Supreme decision: Three key questions in Trump’s court battle to stay on the ballot

The Supreme Court is set to hear oral arguments on Thursday over whether former President Donald Trump should be barred from Colorado’s Republican primary ballot.

The case will shape the 2024 election, as dozens of states have similar pending lawsuits against the former president.

In December, a divided Colorado Supreme Court ruled Trump ineligible to appear on the state ballot under the Constitution’s insurrection clause, which prevents people who “engaged in insurrection” from holding office, citing Trump’s role in the Jan. 6 Capitol riot.

Here are three key questions hanging over the case ahead of the high-stakes arguments in Washington on Thursday.

I'm very nervous about this.  Trump always goes in halfassed with legal representation.  An adverse ruling here would have far-reaching and disastrous consequences.

 Meet the lawyers arguing the Trump ballot case at the Supreme Court

On Trump’s side is a prominent Texas conservative. Arguing against him are two Colorado lawyers making their Supreme Court debuts.

When the Supreme Court holds arguments Thursday on Donald Trump’s eligibility to be president, the justices won’t be hearing from members of Washington, D.C.’s elite circle of Supreme Court specialists.

Instead, the three lawyers presenting the case are all from outside the beltway and have little experience at the high court’s lectern.

Arguing for Trump will be Jonathan Mitchell, a conservative lawyer who is the only one of the three who has ever argued before the Supreme Court. He’s done so five times — and during his most recent case, his legal position so exasperated Justice Elena Kagan that she obliquely and sarcastically referred to him as a genius.

Arguing against Trump will be Jason Murray, a Denver lawyer whose firm describes its mission as holding powerful people accountable. Late last year, Murray successfully persuaded Colorado’s top court to declare Trump ineligible to run in that state due to the Constitution’s insurrection clause — a bombshell decision that paved the way for the Supreme Court to take up the question.

The argument is now over. The disqualification advocates may have expected a cold reception, but this was perfectly glacial. Notably, some of the toughest and most skeptical questions came from the left of the Court.

...Most notable were the questions from Justice Jackson who seemed to push the idea that the president may not have been intended to be one of those covered by the provision.

It is nice to see that even the liberals on the court don't have much stomach for this obvious unconstitutional meddling in our elections. Let us hope they go 9-zip on this AND on the Jack Smith matter when they hear that one as well.

A 9-0 ruling would send a strong message to the American people that prosecutorial power is not to be weaponized, and this needs to be stopped in its tracks before we end up in a civil war.

It was not going to happen no matter how much the nutbags on the left, and conspiracists on the right, may have argued.

It is worse than that, Earl. This is being funded by US. Most of these prosecutions and ballot removals -- including Colorado, Georgia, Maine, New York -- are funded by taxpayer dollars. And they accuse us of subverting Democracy.
