Title: BREAKING>>>Ruth Bader Ginsburg died
Post by: mystery-ak on September 18, 2020, 11:38:27 pm
Just Breaking

Justice Ruth Bader Ginsburg, the liberal leader of the Supreme Court and a trailblazing champion of women’s rights, died on Friday. She was 87 years old.

Seen as a moderate when President Bill Clinton nominated her to the bench in 1993, Ginsburg went on to leave a lasting mark in the realm of gender equality, civil liberties and pay equity, and grew to achieve improbable late-in-life recognition as a pop culture icon and hero of the progressive movement.

Her first major opinion as a justice came in 1996 when she wrote the majority decision in United States v. Virginia. The ruling struck down the Virginia Military Institute’s 157-year-old policy of male-only admissions as unconstitutional, and set a stricter legal standard for government action that treats men and women differently.

Not enough time to confirm a replacement.

That was my thought as well -- though it is the Senate that confirms the nomination.  With the being said, you can bet the Romney will be the hold up even IF they were to try to push a nomination through.

No chance, politically speaking.

The question is whether Trump would dare name a replacement in advance of the election. Huge risk... thus, highly unlikely.

As soon as the Senate recesses, name a recess appointment.
How about Amy Barrett...?

We have three-and-a-half months until the next Senate is sworn in.
I see no reason why a replacement couldn't be voted on by then.
If "the tables were turned the other way", you know the democrat-communists would do it.

Addendum:
Mr. Trump ought to be puttin' in that call to Ms. Barrett tonight.
Pack your bags and come see me as soon as you can get here.
Don't call tomorrow ... call TONIGHT.
Next call to Mr. McConnell: if you know what's good for you, get this done.
I predict that a time-is-of-the-essence performance by the Republican Senate on this will HELP the chances of all the incumbent senators, and might even give a boost to Republican Senate candidates, as well.

Who knows what Trump is going to do -- hopefully not typical Trump where he announces he's going to nominate a justice and finds out that there isn't enough time.

The DEMS are going to prolong her funeral and services as long as possible -- they are going to buy as much times as they possibly can right now.

Or enough votes.

Better to wait and use it as a campaign issue for Senators like Collins and Gardner and McSally.  Playing up who you want voting for the next Supreme Court justice might actually save a seat or two.

Ginsburg in statement before her death said she wished not to be replaced until next president is sworn in
By Tal Axelrod - 09/18/20 08:12 PM EDT

The late Supreme Court Justice Ruth Bader Ginsburg said days before her death that her "most fervent wish" was that she not be replaced on the high court until a new president is sworn into the White House.

"My most fervent wish is that I will not be replaced until a new president is installed," Ginsburg dictated in a statement to her granddaughter that was obtained by NPR.

Ginsburg died Friday due to complications of metastatic pancreas cancer at the age of 87. The second woman appointed to the high court, she served as a justice for over 27 years.

Her death will instantly spark a partisan fight over the vacancy on the bench.

Republicans infamously blocked President Obama’s Supreme Court pick from receiving a confirmation hearing after Justice Antonin Scalia died in 2016, the year of the last presidential election. GOP lawmakers maintained that a Supreme Court vacancy should not be filled the same year as a presidential race.

However, Senate Majority Leader Mitch McConnell (R-Ky.) has maintained that he would fill a 2020 Supreme Court vacancy. He has said that the situation this year would be different than that in 2016 because in 2020 the White House and Senate are held by the same party.

Which may in the end help the GOP's chances to keep the Senate since Republicans will be more motivated to get out and vote to keep in the hands of the GOP.  I think Trump knows that, he's going to pick the person he thinks will help the GOP the most in November, even if they won't be confirmed until after the election.

The question is whether Trump would dare name a replacement in advance of the election. Huge risk... thus, highly unlikely.

@andy58-in-nh

Hard to tell how that would play out. IF he were to name a solid "no question about it" conservative, the Dim heads would explode, but the flip side is those on the right would be throwing parties to celebrate.

I kinda like the idea of a per-election nomination putting pressure on the Semi-Republicans to come out and make a stand for,or against a conservative justice, just days before they have to face the voters.

mystery posted a tweet from someone that said:
"Susan Collins, Lisa Murkowski, and Mitt Romney need to commit today that they will not vote on any Supreme Court nominee before the election."

Ok, this is would be only a GOOD thing.
"Will not vote" means they cast no vote -- not "aye", not "nay".

That leaves 50 Republican senators who WILL vote, and 47 democrat-communists who will oppose.

That means that all we need to win will be 47 votes (assuming 47 dem-com votes "no"), along with a vote from Mike Pence to "break the tie".

How's that...?

Hmmmm.... hold on a minute.
Let's step back and think about this.
With Ms. Ginsburg's seat vacant, that leaves:
- 4 "known conservative" votes
- 1 "swing vote" (Roberts)
- 3 leftist votes.

I sense that in matters of the election, Mr. Roberts is likely to lean towards the Constitutional position, along with the other conservatives.

So... with Ms. Ginsburg now vacant, an 8-member Supreme Court has actually become MORE conservative than it was yesterday...

Francey Hakes (who the hell is she) is on with Tucker Carlson threatening violence in the streets if the Senate attempts to replace RBG before the election.

Apparently, both Sen Lindsay Graham and Sen Grassley said in 2018 that they would not take up the nomination of a replacement for RBG should something happen to her in 2020 in the election year.  If that is true, then the fine people of South Carolina should vote for a true Democommie versus the RINO POS that Graham is.   If Graham sticks to this idiotic mindset, he loses in November, guaranteed.  What a putz to say something so stupid.

The next few days should be very interesting.  Trump has the chance to put the fifth vote on the worthless Supreme Court to end the mass genocide of abortion.  If he decides to delay, he loses the evangelical vote and the pro life vote in November, and he loses the re-election.

Bottomline:  Trump has no choice.  Either he nominates a replacement, or he loses in November.  It is that simple!!!

President Trump on Wednesday unveiled a list of 20 additional potential Supreme Court nominees that includes three Republican U.S. senators, a White House lawyer-turned-judge and his former solicitor general.

Sens. Tom Cotton (R-Ark.), Ted Cruz (R-Texas) and Josh Hawley (R-Mo.), as well as Noel Francisco, who departed as solicitor general in June, are among the names added to the current list of candidates for the Supreme Court. Hawley, however, swiftly tweeted that he has “no interest” in serving on the Supreme Court and looked forward to “ confirming constitutional conservatives” in the Senate.

The list also includes a handful of individuals who have served in the Trump administration or his White House, as well as Trump appointees to lower federal courts. It includes, for instance, Gregory Katsas, who served as deputy White House counsel before Trump chose him to serve on the U.S. Court of Appeals for the D.C. Circuit in September 2017.

The announcement represents a bid to shore up his support among conservatives two months from the 2020 presidential election, as polls show Trump trailing Democratic nominee Joe Biden nationally and in key swing states.

In remarks at the White House, Trump warned that religious liberty, freedom of speech, and the right to bear arms are all at risk if Democrats win the election, asserting that they would appoint “radical” justices to the high court.

“Over the next four years, America’s president will choose hundreds of federal judges and in all likelihood, one, two three and even four Supreme Court justices,” Trump said in remarks from the Diplomatic Reception Room at the White House.

“The outcome of these decisions will determine whether we hold fast to our nation’s founding principles or whether they are lost forever,” Trump continued.

The future of the Supreme Court hangs in the balance as the Nov. 3 voting day quickly approaches.

If Trump wins another four-year term, he would likely get the opportunity to replace ailing liberal Justice Ruth Bader Ginsburg, 87, and possibly fellow liberal Justice Stephen Breyer, 82, which would give conservatives a commanding 6-3 or 7-2 majority.

The next oldest justice is conservative Clarence Thomas, 72, who is currently the longest-serving member of the court and whose 28 years on the bench is longer than the typical justice’s tenure.

And still hasn't undone the damage the left did with the Court in its hands for 20. Even though they were nominally Republican, they pushed every left-wing cause they could from their benches.)

Which may in the end help the GOP's chances to keep the Senate since Republicans will be more motivated to get out and vote to keep in the hands of the GOP.  I think Trump knows that, he's going to pick the person he thinks will help the GOP the most in November, even if they won't be confirmed until after the election.

Good point.  We need to galvanize GOP voters to keep the Senate.  This is the issue that can do it.

If SCOTUS is deadlocked 4-4 during post-election litigation, equal protection is a dead letter. Because ties affirm the appellate court’s decision, we will end up with split circuits and different rules and standards across the country. That is a recipe for chaos and division.

Thank God we have the Senate...but talk about a gift to incentivize Dems to get out the vote.
@DCPatriot
@mystery-ak

Republicans have a number of Senators up for reelection and not many Democrats up for reelection.  Don't have those numbers right now.  It is likely Democrats will take the Senate for this reason and now, also because there is an empty Supreme Court Justice Seat that will bring out more Democrats to vote.

Normally, it is the Independent vote that determines who will be President.  This death of Ginsburg, a liberal but loved by millions, plus Independents don't like the four years of tweets, will likely vote against Trump and for Ginsburg (that being another liberal woman Supreme Court Judge).  There will have to be a Democrat President to have a liberal woman Supreme Court Judge.

Tucker said tonight that Biden would consider Stacey Abrams for the Supreme Court.  OMG, I pray Trump and our worthless Senate do their job so that will never happen!.

This may well be the last opportunity for those that oppose mass genocide/abortion to gain ground and end this horrific and barbaric practice of murdering the most innocent in our society.

We are spending millions if not billions to bring abortion to other countries.  200 years from now, if man does not self destroy themselves, I can see our great nation being known for taking abortion to the entire world and being the Satan nation that destroyed innocent life, and that Planned Parenthood's founder, Margaret Sanger is also the same person that inspired Adolph Hitler with his Final Solution to the Jews.  That is one possibility for the future.

I say end the mass genocide and protect the most innocent in our society.  What we have been doing is against everything this nation stands for.  60 million + murdered unborn babies, and counting!

If God were cynical about mankind, I could see him throwing this out as a test for this nation.  What we do as a nation now may well bode our future.  The blessings bestowed on this nation may well go up as steam if we make the wrong decision.  Of course, you could take the mindset of one  that does not believe in God, but if you are a believer, you might see the possibility of this as the ultimate test for mankind in the USA.

All my life I have been told by media that the majority of people in America oppose abortion.  This being a nation of the people, you would think the Supreme Court would not decide on the tens of millions of murders and oppose the will of the people of this nation, or to undermine the authority of each state's governing body.

At a minimum, I think the Supreme Court should punt the determination of abortion to the states, and end this national tragedy.  At best, end this barbaric practice of mass genocide.

The question is are the GOP Senators in Blue and Purple states going to commit to supporting his nominee or say the next president should pick the nominee in order to save their skins and get reelected.....I would expect they will do and say anything to get reelected..

So Young and So Unexpected

Tragic news that Ruth Bader Ginsburg has passed. It is always a shame when
someone so young passes and especially so unexpectedly. Who would have ever
guessed? Did anyone ever guess that she was ever sick? She tried to hang in there
forever. That didn't work.

The next couple of months are going to be quite interesting if it wasn't interesting
enough already with the election. It will be super interesting with the Supreme's in
play. Maybe we will get an Actual Conservative on the court in the next few weeks.
The Supreme Court is in play.

Tragic, tragic, tragic day.

It is tragic when someone dies but when you have had cancer 18 times and have
had removed three forths of your organs, and yet keep working part time.

How is it that we are allowing the country to be lead by people who are one step
away from life support? Not just Ruth but a lot of people.

Get ready for a fight because we will be seeing one.

Not enough time to confirm a replacement.
Why?

All it takes is a Republican President and a willing Senate.

We have 4 months.

If push came to shove couldn't Mitch just call a recess of the Senate?

Article II, Section 2 of the U.S. Constitution provides that:

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

Thus, when the Senate is in recess, the President may make a temporary appointment to any office requiring Senate approval, including filling vacancies on the Supreme Court, without the Senate's advice and consent. Such a recess appointee to the Supreme Court holds office only until the end of the next Senate session (always less than two years).

Majority in poll before Ginsburg's death supported holding hearings in 2020

A majority of Americans said in a new poll conducted prior to Justice Ruth Bader Ginsburg’s death that the Senate should hold confirmation hearings on a Supreme Court nominee for any vacancy this year.

Sixty-seven percent of Americans said in the Marquette University poll released Saturday that hearings should be held, while 32 percent said the Senate should not consider a nominee to the high court in an election year.

Results did not significantly vary along party lines, with 71 percent of independents, 68 percent of Republicans and 63 percent of Democrats saying confirmation hearings should be held.

I've slept on it.  The President must move quickly and nominate the next Justice.  Like most, Amy Coney Barrett would be my choice.

When her death notice first popped up last night (I was watching Wheel of Fortune, of all shows), I wondered... why so suddenly? Why had there been no notices that she was in very poor health, not expected to live?

The word for the day:  LEVERAGE

Trump has leverage like never before on the do nothing Republican Senate.  First off, any Republican Senator that does not vote in the AFFIRMATIVE for the Trump nominee BEFORE the election, will lose in November.

And Ginsberg wishing for a Dem POTUS to replace her, I do not believe for a nanosecond she said it, and even if she did, WHO F*&^ING CARES?  It is NOT her decision!!!

This is a blessing from heaven, for it will energize the entire Evangelical establishment to align with Trump and VOTE.  Can I hear an AMEN!

If Murkowski, Collins, Romney, Gardner do not vote in the affirmative for this nominee before their election, they lose.  Can I hear another AMEN!  What a wonderful thing, this piece of leverage.

And if ever we are to end mass genocide/abortion, this is the opportunity, and perhaps the last opportunity to align the godless court to correct a major wrong.

Trump will nominate someone in the next few days.  The Dems will drag out the funeral process of Ginsberg for perhaps two weeks.  Given their druthers, they will have her lie in state in all 50 states and all 5 territories with her burial sometime in April next year.  Trump should announce his choice within the week.

AND LET ME BE CLEAR, IT USUALLY TAKES TWO YEARS TO CREATE AND BRING TO MARKET A VACCINE, AND WE ARE LOOKING AT SIX MONTHS OR SO FOR A COVID19 VACCINE.  IF THAT CAN BE DONE, WE CAN GET A SUPREME COURT JUSTICE APPROVED IN THREE WEEKS.  TRUMP DOES PRODUCE RESULTS, AND HE HAS THE LEVERAGE TO TELL THESE WEAK KNEED POS SENATORS TO STAND WITH THEIR PARTY AND VOTE, OR LOSE YOUR ELECTION.  AMEN!!!!!!!!!!!!

I reckon there's a good chance the seat will go to Amy Coney Barrett.

She was on the "very short list" the last time, she's well-vetted, and she was just confirmed by the Senate in 2017 for her current seat. In fact, I believe the two "ladies" who said they won't cast a vote this time voted FOR Ms. Barret the last time. Are they really going to deny her now?

Mr. McConnell's job will be to "keep things tight", set a schedule, and then FORCE the necessary votes ON TIME. If he does this, I predict this nomination process will actually be easier than Mr. Kavanaugh's -- it's going to be difficult to attack Ms. Barrett using the same vectors the leftist-communists would use for a man.

But... they're sure gonna try.
It's up to Republicans to simply IGNORE their screams and media outbursts, and "press on through". Just brush the democrat-communists away as one would brush dust from one's clothes. That's about all they're worth anyway.

One of the core Republican arguments for getting this nomination done is the need for "a full Court" before what will surely become one of the most contested elections in the country's history. Republican senators who support Mr. Trump and Mr. McConnell can only enhance their positions among their core constituencies in their respective states. Collins of Maine, McSally of Arizona and the Pub senator from Colorado might be the exceptions here, but chances are they were going down anyway regardless of their votes.

If the democrat-communists and their sycophant ComInform media try to browbeat Americans with the meme "this should take more time", the counterargument should be that Ginsburg's nomination process was completed in around 45 days or so. Her successor should be entitled to equal treatment.

Damn the RINOs and demmocommies.
Full speed ahead...!

2. the Democrats trampled all over past impeachment practices to try to unconstitutionally remove the president; the Obama-Biden administration used the FBI and Intel agencies against candidate and then President Trump; the Democrats want to get rid of the electoral college

3. the Democrats want to add four Democrat senators via DC and Puerto Rico; the Democrats are using mass mail-in voting to create chaos on election night and talk about a violent insurrection against the president

4. the Senate Democrats were the first to widely use the filibuster against judicial nominees when they were in the minority but then ended the rule (in part) when they became the Senate majority

5. for months the Democrats trashed law enforcement during riots in which they refused to denounce the violence; the Democrats talk about packing the Supreme Court with radical ideologies

6.the Democrats have denounced the framers of the Constitution as a bunch of slaveholders as the basis for rejecting the Constitution when it’s inconvenient toward their unconstitutional ends; the Dems agreed to a 110page radical manifesto that would destroy America as we know it

7. the Democrats appoint judges who thwart elected representatives and the will of the people; etc.

8. Yet today the Democrats and their media propagandists lie (they do that often) about some non-existent tradition or practice preventing the president from nominating a candidate to the Supreme Court during an election or the latter part of his first term.

9. Of course, the tradition and practice are indisputably the opposite.  The Democrats want power at any price.  Wherever possible it must be denied them.

10. The president should proceed quickly with the nomination of a proven constitutionalist and Senate Republicans should proceed quickly with his or her confirmation.

@IsailedawayfromFR

Maybe, maybe not. Depends on what type of cancer it is. Ever seen a patient in "end care" in a nursing home, being shot up with drugs every day so their screams don't scare the other patients? How would YOU like to live like that for weeks,or even months,as your loved ones come to visit and suffer with you?

Getting a death notice 3 weeks in advance is one of the biggest blessings anyone can get because it means you haven't spent months suffering, and it means you have the time to arrange your affairs to be handled the way you wanted, and you had time to say goodbye to family and friends before your upcoming dirt nap.

Lindsey Graham Says He Backs Trump in ‘Any Effort to Move Forward’ on RBG Vacancy

Sen. Lindsey Graham (R-SC) said that he is supporting President Donald Trump “in any effort to move forward” concerning the vacancy left by the late Supreme Court Justice Ruth Bader Ginsburg. As chair of the Senate Judiciary Committee, Graham would preside over confirmation hearings for the president’s choice to fill Ginsburg’s seat.

Graham, who posted his comments to Twitter on Saturday afternoon, said that his decision to back President Trump was driven by two factors — former Sen. Harry Reid’s (D-NV) judicial confirmation rule changes and the Democrats’ ultimately unsuccessful attempt to derail Supreme Court Justice Brett Kavanugh’s nomination to the high court.

“The two biggest changes regarding the Senate and judicial confirmations that have occurred in the last decade have come from Democrats,” Graham wrote. “In light of these two events, I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.”

There’s this repeated fantasy going around that Democrats never would have done what McConnell did to Garland in 2016–except Schumer announced in *2007* that the Senate would preemptively refuse to confirm any Bush nominee. (Before that, Senator Obama voted to filibuster Alito.)

Just dug up this clip of Obama in 2016:

"When there is a vacancy on the SCOTUS, the President is to nominate someone, the Senate is to consider that nomination... There's no unwritten law that says that it can only be done on off-years. That's not in the Constitution text."

When her death notice first popped up last night (I was watching Wheel of Fortune, of all shows), I wondered... why so suddenly? Why had there been no notices that she was in very poor health, not expected to live?

Her last days were kept WELL "under wraps", for some reason.

ANY Republican Senator that doesn't vote for Trump's nominee needs to lose ALL support from the Republican Party, any and all committee seats they have now,and all support from Republican voters.

Not so much as ONE thin dime in financial support. Don't even carpool with them.

I will take it so far as to say that other Republicans should even refuse to talk to them,or even return their phone calls.

If they threaten to switch over to the Dim Party if we do this,so what? All they would be doing would be formalizing their loyalty to the Dim Party. Good riddance to bad trash.

This argument is so funny...if Ruthie was so concerned about who would choose the next Justice she should have retired during O'Bama's Admin

Funny indeed.

RBG’s dying-wish statement seems to conflict with her on-the-record statement regarding Obama when Justice Scalia died:

“There’s nothing in the constitution that says the president stops being president in his last year.”  —Supreme Court Justice Ruth Bader Ginsberg

DC, I know that you are an avid Trump supporter and you have told me in the past as to why, but my question to you is, why do you believe or feel that Trump will do what he claims he will do?  Obviously I'm missing the confidence you have in him.

**********************************************************************************

I don't know that Trump will do as he promises.

But I certainly DO know Hillary Clinton.

...especially with regard to the 2nd Amendment, SCOTUS justices and giving illegals citizenship for their vote.

Ninth Circuit Court Overturns Death Of Ruth Bader Ginsburg

September 21st, 2020

SAN FRANCISCO, CA—In a landmark ruling, the Ninth Circuit Court of Appeals has overturned the death of Supreme Court Justice Ruth Bader Ginsburg. In a close decision, the judges on the court have ruled RBG's death unconstitutional and will block Trump from nominating a replacement.

Kim McLane Wardlaw, the judge who issued the ruling, said in a statement: "Justice Ginsburg's death was an affront to the constitution as well as our God-given right to abort as many babies as possible and sell their body parts for research. Death, at its core, is a construct designed to subvert the rule of law by taking pro-choice liberal judges away from us too soon. We cannot allow Ruth Bader Ginsburg's death to stand. By law, she will now be considered to be still alive."

Trump slammed the ruling as "idiotic" and called the court judges "a bunch of morons." Republicans pounced on this ruling like tigers that pounce on their prey before ruthlessly tearing it to pieces with their razor-sharp claws. "This is a terrible ruling because we're racist and we hate women," said a bunch of Republicans, according to anonymous sources.

Give it a week or two before they announce that not only did Ginsberg die from Covid, but that Trump is responsible for her death.  The lunatics will be calling for Pelosi and Schumer to charge Trump with murder.
