And yes, they do have the power to block a vote on her nomination.  Unfortunately, it appears that McConnell is just going to roll over on this one.

She should really be put through just as much angst and grief as Kavanaugh, Barrett, and Gorsuch got.

WATCH: Sen. Cruz’s opening statement in Jackson Supreme Court confirmation hearings

Sen. Ted Cruz, R-Texas, argued March 21 in his opening remarks at the Senate Judiciary Committee confirmation of Judge Ketanji Brown Jackson that Democrats have altered the duties of the Supreme Court.

“Our Democratic colleagues want the Supreme Court to be anti-democratic. Our Democratic colleagues get frustrated with the democratic process. When they can't pass gun control laws because the American people don't support them, they want unelected judges to mandate those same laws instead,” Cruz said. “Law after law after law that they can’t get through the democratic process, the Democrats have decided it’s much simpler to convince five lawyers in black robes than to try to convince 330 million Americans.”

Cruz argued that’s the reason confirmation hearings have become “so contentious.” But, he promised Jackson: “This will not be a political circus.”

Jackson was nominated by President Joe Biden in February to replace retiring Supreme Court Justice Stephen Breyer. If confirmed, she will be the first Black woman on the high court.

Sen. Lindsey Graham (R-S.C.) fumed over progressive criticism of J. Michelle Childs, a district court nominee who was also a Supreme Court contender, and accused Democrats of holding a double standard against GOP nominees.

Graham’s remarks, which came near the start of the four-day hearing for President Biden's actual nominee for the court — Ketanji Brown Jackson — are the most extensive comments Graham has given on Jackson’s nomination since his meeting with Jackson last week.

After that meeting, which lasted roughly 15 minutes, Graham went radio silent on his thinking about Jackson.


“The attacks from the left against Judge Childs was really pretty vicious, to be honest with you,” Graham said.

Graham added that he believed there was a “wholesale effort” to take her out of the running for the Supreme Court seat.

“This is a new game for the Supreme Court, and this game is particularly disturbing to me,” Graham said.

Where does it say we cannot?

I openly admit it would be an interesting question, and if she is confirmed and Breyer retires during Bidet's administration, I don't see the question being litigated.

However, there is nothing in the Constitution or in the relevant statutes that prohibits a pre-vacancy nomination or a confirmation hearing, particularly in light of the announced intentions of a currently sitting justice to retire.

The statute currently forbids more than nine sitting justices actively hearing cases and deciding them; it doesn't of its own necessary language do more than that.
By that logic, an endless progression of 'on deck' justices could be established, like a batting lineup, just waiting for their turn. I cannot see that as the intent of the founders.

Yes, it could.  But as @Cyber Liberty pointed out, it is quite likely the case that a confirmation that does not result in the confirmee being sworn into office before that session of Congess ends is likely a "dry" confirmation that will expire of its own accord with the end of the Session.

So, at most, you get an endless supply that's good for one session of Congress.  Building up a bench of reserves would be rather a poor waste of limited legislative time under those circumstances.

So perhaps the Founders were wiser and more ingenious than most of us give them credit for.

Back then, there was a moral understanding that becoming a legislator was an honor and privlidge to serve the at the will and for  the people.  Not profit on them, which is the overriding theme now.

Fair enough; however, an individual is not a "justice" until they've taken the oath of office, and therefore they have no vested interest in the office until such time.  As a result, I do not believe that the confirmation proceedings taken by one Congress would bind a subsequent Congress if those confirmation proceedings did not result in the oath of office being given to the confirmee.  Thus, one could have a hundred thousand confirmed "reserves" from a Democrat-controlled Congress, and none of those would bind a subsequent session of Congress if none of them were given the oath of office.

Furthermore, this woman claims she suffered from a segregationist south.  What the hell?   She was born in 1970.  Why isn't just one GOP member asking for an example of WHERE in the south she experienced this after 1975-1980.

There is very little suspense on Capitol Hill regarding Judge Ketanji Brown Jackson’s confirmation to the Supreme Court. The moment Justice Stephen Breyer announced his retirement, it was assured that his replacement would end up with the votes needed, likely with several Republicans offering their support along the way.

KBJ’s confirmation hearing hasn’t changed that dynamic. As RedState reported, she has received tough but fair questions from the GOP members of the Judiciary Committee, with the most contentious ones centering on her sentencing of pedophiles in possession of child pornography. In the seven cases she handled on the matter, she gave sentences below (sometimes far below) the federal guidelines for the crimes committed. Sen. Josh Hawley has led the charge to expose that reality and question it.

On Tuesday morning, the second day of hearings began, and onlookers were greeted by Sen. Dick Durbin dabbling in absolute absurdity regarding the treatment of KBJ.

Judge Jackson is removing the consideration that every piece of child pornography has at least one victim that gets re-victimized every time someone views it. If there was no demand there would be no supply. She’s only seeing it from the eyes of the criminal, not the victim.

That's totally the wrong basis for viewing the harm caused by child pornography.  The gravamen of the crime is not the burden it puts on the U.S. postal service, or the internet providers, the gravamen is the sexual exploitation of children, and that is independent of how the images were delivered to the defendant.


That, by itself, demonstrates a lack of the real fine-tuned legal reasoning skills Supreme Court justices are expected to have.
