was the same charming person." She described Hunter as "incredibly charming" and "charismatic" during this interaction. Hunter proceeded to ask her to come back to his hotel room with him, to which she declined, but gave him her phone number. She said Hunter texted her the address of where he was staying, but she did not respond.

She said it was a week later that she was online and realized the man from the gentleman's club was Hunter Biden.

Kestan's next interaction with Hunter came around January 2018. Kestan said one of her friends was with Hunter at the SoHo Grand and told her to join them, so she went. Kestan said there was loud rock music playing upon entering the hotel room and she saw Hunter "smoking crack within the first 10 or 15 minutes" of her arrival. The three individuals - Hunter, Kestan, and another unnamed woman - hung out all day and went to dinner. The unnamed woman left, but Kestan stayed. Kestan said she stayed at the hotel with Hunter for five days.

During the five-day period, Kestan said that Hunter was smoking crack "every 20 minutes." Kestan added that when they would go out in public or to an event, Hunter would smoke crack "once an hour." One night, she said Hunter left for a business dinner. Kestan said Hunter's demeanor during this time was "charming" and that she "never saw an immediate change in his behavior" while he was smoking crack. She also said she "felt" for him because she knew people with drug addictions.

Kestan testified to hanging out with Biden at other points in 2018, including a meet-up at Atlantic City in February 2018.

Prosecution continues to build case against Hunter Biden

Fox News' Rich Edson provides updates from Hunter Biden's ongoing federal trial. 'Outnumbered' panelists react.

Edson detailed the case the prosecution has made so far, arguing that Biden was a drug user at the time he bought the gun and entering into evidence excerpts from his own book, which detailed his drug use.

The prosecution also entered Biden's laptop into evidence, which featured pictures of Biden next to cocaine.

Kathleen Buhle took the stand, testifying that she found a crack pipe in 2015 but said she had been suspicious before that since Biden had been kicked out of the Navy for cocaine use.S

She also testified that she would not let her children drive Biden's car without checking it for drugs.

Edson also noted that First Lady Jill Biden spent another morning in the court room in support of her stepson, though she has since departed after the morning session.

Stripper ex-lover testifies about Hunter Biden's attempts to get clean

Zoe Kestan, Hunter Biden's ex-girlfriend, testified Wednesday under immunity about his efforts to overcome his drug addiction in 2018.

Kestan testified that the two discussed getting Hunter clean while they were staying at a Four Seasons Hotel. She said he talked about a drug called Combo, venom from a frog that would make you “purge,” which he hoped would help his addiction.

She said that two weeks later, they stayed at a hotel in Midtown Manhattan for about 10 days, where Hunter was trying Combo and had burns on his arm.

“I thought it worked," she told the court, but added that within 20 minutes he was smoking crack again.

Kestan testified that while staying at a separate hotel called The Mercer at a later date, she told Hunter she might move to California to launch a business.

"I love California … I think I could get sober if I go out there with you," Hunter said, according to her testimony.

She later added that it seemed his plan to get sober "had gone out the window" when his drug habit continued.

Jury shown gun Hunter Biden bought in 2018

StarQuest Shooters & Survival Supply employee Gordon Cleveland took the witness stand Wednesday and was asked by the prosecution to walk them through the day Hunter Biden purchased a firearm, October 12, 2018.

Cleveland said he saw Hunter pull up in the black Cadillac owned by Joe Biden and greet him without knowing who Hunter Biden was at the time.

Cleveland said that Hunter Biden came in and said he was looking for a firearm. When he asked specifics Hunter said he was looking for a revolver.

After looking through the store with Cleveland, Hunter eventually settled on a Colt Cobra, with customized wood grips

The prosecution, with permission of marshals, brought the actual gun out to display

Derek Hines, the prosecutor, brought the gun up to Cleveland and asked him to identify the make and read off the serial number

Mr. Hines then proceeded to show and display the Colt Cobra to the jury.

Gun store employee takes the stand in Hunter Biden trial

StarQuest Shooters & Survival Supply employee Gordon Cleveland has taken the stand.

The prosecution had indicated they planned to call on Cleveland, an employee of StarQuest Shooters & Survival Supply owner Ronald Palimere, who is believed to be the employee who sold Hunter Biden the gun at the center of the case.

StarQuest Shooters & Survival Supply is the Delaware store where Biden allegedly purchased the gun, a purchase prosecutors allege was made possible by Biden lying on a background check about his drug use during the purchase process.

Prosecutors are expected to question both Palimere and Cleveland about how and when the federal gun purchase form was filled out by Biden.

Cleveland's testimony comes on the third day of the trial, with the prosecution already calling FBI Agent Erica Jensen, Biden ex-girlfriend Zoe Kestan, and Biden's ex-wife Kathleen Buhle.

Biden faces 25 years in prison if convicted on all charges.

Hunter Biden told ex-girlfriend he'd 'always be an addict'

Zoe Kestan, ex-girlfirend of Hunter Biden, testified that Hunter once told her that he would "always be an addict."

In September 2018, after spending time at their time at his house in Malibu, Kestan said she departed and did not see him again until mid November 2018. They were stayed in Massachusetts, and ended up in Providence, Rhode Island. Hunter was also looking for drugs. specifically cocaine of the time, Kestan testified. According to her, Hunter also said he was on a ketamine treatment for addiction.

November 20, 2018 was the last time they ever saw each in person .

Prosecution ended its line of questioning with a follow up text message that Hunter sent a few weeks later to Zoe partially that read. “I can be sober but I’ll always be an addict”.

Krestan read that aloud in the court.

Immediately after, defense attorney Abbe Lowell began cross-examination and points out that from this time period, -- in late September through November -- Krestan had no contact with Hunter Biden and was not aware of what he was doing, his state of mind or anything else.

That timeframe covers the time of the gun purchase.

Gun store employee testifies Hunter Biden filled out drug portion of application for pistol

StarQuest Shooters & Survival Supply employee Gordon Cleveland testified that Hunter Biden filled out the portion of the gun application related to drugs.

Cleveland testified that he told Biden after he decided to buy the gun that he would need to fill out a form to complete the purchase.

Cleveland said he gave Biden the form, while Biden gave Cleveland his passport as a form of identification. Cleveland also testified that he was "two feet" from Biden as he filled out the form.

Shown the form by the prosecution and asked if that was the form Biden filled out, Cleveland responded with a "yes."

Cleveland also testified that he told Biden to fill out the form "truthfully," an to "take your time," while watching him fill out the form.

He further testified that he personally saw Biden fill out question 11e, which asks whether he was an unlawful user of or addict to drugs, with Cleveland saying he personally watched Biden check the "no" box.

Hunter’s Missing Gun Appears at Trial 6 Years Later

Wendell Husebø 5 Jun 2024

Hunter Biden’s missing revolver appeared at his gun trial after six years, when the FBI got involved in the case of a missing firearm tossed in a Delaware dumpster.

Text messages from Hunter previously revealed what appears to be a contradiction in an official Secret Service statement, which claimed the agency had “no involvement” in the incident involving Hallie Biden, Hunter’s ex lover, finding a gun “inside of Hunter Biden’s pickup” and tossing “it in a trash can behind a grocery store where they frequently shopped.” Yet Hunter’s text messages say, “The police the FBI the Secret Service came on the scene,” as Breitbart News reported in 2021.

The gun store owner who sold the weapon to Hunter reportedly refused to supply the paperwork to the Secret Service when it allegedly sought to retrieve it at the time of the incident, suspecting the agency’s officers would keep the documents away from scrutiny.

During Wednesday’s court proceedings, the prosecutors from the Justice Department produced the weapon for the jury and former gun shop employee Gordon Cleveland (who sold the gun to Hunter) to inspect. Jurors “craned their necks” to see the gun for Cleveland to verify. He verified it immediately, according to court reporters.

Cleveland told Hunter at the time of the gun purchase in 2018 to “take your time” in filling out the federal form before he bought it, Cleveland testified. He also said he watched Hunter mark “no” on the question of whether he was a user of illegal drugs.

Hunter used crack when he purchased the firearm, according to a wide variety of photos from the time on his abandoned laptop.

The son of a Democrat politician argues that evidence should be disqualified because there was no chain of custody.

Now, replace the word 'evidence' with the word 'ballots'.

DAY 4

Hunter Biden trial: Gun salesman rejects defense portraying him as pushy
By
Ashley Oliver
June 5, 2024 9:39 pm
.

WILMINGTON, Delaware — A former gun store clerk defended his sales practices as he was grilled by Hunter Biden‘s attorney during the first son’s trial on Wednesday.

Gordon Cleveland, who sold Biden a revolver in 2018, testified that he was more interested in selling customers “quality” items than expensive ones.

Prosecutors called Cleveland, a trash truck driver and onetime employee of Starquest Shooters & Survival Supply, to the stand to testify about the interaction he had with Biden at the time of the purchase.

Special counsel David Weiss has alleged Biden lied about his drug use on a federal form to purchase a Colt Cobra and that he illegally retained the firearm for 11 days.

Cleveland testified that he watched Biden fill out the form, which prosecutors displayed as an exhibit to the courtroom. The form featured Biden’s signature and showed the first son had checked off “no” in response to a question about whether he was an unlawful drug user or drug addict.

He said Biden filled it out at a normal pace “like you would do with any form.”

Cleveland recalled how Biden had driven up to the store in a black Cadillac, walked into the small shop, and told the clerk he was looking for a revolver.

First lady Jill Biden will not appear in court to support her step-son Hunter Biden on Thursday due to her trip with President Biden outside the country.

The first lady, who was in attendance for the first three days of Hunter Biden's gun trial this week, is currently in France to commemorate the 80th anniversary of D-Day.

The president and first lady were photographed touring the Normandy American Cemetery in Colleville-sur-Mer, France, on Thursday.

President Biden's younger sister, Valerie Biden Owens, is in court Thursday amid the first lady's absence.

Testimony resumes after dispute over text message evidence

The jury was seated just after 9:30 Thursday and the defense continued their examination of gun store employee Gordon Cleveland.

Before the jury was seated there was an objection on the use of text messages between Hallie and Hunter Biden the defense was attempting to enter into evidence.

At issue was the way the texts were extracted from Hunter Biden's laptop, which varied slightly from the prosecution, who had limitations on what they could extract.

The decision was made that the prosecution will be able to check that each message the defense wants to introduce match what the government already has in their extraction report.

Hallie Biden, Hunter Biden's sister-in-law, arrived to court Thursday morning for day four of Hunter Biden's federal gun crime trial.

Hallie is among several potential witnesses who are expected to be called by the prosecution to testify in Hunter's trial. The pair were in a romantic relationship in 2018.

Hallie observed Hunter Biden using drugs on multiple occasions, according to prosecutors, and she and her children discovered drug paraphernalia and drugs in his possession when they searched his bags, backpacks and vehicle in an effort to help him get sober.

Hallie, prosecutors said ahead of the trial, "observed that the defendant frequently lost phones and changed phones, which explains gaps in time where there are no messages, and she also had various text message exchanges with the defendant."

Hallie Biden, the widowed wife of Hunter Biden's brother, Beau Biden, has been called to the stand in Hunter Biden's gun trial.

Hallie Biden, who was romantically involved with her brother-in-law following Beau's death in May of 2015, is expected to testify that Hunter Biden stayed at her home during the fall of 2018 and that she and her children found drugs in his possession multiple times. Hunter Biden also recently generated controversy for visiting Hallie Biden just days before the trial began.

Prosecutors previously called FBI agent Erika Jensen, Hunter Biden's ex-girlfriend Zoe Kestan, Hunter Biden's ex-wife Kathleen Buhle, and gun salesman Gordon Cleveland to testify.

Prosecutors have continued to build the case that Hunter Biden was addicted to drugs at the time he purchased a weapon and lied about his drug use on a federal firearms form.

If convicted on all charges , Biden faces a maximum of 25 years in prison.

Hallie Biden says brother-in-law Hunter introduced her to crack

Hallie Biden testified in court Thursday that her brother-in-law, Hunter Biden, introduced her to crack.

Hallie recounted a June 2018 trip to Los Angeles to meet Hunter at the Roosevelt Hotel, where she used drugs, specifically crack cocaine. She testified that Hunter introduced her to and gave her the drugs.

Hallie continued using drugs until August 2018, she said, and reflected on the experience as one that was "terrible."

"It was a terrible experience I went through and I was embarrassed and ashamed, and I regret that period of my life," she told the court.

She later revisited Hunter at a treatment facility in August 2018.

could’ve been on drugs at the moment. When Hunter went to bed, Halle decided to clean out his car. She said she had done this before to see if there were any remnants of potential drug use, or alcohol.

When prosecutors asked what she had found, she testified that she found remnants of crack, cocaine, dirty clothes, trash, and the gun.Prosecutors then pulled out the actual gun that Hunter purchased and brought it to the witness stand.

They asked Halle to identify the firearm, and she said it looked very similar to the gun that she had seen in the car.

Surveillance footage shows Hallie Biden throwing away Hunter's gun, returning later to look for it

During court Thursday, Hallie Biden recalled the day of October 23, 2018, when she found the gun in Hunter Biden's car and threw it in a trash can outside Janssen's Market.

Hallie said that she was cleaning Hunter's car and found the gun, bullets, and remnants of what she believed to be drugs. Hallie described feeling "panicked" and "wanted to get rid" of the gun because she "didn't want him to hurt himself."

The gun Hunter had purchased from Starquest Shooters and Survival Supply in Wilmington, Delaware, was shown to Hallie in court. She confirmed it looked the same as the one she found that day.

Upon finding the gun, Hallie went back into the house to look for something to put it in. She found a small "gift bag." Hallie then found the brown leather pouch and put the gun inside, then put the pouch with the firearm in it and the bullets in the shopping bag.

Asked what Hunter would normally keep in the brown leather bag, Hallie said "Sometimes business cards, sometimes drugs."

Hallie said she took the gun to the Janssens Market up the road and threw it away in a trash can outside the store, a claim that was backed up by surveillance footage shown in court.

Surveillance footage from October 23, 2018 was played for the court showed Hallie drive up in a BMW. The footage showed her getting out of the car, grabbing the bag with the firearm in it from the back seat, and throwing it away in a trash can. She keeps walking and goes into the grocery store.

"I realize it was a stupid idea now, but I was panicking," Hallie said.

After finding out what happened, Hallie said Hunter told her to go to the store, look for the gun, and if it wasn't there to file a police report since it was registered in his name.

Surveillance footage played for the court showed Hallie going back to the Janssen's Market to look for the gun. Hallie was seen quickly getting out of her car and walking very fast to the trash can. The gun was not there. She was then seen running around looking for the gun. Hallie said she went into the grocery store and asked if the trash had been taken out. Hallie said she then filed the police report at Janssen's Market.

Hallie: "Why won't you answer my calls. Where are you?"

Hunter: "I'm behind Blue Rock Stadium waiting for a dealer named Mookie."

Hallie testified that she understood Hunter was buying "crack cocaine" at the time this message was sent.

Messages from Oct. 14, 2018:

Hallie: "I called you 500 times"

Hunter: "I was sleeping in a car smoking crack on 4th and Rodney."

Hunter: "Where are you"

Hunter: "That's my truth"

.

President Joe Biden pledged not to pardon his son Hunter Biden as he faces a federal gun crimes trial in Delaware.

During an interview in Normandy, France, where Joe Biden is commemorating the 80th anniversary of D-Day, the president provided a one-word response when asked by ABC whether he had ruled out using his clemency powers in the two federal cases against his son, the other relating to alleged tax evasion.

“Yes,” Joe Biden told the network, according to excerpts before the interview airs in its entirety Thursday night.

Hunter Biden is on trial in Delaware on charges he lied on paperwork to obtain a firearm and illegally carried the weapon despite being addicted to drugs. He has also been indicted in California on nine additional tax-related counts, including tax evasion, with those proceedings expected to start in September.

World News Tonight anchor David Muir, too, asked Joe Biden whether he would respect the verdicts in Hunter Biden’s trials.

“Yes,” Joe Biden said.

Jonathan Turley reveals why Hunter Biden isn't pleading guilty in gun trial: 'This is Biden town'

Fox News contributor Jonathan Turley joined "America's Newsroom" on Thursday to discuss what he believes to be "astonishing" about Hunter Biden's gun case and answer why he believes the president's son has pleaded guilty.

Turley, a Constitutional law professor, said he believed the prosecution in Hunter's trial was doing an "amazingly good job"

"This is a very disciplined case. What's really astonishing is how fast all of the defense's put forward by Abbe Lowell collapsed within 48 hours," Turley said. "There was a long argument that the laptop was tampered with. [The prosecution] put on an agent who said there's no tampering here, this is real and authentic."

"[The Defense] said that Hunter Biden wasn't doing drugs when he signed that [gun form]. They have a text from him the next day trying to score drugs from a guy named Mookie, and the day after that doing drugs on the hood of a car, according to texts."

Turley also referenced the gun shop employee who testified that Hunter Biden filled out the gun form and said, "So, all of these defenses collapsed shortly after they were stated by the defense."

"That leads to this question of why isn't he just pleading guilty. This is an open and shut case. It's obvious he was doing drugs and signed the form falsely," Turley said. "That might keep him out of jail, it would've certainly avoided an embarrassing trial."

"The answer is: This is Biden town. This is a Biden who is standing trial in his hometown and this is the opposite of Manhattan," Turley added. "Here, the jury pool could not be better for the defendant, and I think the defense is using a nullification strategy."

Defense attorneys try to cast doubt on Hunter Biden's text messages

Defense attorneys have attempted to cast doubt on text messages that Hunter Biden seemingly indicates he was doing crack or readying to meet a crack dealer.

The defense focused on two texts from October 13th and 14th, around the same time Biden allegedly lied to purchase a gun from a Delaware gun store, noting that Hallie Biden texted Hunter to ask if he was with someone, which Hallie confirmed she suspected could be a woman.

Hunter Biden responded that he was waiting for a dealer named Mookie, but the defense attempted to cast doubt on the idea, arguing that Biden would have actually been with a woman.

The defense also brought up the October 14, 2018 text in which Hunter told Hallie he was sleeping on a car smoking crack, with the defense asking if she actually knows that Biden was actually engaged in that activity at the time of the text.

Hallie Biden responded "no" to the defense question.

Defense attorneys scramble to get additional texts into evidence, confusing jury

Defense attorney Abbe Lowell sought to enter certain text messages between Hallie Biden and Hunter Biden into evidence, confusing the jury and others in court.

Lowell and the defense team are trying to introduce some new texts into evidence. Leo Wise and the prosecution team are complaining because they only got notice about these texts at 11:07 p.m. last night, and they haven’t had time to review them, and don’t know the source, other than they came from the 18,000 pages worth of data from the laptop.

It seems Lowell and his team thought the government had everything and knows where everything is, when it comes to the laptop. Wise explained that’s not the case, the data goes through a filter team, and it’s possible that the defense team has texts that the government has not even seen yet.

Wise wants to know where these texts are in the laptop. Judge Noreika peppered the defense with questions about this before the jury came in this morning. That process went on for nearly 30 minutes. Lowell and his team are scrambling to get that information to the prosecution, but they said they won’t have it today and Judge Noreika is not waiting on anything to keep the case moving forward.

During his cross-examination of Hallie, Lowell attempted to suggest that Hunter was lying to Hallie when he said on October 13, 2018, (the day after he bought the gun) that he was behind Blue Rocks Stadium “waiting for a dealer named Mookie…” and the next day when he texted Hallie that he was “sleeping on a car smoking crack…”

Lowell introduced the texts from Hallie that preceded both of those texts. On the 13th, Hallie texted Hunter – Why won’t you answer my calls? Where are you? Are you with someone? Hunter replied with the now infamous text about waiting for the drug dealer named Mookie.

Did you think he was with a dealer or a woman, Lowell asked. “A woman,” replied Hallie.

Do you know if he was there? “I do not," she said.

On October 14, 2018, Hallie texted Hunter: I called you “500 times” and you don’t answer. “Practice what you preach.” Hunter replied with another now infamous text that claimed he was sleeping on a car smoking crack.

You have no idea if he was actually there, asked Lowell. “Correct,” Hallie answered.

Lowell sought to suggest that Hunter was lying to Hallie and that he wasn’t actually smoking crack on either of those days, and therefore maybe wasn’t “addicted” to crack cocaine when he bought the gun on October 12, 2018.

During cross-examination under questioning by the defense, Hallie appeared confused after Lowell handed her a binder of texts to and from Hunter. Hallie was to only examine the binder if she could not recall a specific question Lowell asked her about her exchanges with Hunter back in 2018. She sometimes looked at the binder without being instructed to do so.

When answering Lowell, she often appeared hesitant to respond – slightly shaking her head no while speaking. The judge jumped in to explain the legal process.

Hallie was unsure when she should look at the binder. When Lowell directed her to look at the binder, he told her the wrong row number at least twice, compounding the confusion.

The judge rolled her eyes at Lowell at one point, when he asked if he could read in one of Hallie's texts.
