The Republican National Committee (RNC) on Wednesday sued the congressional panel investigating the Jan. 6, 2021, attack on the U.S. Capitol, seeking to block its subpoena of an RNC vendor.

In a lawsuit filed in U.S. District Court in the District of Columbia, the RNC said the House Select Committee's subpoena of Salesforce, which organizes donor information for the RNC, was "overbroad" and "seeks sensitive and proprietary data."

"The RNC has sued to stop the January 6th Committee from unlawfully seizing confidential information about the internal activities of the Republican Party and millions of its supporters which is completely unrelated to the attack on the Capitol," the RNC said in a statement.

In a statement, the committee said the RNC and the Trump campaign had solicited donations after the 2020 election "by pushing false claims that the election was tainted by widespread fraud."

The committee said claims about a stolen election motivated rioters who stormed the Capitol

1) Fox is told that the 1/6 committee will conduct eight hearings in June. But the ninth and final hearing will come in September to put a button the committee’s findings. Fox has learned that the panel will issue its report in connection with the September hearing.

2) Various members of the 1/6 committee will lead each hearing, focusing on a specific “theme.” Each hearing will focus on a particular subject connected to the riot.   The hearings will run for 90 minutes when they begin.

3) The committee will begin to do some behind the scenes work on upcoming weekends to prepare for the hearings.

A) The 1/6 committee has taken the extraordinary move of issuing subpoenas for sitting lawmakers who have not agreed to cooperate with the investigation.

B) The subpoenas include House Minority Leader Kevin McCarthy (R-CA), Rep. Andy Biggs (R-AZ), Mo Brooks (R-AL), Jim Jordan (R-OH) and Scott Perry (R-OH).   Such a move is exceptional because the Constitution gives the House and Senate the right to discipline its own members.

C) So, a subpoena in this case is only enforceable if the House were to take them to court. That creates a Constitutional problem. The House has a conventional ethics process where members can be referred to the Ethics Committee.

D) Moreover, if the lawmakers don’t comply with the subpoena, the House could potentially vote to hold those members in contempt and refer them to the DoJ for prosecution.

1) Fox is told that the exact agenda and potential witnesses for the 1/6 committee hearings remains vague. Fox is told that the schedule for deposing witnesses is “changing hour by hour” and some witnesses remain tough to nail down.

2) However, Fox is told there could be more information forthcoming next week on “material witnesses” who are Members of Congress.

The Capitol Police will provide a briefing on security for members on the committee on May 20.
