Day 2 of January 6 Committee Public Hearings Attack Trump for Doubting Election

The second day of public hearings of the House Select Committee to Investigate the January 6th Attack on the United States Capitol was held Monday, and focused on attacking then-President Donald Trump for questioning the 2020 election results.

The goal was a to argue that Trump inspired those who stormed the Capitol by convincing them that the election had been “stolen” and that they had to prevent an illegitimate president from being installed by stopping the certification of the result.

The panel played video depositions of various individuals who had testified before the committee behind closed doors — on pain of prosecution for contempt of Congress — about their disagreement with Trump about the legitimacy of the election.

Notable testimonies included those of former presidential adviser Jared Kushner (Trump’s son-in-law); former Attorney General Bill Barr (whom the Democrat-run House had already voted to hold in contempt over his refusal to hand over grand jury documents in the “Russia collusion” investigation); and — speaking live — former Fox News reporter Chris Stirewalt. News interviews with Trump aides, such as former New York City mayor (and Trump later) Rudy Giluiani, were played.

Former campaign manager Bill Stepien was unable to testify due to the fact that his wife had gone into labor; video of his taped deposition was played instead.

The theme was the same throughout: Trump seized on theories that votes had been switched or that there had been massive voter fraud; individuals close to Trump were said to have counseled him against pursuing those theories; and individuals on camera during the January 6 event cited similar theories as their motivations.

No evidence was presented linking Trump directly to the Capitol riot, however, nor was any evidence presented in Trump’s defense.

The committee did not consider past Democratic efforts to oppose the certification of elections; the Democrats’ pursuit of the “Russia collusion” theory to undermine the 2016 election; and Democrats’ own preparations to challenge the results in 2020.

The committee is entirely one-sided, with members hand-picked by Speaker of the House Nancy Pelosi (D-CA), who rejected Republican nominees.

Members of the panel include several former House impeachment managers, including Reps. Adam Schiff (D-CA) and Jamie Raskin (D-MD), who led the first and second impeachments of Trump, respectively.

CNN’s Phillip on 1/6 Hearing: ‘Elephant in the Room’ Is Trump’s Mental Capacity

CNN anchor Abby Phillip said Monday on her network’s coverage of the House Select Committee hearing on the January 6 riot at the U.S. Capitol that the “elephant in the room” was former President Donald Trump’s mental capacity.

Anchor Dana Bash said, “Absolute vivid descriptions painting a picture of just what you described, of a president of the United States, one after another rejecting the sound advise, data-based advice he was getting from his campaign manager, from the attorney general of the United States, from the legal team that he ended up firing. All of that advice, he rejected, and he instead chose, this is the way they described it, a drunk Giuliani and the people in his orbit.”

Phillip said, “At some point, it’s a question of does that matter? When everybody around you is telling you that it’s not true, does it really matter? Perhaps that’s a question for the lawyers. But there’s another element to several of the pieces of testimony. Bill Barr and other people around him, Bill Stepien saying it got much more difficult to convince the president of anything rational. They’re raising the question that we heard from Adam Kinzinger, one of the Republicans on this committee over the weekend, who basically said if Trump, in fact, does believe all of these lies and conspiracy theories, now we also have questions about his capacity, his mental capacity in that role. I think that’s actually the elephant in the room of a lot of this testimony. Bill Barr basically saying you can’t rationalize with this guy.”

CNN anchor and analyst Chris Wallace said the House select committee investigating the Jan. 6, 2021, attack on the U.S. Capitol is attempting to paint former President Trump as a “loser” desperate to hold on to power following his loss in the 2020 election.

“If they’re successful today, and obviously to Trump supporters nothing they say may be successful, but if they’re successful in putting the lie to the big lie, then suddenly Trump is not an aggrieved party,” Wallace said during CNN’s coverage of Monday’s second hearing of the committee.

“He’s simply a loser, in a naked grab for power and willing to overturn the judgement of 150 million American voters and say that he won when he didn’t win.”

For the second time, Wallace was a member of CNN’s team of analysts covering the highly anticipated congressional hearings.

He was hired by the network late last year to host a show on its streaming channel, which has since been shut down. Executives at CNN have said Wallace will continue to host a talk show that will air on Sunday evenings on CNN and on HBO Max, which is owned by the cable giant’s new parent company, Warner Bros. Discovery.

The Trump campaign exploited its donors to raise millions of dollars off of claims of election fraud officials knew were false, the House committee investigating the Jan. 6, 2021, Capitol riot argued Monday.

“Throughout the committee’s investigation, we found evidence that the Trump campaign and its surrogates misled voters as to where their funds would go and what they would be used for. So not only was there the big lie; there was the big rip-off,” Rep. Zoe Lofgren (D-Calif.) said in a closing statement at Monday’s hearing.

In a pre-recorded video, senior investigative counsel Amanda Wick explained how the campaign sent millions of fundraising emails to supporters between Election Day 2020 and Jan. 6, 2021, the day of the riots. The emails urged donors to give money to “fight back” and “step up” in response to the “left-wing mob” and Democrats undermining the election.

The House committee examining last year’s attack on the Capitol accused former President Trump on Monday of lying purposely to the public in order to stay in power and raise money from sympathetic supporters — an orchestrated effort the panel said led directly to the deadly insurrection of Jan. 6. 

Gathered on Capitol Hill for the second in a series of public hearings into its investigation, the select committee leaned heavily on the testimony of some of the leading figures in Trump’s political orbit to hammer home the notion that, not only were Trump’s claims of rampant voter fraud false, but also that he knew them to be so.

Leading the charge was former Attorney General Bill Barr, who delivered a damning portrait of the former president as someone increasingly “detached from reality” following the election.

Barr said his Justice Department was forced to play “whack-a-mole” with the flood of false fraud allegations pouring in from Trump supporters around the country. One by one, the department investigated the claims but found no wrongdoing. The accusation that Dominion Voting Systems, a voting machine company, had installed software to flip votes from Trump to Joe Biden was “idiotic,” Barr said, while another claim — that more people voted in Philadelphia than there are voters in the city — was “absolute rubbish.”

“And I told him that the stuff that his people were shoveling out to the public was bull—-, I mean, that the claims of fraud were bull—-,” Barr told the committee in an earlier interview that was aired during Monday’s hearing. “And, you know, he was indignant about that.”

Testimony presented Monday showed a clear fracture behind the scenes between Trump and some of his top aides, who told the committee they confronted Trump directly about his claims of widespread fraud in the weeks after the 2020 election, only to be ignored.

“The election fraud claims were false. Mr. Trump’s closest advisors knew it. Mr. Trump knew it,” Rep. Zoe Lofgren (D-Calif.) said at the outset of the hearing. “That didn’t stop him from pushing the false claims and urging his supporters to, ‘fight like hell’ to ‘take back their country.’”

The committee used video clips of Trump making fabulous claims of rampant fraud, and contrasted them with interviews with White House and campaign aides disputing those assertions.

They showed Trump laying the groundwork for his ultimate assertion — that only fraud could deal him an election loss — as early as April 2020, a thread he revisited when he claimed victory on election night, then amplified heading into Jan. 6.

Former deputy attorney general Richard Donoghue testified that he personally explained to Trump that DOJ officials had looked into claims of fraud in Georgia, Nevada and elsewhere, but that much of the information the president was receiving was inaccurate. In response, Trump would shift his focus to other claims of fraud.

“There were so many allegations that when you gave him a very direct answer on one of them, he wouldn’t fight you on it, he’d move to another one,” Donoghue said.

Former Trump campaign manager Bill Stepien, who was promoted to that role in July 2020, was scheduled to testify in-person on Monday but backed out after his wife went into labor.

In his absence, the committee used clips of Stepien’s private deposition, in which he discussed his effort to convince Trump of the benefits of mail-in voting, of the amount of time it would take to count ballots and declare a winner in the 2020 election, and of the need to let votes be counted before declaring victory. As part of that effort, he brought in House Minority Leader Kevin McCarthy (R-Calif.) to help make the case. It fell on deaf ears.

“My recommendation was to say that votes are still being counted. It’s too early to tell, too early to call the race,” he said.

MSNBC legal analyst Barbara McQuade said Monday on MSNBC’s “Katy Tur Reports” that the House committee investigating the Capitol riot had “stumbled upon another” crime in former President Donald Trump’s fundraising.

McQuade said, “You know what I think may have happened here? The committee, in investigating one crime, may have stumbled upon another. This happens quite a bit when prosecutors investigate cases. It turns out we didn’t find Whitewater, but we did find Monica Lewinsky. In this case, it appears that they are building a very solid case of willful blindness as to the big lie, which could contribute to criminal liability for Donald Trump for election fraud, conspiracy to defraud the United States, and conspiracy to obstruction an official proceeding.”

She continued, “In addition, if he’s using a lie as a false pretense to collect money from people, that could also be a charge of wire fraud. So in that way, I think we may have seen an expansion of potential liability here.”

McQuade added, “The same mindset that would be a support for any of these other election-based crimes would be the same mindset used as evidence in a fraud claim. What comes out to me is I thought we heard crystal clear today what I thought is the essence of willful blindness. That is a theory of liability of knowledge of fraud, and that was when William Barr said, ‘He showed no indication of any interest in what the actual facts were.’ That’s is the essence of willful blindness, turning a blind eye to a fact that is inconvenient but true.”
