ATHENS, Ga. – The University of Georgia Police Department have taken a suspect in custody in connection with the suspected homicide of a 22-year-old nursing student from Augusta University who police found dead on the University of Georgia campus Thursday.

Police have charged Jose Antonio Ibarra with malice murder, felony murder, aggravated battery, aggravated assault, false imprisonment, kidnapping, hindering a 911 call and concealing the death of another, UGA Police Chief Jeffrey L. Clark said during a news briefing Friday evening. The suspect is not a U.S. citizen, according to authorities.

"The evidence is robust," he told reporters, crediting campus security cameras in part for the arrest.

Clark said he believed the attack was a "crime of opportunity" and that the suspected killer had no known connection to the victim. Ibarra is not a UGA student, he added.

Ibarra's immigration status was not immediately known to investigators, the chief said, adding that he believed the suspect is from Venezuela.

"Right now I don’t know his full status," he said. "He is not a citizen of the United States."

Police initially swept up three to four people during the early stages of the investigation but were only arresting and charging Ibarra, Clark added.

Riley had previously attended UGA before entering a nursing program at Augusta's Athens campus, where she made the Dean's List.

Police were asking anyone who saw anything "relevant or suspicious" between 7 a.m. and noon Thursday around UGA's Intramural Fields and Lake Herrick to call 706-542-2200.

That's where they found Riley – with "visible injuries" – within 30 after they received a call from a concerned friend who said she went for a run and didn't come back.

According to an incident report obtained by Fox News Digital, multiple officers began searching for Riley near the Intramural Fields around 12:07 p.m. At 12:38, a UGA police officer spotted her on the ground.

"I called out to Riley, and I did not get a response," the officer wrote.

She had visible injuries, and police could not locate a pulse. They began CPR anyway. A sergeant arrived with a defibrillator minutes later and unsuccessfully attempted to revive the victim.

"Based on the injuries and Riley's physical condition, I suspected that foul play was involved," the police report reads. Investigators were reviewing the officer's bodycam for additional evidence.

As the New York Post reported, 22-year-old Laken Hope Riley was found “not breathing” and with “visible injuries” in a forested area near Lake Herrick, which is located on the University of Georgia (UGA) campus in Athens, around 12:38 p.m. Thursday.

Riley was a student at UGA before transferring to the nursing program at Augusta University’s Athens Campus after the spring 2023 semester, according to UGA’s student newspaper, The Red & Black.

The UGA Police Department arrested and identified Jose Antonio Ibarra as the individual responsible for the slaying. UGA Police Chief Jeffrey L. Clark announced during a news briefing Friday evening that Ibarra has been charged with malice murder, felony murder, aggravated battery, aggravated assault, false imprisonment, kidnapping, hindering a 911 call, and concealing the death of another.

An undocumented Venezuelan man living in Athens, Georgia — who is the brother of a suspect accused of killing on the University of Georgia campus —— was charged Friday night with possessing a fraudulent green card, according to officials.

Diego Ibarra, 29, was charged by a federal criminal complaint and is being held in state custody, the U.S. Attorney's Office in the Middle District of Georgia said in a press release. Ibarra could face as many as ten years in prison if convicted.

The federal arrest affidavit for Diego Ibarra shows after he made an asylum claim in El Paso, he was released to New York. But in September 2023, Athens-Clarke County Police charged him with drunken driving and driving without a license. A month later, police arrested him again, this time for shoplifting. And in December, he allegedly skipped court and racked up another charge.

Ibarra is the brother of Jose Ibarra, 26, of Venezuela, who is facing state charges for malice murder, felony murder, aggravated battery, aggravated assault, false imprisonment, kidnapping, hindering a 911 call and concealing the death of another in connection with the death of Laken Hope Riley, a 22-year-old Augusta University nursing student who police found dead Thursday on the University of Georgia campus.

Immigration and Customs Enforcement (ICE) on Sunday confirmed that the Venezuelan national charged in connection with the murder of 22-year-old Georgia nursing student Laken Riley entered the U.S. illegally in 2022 and had previously been arrested in New York City.

Fox News had previously reported that 26-year-old Jose Antonio Ibarra, charged with the murder of Riley on the University of Georgia campus, had crossed into the U.S. illegally near El Paso in September 2022 and was paroled into the U.S.

In a statement to Fox News Digital, ICE confirmed he had been encountered by Customs and Border Protection (CBP) on Sept. 8, 2022 after entering near El Paso and was "paroled and released for further processing."

ICE also confirmed that Ibarra had been arrested by the New York Police Department a year later, on Sept. 14, 2023, and "charged with acting in a manner to injure a child less than 17 and a motor vehicle license violation."

When ICE learns that what it believes to be a removable illegal immigrant has been arrested on criminal charges, the agency will normally lodge a detainer – a request asking local law enforcement to keep the suspect in custody until they can be transferred to ICE and put into deportation proceedings.

In this case, however, ICE's statement says Ibarra was released before a detainer could be issued. NYC is also a "sanctuary city" which generally restricts law enforcement from complying with ICE detainers.

In its statement, ICE said that its Enforcement and Removal Operations office in Atlanta "encountered Ibarra pursuant to his arrest by the University of Georgia Police Department and being charged with murder and other crimes. ERO Atlanta lodged a detainer."

Gov. Brian Kemp (R-GA) has said President Joe Biden’s inaction on securing the southern border has led to the death of a Georgia college student in an open letter he addressed to the president and his administration.

The letter comes after Jose Ibarra, an illegal Venezuelan immigrant, has been identified as the sole suspect in the murder of Laken Riley, an Augusta University nursing student found dead on the University of Georgia’s campus. Ibarra had illegally crossed into the United States through El Paso, Texas, in September 2022 and was released due to lack of detention space, according to NewsNation.

“As I have stated many times in the past, your actions and those of your administration have resulted in every state in the country experiencing the disastrous impacts of an unsecured U.S. southern border,” Kemp’s letter to Biden reads. “More than nine million illegal immigrants have crossed the border since you took office – with an additional, unknown number of migrants who were not detained and processed – while at least 58 people on the terror watchlist have been encountered between ports of entry this fiscal year alone.”

The suspect, 26-year-old Jose Ibarra, was arrested by U.S. Customs and Border Protection on Sept. 8, 2022, after he unlawfully entered the U.S. near El Paso, Texas, U.S. Immigration and Customs Enforcement said in a statement.

Ibarra was released by U.S. border officials pending a review of his immigration case, ICE said. He was arrested a little over a year later, on Sept. 14, 2023, by New York Police Department officers and charged with acting in a manner to injure a child less than 17 and a motor vehicle license violation, according to the ICE statement. The statement did not elaborate on the details of his alleged crimes.

The suspect was arrested again on Friday in connection with the murder of Riley after her body was discovered in a wooded area on the Athens campus of the University of Georgia, police said at a news briefing Friday.

ICE has requested to detain Ibarra if and when he's released from criminal custody so it can seek his deportation.

CNN reported there was "little evidence" linking illegal immigration and crime after a Venezuelan migrant was charged in connection with the murder of a 22-year-old Georgia nursing student.

Laken Riley, an Augusta University nursing student, was found dead Thursday on the University of Georgia campus with signs of blunt force trauma after setting out for a jog that morning. Murder suspect 26-year-old Jose Antonio Ibarra had crossed into the U.S. illegally near El Paso in September 2022 and was paroled into the U.S., officials confirmed Sunday.

Immigration and Customs Enforcement (ICE) also confirmed that the suspect had also been arrested last year in New York by the NYPD and "charged with acting in a manner to injure a child less than 17 and a motor vehicle license violation."

However, CNN repeatedly discounted any connection between the suspect's immigration status and crime in a Monday report.

I'm being told the case against Ibarra was closed administratively. In my experience, that would mean the US Attorney for the Western District of Texas declined the prosecution. An email declination to pursue the case is enough for a closing on the FBI side.
