Justice Ruth Bader Ginsburg, the liberal leader of the Supreme Court and a trailblazing champion of women’s rights, died on Friday. She was 87 years old.
Seen as a moderate when President Bill Clinton nominated her to the bench in 1993, Ginsburg went on to leave a lasting mark in the realm of gender equality, civil liberties and pay equity, and grew to achieve improbable late-in-life recognition as a pop culture icon and hero of the progressive movement.
Her first major opinion as a justice came in 1996 when she wrote the majority decision in United States v. Virginia. The ruling struck down the Virginia Military Institute’s 157-year-old policy of male-only admissions as unconstitutional, and set a stricter legal standard for government action that treats men and women differently.

I see no reason why a replacement couldn't be voted on by then.

The late Supreme Court Justice Ruth Bader Ginsburg said days before her death that her "most fervent wish" was that she not be replaced on the high court until a new president is sworn into the White House.
"My most fervent wish is that I will not be replaced until a new president is installed," Ginsburg dictated in a statement to her granddaughter that was obtained by NPR.
Ginsburg died Friday due to complications of metastatic pancreas cancer at the age of 87. The second woman appointed to the high court, she served as a justice for over 27 years.

Republicans infamously blocked President Obama’s Supreme Court pick from receiving a confirmation hearing after Justice Antonin Scalia died in 2016, the year of the last presidential election. GOP lawmakers maintained that a Supreme Court vacancy should not be filled the same year as a presidential race.
However, Senate Majority Leader Mitch McConnell (R-Ky.) has maintained that he would fill a 2020 Supreme Court vacancy. He has said that the situation this year would be different than that in 2016 because in 2020 the White House and Senate are held by the same party.

Which may in the end help the GOP's chances to keep the Senate since Republicans will be more motivated to get out and vote to keep in the hands of the GOP. I think Trump knows that, he's going to pick the person he thinks will help the GOP the most in November, even if they won't be confirmed until after the election.

Hard to tell how that would play out. IF he were to name a solid "no question about it" conservative,the Dim heads would explode,but the flip side is those on the right would be throwing parties to celebrate.
I kinda like the idea of a per-election nomination putting pressure on the Semi-Republicans to come out and make a stand for,or against a conservative justice,just days before they have to face the voters.

Ok, this is would be only a GOOD thing.
"Will not vote" means they cast no vote -- not "aye", not "nay".
That leaves 50 Republican senators who WILL vote, and 47 democrat-communists who will oppose.
That means that all we need to win will be 47 votes (assuming 47 dem-com votes "no"), along with a vote from Mike Pence to "break the tie".
How's that...?

Let's step back and think about this.
With Ms. Ginsburg's seat vacant, that leaves:
- 4 "known conservative" votes
- 1 "swing vote" (Roberts)
- 3 leftist votes.
I sense that in matters of the election, Mr. Roberts is likely to lean towards the Constitutional position, along with the other conservatives.
So... with Ms. Ginsburg now vacant, an 8-member Supreme Court has actually become MORE conservative than it was yesterday...

I'm not so sure of this. McConnell has to take temperature of vulnerable senators -- Collins, Tillis, McSally, Gardner. Do they WANT a pre-election vote? McConnell can have cake and eat it. Fire up GOP base, but ram through vote in lame duck, regardless of who wins Nov. 3.

President Trump on Wednesday unveiled a list of 20 additional potential Supreme Court nominees that includes three Republican U.S. senators, a White House lawyer-turned-judge and his former solicitor general.
Sens. Tom Cotton (R-Ark.), Ted Cruz (R-Texas) and Josh Hawley (R-Mo.), as well as Noel Francisco, who departed as solicitor general in June, are among the names added to the current list of candidates for the Supreme Court. Hawley, however, swiftly tweeted that he has “no interest†in serving on the Supreme Court and looked forward to “ confirming constitutional conservatives†in the Senate.
The list also includes a handful of individuals who have served in the Trump administration or his White House, as well as Trump appointees to lower federal courts. It includes, for instance, Gregory Katsas, who served as deputy White House counsel before Trump chose him to serve on the U.S. Court of Appeals for the D.C. Circuit in September 2017.
The announcement represents a bid to shore up his support among conservatives two months from the 2020 presidential election, as polls show Trump trailing Democratic nominee Joe Biden nationally and in key swing states.
In remarks at the White House, Trump warned that religious liberty, freedom of speech, and the right to bear arms are all at risk if Democrats win the election, asserting that they would appoint “radical†justices to the high court.
“Over the next four years, America’s president will choose hundreds of federal judges and in all likelihood, one, two three and even four Supreme Court justices,†Trump said in remarks from the Diplomatic Reception Room at the White House.
“The outcome of these decisions will determine whether we hold fast to our nation’s founding principles or whether they are lost forever,†Trump continued.
The future of the Supreme Court hangs in the balance as the Nov. 3 voting day quickly approaches.
If Trump wins another four-year term, he would likely get the opportunity to replace ailing liberal Justice Ruth Bader Ginsburg, 87, and possibly fellow liberal Justice Stephen Breyer, 82, which would give conservatives a commanding 6-3 or 7-2 majority.
The next oldest justice is conservative Clarence Thomas, 72, who is currently the longest-serving member of the court and whose 28 years on the bench is longer than the typical justice’s tenure.

Republicans have a number of Senators up for reelection and not many Democrats up for reelection. Don't have those numbers right now. It is likely Democrats will take the Senate for this reason and now, also because there is an empty Supreme Court Justice Seat that will bring out more Democrats to vote.
Normally, it is the Independent vote that determines who will be President. This death of Ginsburg, a liberal but loved by millions, plus Independents don't like the four years of tweets, will likely vote against Trump and for Ginsburg (that being another liberal woman Supreme Court Judge). There will have to be a Democrat President to have a liberal woman Supreme Court Judge.

If Thrump nominates someone tomorrow there is no way that the Senate will have a confirmation vote before the election. If the GOP retains control of the Senate then it becomes a moot point whoever he nominates gets seated.
The question is are the GOP Senators in Blue and Purple states going to commit to supporting his nominee or say the next president should pick the nominee in order to save their skins and get reelected.....I would expect they will do and say anything to get reelected.. :shrug:

Harvest and print fake ballots, fill out ballots for those in nursing homes, all your want - the Early Voting Ballot Board will throw them all out. Been there, done that. Democrat District Attorney filed a suit against me to remove me as that Judge, he filed it with the Texas Attorney General (who was John Cornyn). I won the case, naturally. I knew I was right and District Attorney was wrong. I stayed as that Judge and kept throwing out the ballots you spoke about above.

Tragic news that Ruth Bader Ginsburg has passed. It is always a shame when
someone so young passes and especially so unexpectedly. Who would have ever

A majority of Americans said in a new poll conducted prior to Justice Ruth Bader Ginsburg’s death that the Senate should hold confirmation hearings on a Supreme Court nominee for any vacancy this year.
Sixty-seven percent of Americans said in the Marquette University poll released Saturday that hearings should be held, while 32 percent said the Senate should not consider a nominee to the high court in an election year.
Results did not significantly vary along party lines, with 71 percent of independents, 68 percent of Republicans and 63 percent of Democrats saying confirmation hearings should be held.

I reckon there's a good chance the seat will go to Amy Coney Barrett.
She was on the "very short list" the last time, she's well-vetted, and she was just confirmed by the Senate in 2017 for her current seat. In fact, I believe the two "ladies" who said they won't cast a vote this time voted FOR Ms. Barret the last time. Are they really going to deny her now?
Mr. McConnell's job will be to "keep things tight", set a schedule, and then FORCE the necessary votes ON TIME. If he does this, I predict this nomination process will actually be easier than Mr. Kavanaugh's -- it's going to be difficult to attack Ms. Barrett using the same vectors the leftist-communists would use for a man.
But... they're sure gonna try.
It's up to Republicans to simply IGNORE their screams and media outbursts, and "press on through". Just brush the democrat-communists away as one would brush dust from one's clothes. That's about all they're worth anyway.
One of the core Republican arguments for getting this nomination done is the need for "a full Court" before what will surely become one of the most contested elections in the country's history. Republican senators who support Mr. Trump and Mr. McConnell can only enhance their positions among their core constituencies in their respective states. Collins of Maine, McSally of Arizona and the Pub senator from Colorado might be the exceptions here, but chances are they were going down anyway regardless of their votes.
If the democrat-communists and their sycophant ComInform media try to browbeat Americans with the meme "this should take more time", the counterargument should be that Ginsburg's nomination process was completed in around 45 days or so. Her successor should be entitled to equal treatment.

As chair of the Senate Judiciary Committee, Graham would preside over confirmation hearings for the president’s choice to fill Ginsburg’s seat.
Graham, who posted his comments to Twitter on Saturday afternoon, said that his decision to back President Trump was driven by two factors — former Sen. SAN FRANCISCO, CA—In a landmark ruling, the Ninth Circuit Court of Appeals has overturned the death of Supreme Court Justice Ruth Bader Ginsburg. In a close decision, the judges on the court have ruled RBG's death unconstitutional and will block Trump from nominating a replacement.
