Texas Attorney General Ken Paxton has sued to block a recent expansion of President Biden’s climate policy, a new Environmental Protection Agency (“EPA”) rule. EPA’s new rule alters the national ambient air quality standard (“NAAQS”) for particulate matter. Only six months after the EPA had reviewed the issue, the agency did an about-face when President Biden directed EPA to redo its review as part of a broader effort to “tackle the climate crisis.”

The EPA’s NAAQS rule is not based on sound science and it will impose significant economic harm on Texas. Further, the rule and its corresponding compliance costs will result in the closure of manufacturing and industrial facilities, putting workers out of jobs and devastating the surrounding communities.

“This new rule improperly imposes a huge burden with no scientific basis,” said Attorney General Paxton. “I will always use every available avenue to block Biden’s extremist climate agenda, especially when federal policy undermines Texas industry and destroys Texas jobs.”

Argue regulation is arbitrary, capricious and illegal

A coalition of red state attorneys general is challenging the Biden administration over one of its most stringent air quality regulations.

Twenty-four states are challenging the Environmental Protection Agency’s (EPA) recent tightening of the National Ambient Air Quality Standards (NAAQS) for particulate matter (PM2.5), arguing that the regulation is arbitrary, capricious and illegal. The EPA reduced the allowable the annual PM2.5 standard from 12 micrograms per cubic meter to 9 micrograms per cubic matter, or by about 25%

“The EPA’s new rule has more to do with advancing President Biden’s radical green agenda than protecting Kentuckians’ health or the environment,” Republican Kentucky Attorney General Russel Coleman said in a statement about the lawsuit. “This rule will drive jobs and investment out of Kentucky and overseas, leaving employers and hardworking families to pay the price.”

In addition to Kentucky, the states represented in the petition include West Virginia, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Utah and Wyoming.
