Ex-Trump lawyer Michael Cohen discussing plea deal with prosecutors
The deal could come as early as today, say sources familiar with the matter.

by Sarah Fitzpatrick, Joe Valiquette, Jonathan Dienst and Tom Winter / Aug.21.2018 / 10:51 AM ET / Updated 11:23 AM ET

Michael Cohen, President Donald Trump's former personal attorney, is discussing a possible guilty plea with federal prosecutors in Manhattan in connection with tax fraud and banking-related matters, multiple sources familiar with the matter tell NBC News.

Those sources stress no deal has been reached but do say the potential deal could be reached as early as today.

The plea could have significant implications for Trump, who has blasted Cohen ever since his former fixer and his attorney, old Clinton hand Lanny Davis, began signaling this summer that Cohen might cooperate with special counsel Robert Mueller’s investigation.

When reached by NBC, Davis said he cannot comment on advice of counsel since there is an ongoing investigation. Cohen has previously denied wrongdoing.

Reality:  Trump's Pardon Power doesn't reach to SDNY.  He probably had visions of Harriet Meyers, v2.0 dancing in his head last year about this time.

It’s a US Attorney office.  He can pardon Cohen for their charges.  However, the state of New York can also charge him for tax evasion and bank fraud. State charges can only be pardoned by the governor.
I disagree.  Circle gets the square.

Trump’s Former Fixer, Michael Cohen, Reaches a Plea Agreement Over Payments to Women

By WILLIAM K. RASHBAUM

Michael Cohen, President Trump’s former lawyer, reached a plea agreement with prosecutors investigating payments he made to women for Mr. Trump, a person familiar with the matter said.

Prosecutors in New York had been scrutinizing Mr. Cohen for bank and tax fraud, as well as for his role in helping to arrange financial deals to secure the silence of women who said they had affairs with Mr. Trump.

The United States attorney’s office announced that there would be a “proceeding of interest” in a case against a defendant identified only as John Doe, language that almost always indicates a guilty plea. One person with knowledge of the matter said the proceeding would be the guilty plea by Mr. Cohen.

I see. Trump's personal lawyer making a plea deal is just everyday ho-hum news and shouldn't be reported...

Now if the jury fails to convict Manafort, I'm going to laugh my ass off. So don't say I don't care about the Manafort trial. That's news too.

And it was the Stormy thing that got him on the tax evasion problem. But I was told it didn't happen or that if it did happen it was no big deal... And no matter what, it wasn't a campaign finance violation...

I know, he's doing "good things" and that excuses all this less than stellar behavior... I wonder how far that can be stretched... We'll see...

Eight counts were included in the criminal information on Cohen: five counts of evasion of personal income tax, one count of making a false statement to a financial institution, one count of causing an unlawful corporate contribution, and one count of making an excessive campaign contribution.

I'd be a little nervous about the campaign contribution stuff.
I thought it was all Trump's own money running his campaign, but what do I know.....
I'll give him the benefit of the doubt.
Maybe he was donating to Hillary's campaign, in search of a job.
It seems to be a running theme.

If TRUMP had paid the $130k directly -- & disclosed it on his campaign's @FEC report -- there would not have been any campaign finance violation. Instead, he apparently had MICHAEL COHEN do it, & the result is count numbers 7 & 8 in Cohen's guilty plea.

@PPVSRB

Counts 1-5.  Tax evasion 2012-2016
Count 6 false statement to financial institution Feb 2015-April 2016
Count 7 willful cause of unlawful corporate contribution June 2016-Oct. 2016
Count 8 excessive campaign contribution on Oct. 27, 2016

If they are going to enter a plea deal with him, he probably has something aside from his word to substantiate what he is saying.

He's just a convicted (soon to be) felon.  He'd say anything to get a lighter sentence.

Lanny Davis @LannyDavis 11m

Today he stood up and testified under oath that Donald Trump directed him to commit a crime by making payments to two women for the principal purpose of influencing an election.  If those payments were a crime for Michael Cohen, then why wouldn't they be a crime for Donald Trump?

Don't mean to be picky here @Concerned but Cohen said, under oath, that he was instructed to make the payments to Stormy Daniels and Karen McDougal from "The Candidate" that could mean Sen. Cruz, right?

Of course he would. However, they are not going to just shave major time off of his sentence without something to back up what he’s saying as part of his plea.

You're not picking on me, I just posted the tweet that Lanny Davis made, but the charging document notes that Cohen admitted to facilitating making a payment from June 2016 up to and in and about October 2016 in order to influence the election.  I think Cruz was out of it by that timeframe.

Court filing: Cohen coordinated with 'one or more members' of Trump campaign on hush money
By Tal Axelrod - 08/21/18 06:45 PM EDT

The Department of Justice filing on Michael Cohen’s guilty plea on bank fraud, tax fraud and campaign finance law violations expands on details surrounding hush money payments to two women who claim to have had affairs with President Trump.

The filing says Cohen “coordinated with one or more members of the campaign, including through meetings and phone calls, about the fact, nature, and timing of the payments.”

Cohen said Tuesday he was directed to make the payments to adult film actress Stormy Daniels and Playboy playmate Karen McDougal by “the candidate,” not mentioning Trump by name.

A $130,000 payment to Daniels, whose real name is Stephanie Clifford, was completed just weeks before the 2016 election. She is now suing Cohen and the president for defamation and to void the nondisclosure agreement.

Cohen also coordinated a payment of $150,000, which matches up with the amount former McDougal was paid by publishers of the National Enquirer for exclusive rights to her story about her alleged affair with Trump.

“What he did was he worked to pay money to silence two women who had information that he believed would be detrimental to the 2016 campaign, to the candidate and the campaign,” Deputy U.S. Attorney Robert Khuzami said at a press conference.

Khuzami went on to detail sham invoices Cohen filed to shield the true intent of the payments.

Cohen’s attorney Lanny Davis put out a statement Tuesday evening, saying, “If those payments were a crime for Michael Cohen, then why wouldn't they be a crime for Donald Trump?”
