Attor­ney Gen­er­al Ken Pax­ton Sues Five Busi­ness­es for Refus­ing to Allow Law Enforce­ment Offi­cers to Car­ry Firearms

Texas Attorney General Ken Paxton filed five lawsuits to enforce state law against establishments that refused to allow police officers to enter the premises with their firearms, thereby jeopardizing public safety.

The lawsuits allege that The Factory in Deep Ellum (in Dallas), Texas Trust CU Theatre (in Grand Prairie), Meow Wolf (in Grapevine), The Lucky Duck (in San Antonio), and the State Fair of Texas have violated state law by restricting peace officers, including off-duty officers, from entering the premises with their authorized firearms.

Texas Code of Criminal Procedure article 2.1305 provides that establishments serving the public—including businesses, restaurants, hotels, sports venues, arenas, and places of amusement—that restrict a peace officer from carrying their authorized weapon are subject to a civil penalty of $1,000 for each violation. Before filing suit, the Office of the Attorney General (“OAG”) received written confirmations regarding the five named establishments indicating they would follow Texas law. Despite this, the OAG has continued receiving complaints from peace officers that these establishments are violating the law.

“Texas law must be respected to ensure the safety and well-being of our citizens,” said Attorney General Paxton. “Criminal activity can occur at any time and any place. Peace officers are often well-positioned to prevent and suppress crime, even when they are out of uniform and off duty.”

The Office of the Attorney General is committed to ensuring that our peace officers’ authority to carry their weapons while off duty is respected. Peace officers wanting to register a violation of their right to carry may email  violation@oag.texas.gov or they may submit a complaint form here.

Who ever thought they would live long enough  to see establishments in Texas banning guns from anybody,never mind LEO's.

The left wants EVERYBODY disarmed legally so that they are then pretty much free to riot and loot at will.

The idea is to destroy America and then turn it into some "socialist paradise" where everybody gets everything they want,and nobody has to work or pay for it.

Property rights. But then, you should also be able to deny installing a handicap bathroom in your establishment too, or not follow common regulations and building codes... Be free to maintain a man-trap.

Where is the line? I hate ANY imposition over the property owner, even public-facing property. This here is the flip-side of that. A ridiculous example that defies reason.

There is a near issue to this that pisses me off. I carry a lot. Don't really mean to. It ain't really a thing to me. But if I am coming off the mountain, and stop in town to do some business, I don't want to leave my rig in the truck. But if I am going to a bank for instance, or any govt. building, I cannot enter...

That sucks. If you are going to deny it, then offer some kind of check-in. My bank used to do that for me... First stop was at the security desk at the back door - I could legally enter and stop there. And there I could check my gear with the sec guy, go in, do my business, and pick up my guns on the way out.
I don't mind that at all.

I hate having to frisk myself twice for knives before walking into the courthouse, and leave them in the vehicle. It's almost as bad as the TSA.

AND THEN... When you forget, because you've had that folding knife in your back pocket, slid in there right next to your wallet, and it's been right there, literally your whole life long... Then, when you forget, they CONFISCATE it... You don't get it back... Pisses me right off.

It ain't nothing special... An Uncle Henry Papa Bear... Thirty bucks. More trouble to sit and put a real edge on it than to get another, But it's MINE, dammit. They have no right. I just forgot.  *****rollingeyes*****

I not  only agree,I think open carry gives the thugs an advantage they shouldn't have. They see a gun,so they just go down the block to rob someone else at gun point.

I live in an open-carry state,and still carry concealed.
