Graham gets combative with Jackson: 'What faith are you, by the way?'

Sen. Lindsey Graham (R-S.C.) on Tuesday grew increasingly combative in his line of questioning of Ketanji Brown Jackson, asking President Biden’s Supreme Court nominee about her religious faith, her defense of Guantánamo Bay prisoners and whether she was aware of what he said were left-wing attacks on his preferred nominee to the court.

Graham has been seen as a swing GOP vote on Jackson given his support for previous Democratic judicial nominees, but he has signaled he is likely to vote “no” on this nomination.

The Republican senator has also made it clear he disliked Democratic questioning during confirmation hearings for former President Trump's Supreme Court nominees and has repeatedly sought to underscore a double standard in how nominees from different presidents are treated.


Graham opened his questioning by asking Jackson abruptly about her faith.

“What faith are you, by the way?” he asked. 

When she responded she is a nondenominational protestant, Graham then asked: “Could you fairly judge a Catholic?”

Cruz Challenges Left-Wing SCOTUS Nominee: 'Will You Protect Freedom or Restrict It?'

In his opening statement about Supreme Court nominee Ketanji Brown Jackson before the Senate Judiciary Committee today, Sen. Ted Cruz (R-Texas) indirectly alluded to her long history of  left-wing judicial advocacy by raising questions about abortion, gun rights, religious liberty and free speech.

The point of the hearings, he said, is to determine whether Jackson will follow the law -- will she protect freedom or restrict it?

"All of those questions are fair game," said Cruz. "Will you follow the law? What does your record indicate? Will you protect the rights of every American citizen regardless of race, regardless of party, regardless of view? That’s what the focus of this hearing should be."

According to the conservative website The Federalist, "As a result of her work, Jackson has earned the favor of several pro-abortion, pro-LGBT, anti-religious liberty activist groups including The Leadership Conference on Civil and Human Rights, which is composed of problematic organizations including the radical Southern Poverty Law Center, the increasingly anti-free-speech American Civil Liberties Union, and Planned Parenthood."

Sen. Cruz: “… I agree with Chairman [Dick] Durbin. Chairman Durbin quoted [former Senator] Paul Simon and he said, history will judge ‘did she restrict freedom or did she expand it’? I agree with that. The reason the American people care about the Supreme Court is that it is integral to protecting or taking away our constitutional rights.

“When it comes to free speech, this committee should enquire will you protect the rights of Americans to speak, to say unpopular ideas, to say ideas that the government doesn’t want you to say but you, nonetheless, have a right to say. Will you protect freedom or restrict it?

“When it comes to religious liberty, will a justice vote to protect your right to live according to your faith and according to your conscience? Or will a justice vote to crush religious liberty and strip those rights away?

As much as the Senate hearings are pointing out her liberal biases, she'll be confirmed.  So why even hold the hearings when they will do little to alter the outcome anyways?  I guess a formality to make it appear that there's some true opposition.

Breyer was confirmed before there was a vacancy as well.  Given Breyer's stated intent to retire, this is not a completely novel situation.

There will never be 10 on the bench until and unless the statute governing the composition of the Supreme Court is changed.  Even if she is confirmed, she won't be a justice until she has been given the oath of office, and she cannot be seated so long as there are already nine justices serving.

The case came up during Jackson’s confirmation hearing on Tuesday, when she faced questioning from Sen. John Cornyn, R-Texas. Cornyn brought up the concept of substantive due process, a legal doctrine utilized to expand the Constitution’s due process clause to protect various rights not enumerated in the Constitution.

"Why isn't substantive due process just another way for judges to hide their policy making under the guise of interpreting the Constitution," Cornyn said, criticizing the doctrine.

28 U.S.C. §1:  "The Supreme Court of the United States shall consist of a Chief Justice of the United States and eight associate justices, any six of whom shall constitute a quorum."

As I count it, that makes 9.  No more, and no less.

Breyer was confirmed before Blackmun retired.  I don’t recall there being much of a constitutional crisis back then.

The Senate Judiciary Committee grew fervent when Sen. Ted Cruz (R-TX) and several colleagues accused the chairman, Sen. Dick Durbin (D-IL), and his party of withholding records of Supreme Court nominee Judge Ketanji Brown Jackson and demanded to know, “is there anything else that Democrats have access to in this case that they’re not sharing with Republicans?”

Prior to taking the last break from questioning for the second day of the confirmation hearing on Tuesday, Sen. Mazie Hirono (D-HI) had brought up information regarding probation reports that had not been submitted to the record. When the committee returned from recess, Cruz reiterated his concern before normal order could resume.

“I asked the chairman about Senator Hirono had referenced five probation reports that were not in the record,” Cruz stated. “I asked the chairman whether the Democrats had access to information about Judge Jackson’s judicial record that Republicans did not. You did not answer me at the time.”

Judge Nominated To Supreme Court On The Basis Of Her Sex Can’t Define ‘Woman’

Judge Ketanji Brown Jackson, who was nominated to the U.S. Supreme Court by President Joe Biden in large part because of her sex, said she couldn’t define what a woman is on Tuesday during her confirmation hearings.

Jackson was chosen to replace retiring Justice Stephen Breyer in fulfillment of Biden’s identity politics pledge to install a black woman on the Supreme Court. Despite those reasons for her nomination, Jackson stumbled through giving a definition of “woman” when Republican Sen. Marsha Blackburn asked the straightforward question.

“Can you provide a definition for the word ‘woman’?” Blackburn asked during the hearing.

“No, I can’t,” Jackson said after confirming the question.

The progressive judge claimed she was unable to provide a definition because “I’m not a biologist.”

“The meaning of the word woman is so unclear and controversial that you can’t give me a definition?” Blackburn pressed.
