“Anyone who isn’t confused really doesn’t understand the situation.” Those words, from CBS icon Edward R. Murrow, came to mind this week after I spoke with journalists at the network.

There is trouble brewing at Black Rock, the headquarters of CBS, after the firing of Catherine Herridge, an acclaimed investigative reporter. Many of us were shocked after Herridge was included in layoffs this month, but those concerns have increased after CBS officials took the unusual step of seizing her files, computers and records, including information on privileged sources.

The position of CBS has alarmed many, including the union, as an attack on free press principles by one of the nation’s most esteemed press organizations.

I have spoken confidentially with current and former CBS employees who have stated that they could not recall the company ever taking such a step before. One former CBS journalist said that many employees “are confused why [Herridge] was laid off, as one of the correspondents who broke news regularly and did a lot of original reporting.”

That has led to concerns about the source of the pressure. He added that he had never seen a seizure of records from a departing journalist, and that the move had sent a “chilling signal” in the ranks of CBS.

A former CBS manager, who also spoke on condition of anonymity, said that he had “never heard of anything like this.” He attested to the fact that, in past departures, journalists took all of their files and office contents. Indeed, the company would box up everything from cups to post-its for departing reporters. He said the holding of the material was “outrageous” and clearly endangered confidential sources.

Herridge declined to make any public comments on her departure.

This action included materials that may reveal information about confidential sources, according to an article by Jonathan Turley, Shapiro Chair of Public Interest Law at George Washington University, in The Hill.

Catherine Herridge, an Emmy-winning and nominated reporter known for her work on national security and intelligence, was among the 800 employees Paramount Global laid off in a bid to streamline operations amid financial strain. Her firing has since escalated into a broader controversy.

In his article titled “CBS faces uproar after seizing investigative journalist’s files,” Turley sheds light on the concerns that have emerged within the journalistic community at CBS.

Herridge’s colleagues are reportedly alarmed by the company’s unprecedented steps to take possession of her work materials, including sensitive information on sources promised confidentiality.

With that said, it sounds like a standard industry practice in which departing reporters are generally allowed to take their own files, records, notes, and sources with them, and that what CBS did here violated that professional tradition, courtesy, or custom.

Computers can only be remotely hacked if they are attached to a computer network.

Keep your double secret probation secret material on a computer with no network connectivity - no BlueTooth, no WiFi, no Cell, no GPS, no Dial-up, no Local Area Network, nor Wide Area Network.  Make the bastards break into your house, steal your computer, and have to decrypt files or filesystems.  If they want your info, make them work for it.

CBS apparently seized computers, records and files of the now-former investigative reporter Catherine Herridge, who has recently been fired from the network, according to Jonathan Turley.

Turley, a professor at George Washington Law School, said he talked with people presently and formerly employed by CBS who confidentially told him they do not recall senior staff ever taking such a step before. At the time of her departure, Herridge was investigating special counsel Robert Hur’s report on President Joe Biden, allegations of corruption against the president and Hunter Biden’s laptop, Turley noted.

One former CBS journalist reportedly said staffers have never seen the apparent seizure of records and files from departing staffers.

The apparent seizure has caused a “chilling signal” across staffers at CBS, the journalist added, Turley wrote. A previous CBS manager reportedly stated that he had “never heard of anything like this,” as most departing journalists take their records and files upon leaving. He said the apparent seizure of her possessions is “outrageous” and endangered confidential sources, Turley added.

This action is deeply concerning to the union because it sets a dangerous precedent for all media professionals and threatens the very foundation of the First Amendment.

It is completely inappropriate for an employer to lay off a reporter and take the very unusual step of retaining and searching the reporter's files, inclusive of confidential source identification and information. From a First Amendment standpoint, a media corporation with a commitment to journalism calling a reporter’s research and confidential source reporting "proprietary information" is both shocking and absurd.

The retention of a media professional's reporting materials by their former employer is a serious break with traditional practices which supports the immediate return of reporting materials. We urge CBS to return this material to Catherine in support of the most basic of First Amendment principles. We are encouraged by recent outreach by CBS News to SAG-AFTRA on this matter, and we are hopeful that it will be resolved shortly.

In mid-February, CBS let go about 20 people from their news staff, including investigative reporter Catherine Herridge. Hundreds were also fired from the parent company, Paramount Global.
 

But what made the firing of Herridge even worse was that CBS seized her records, files, and computers in an unprecedented move. That has sparked a huge outcry. Herridge was covering some significant stories on the Biden family, including the Hur Report and many angles of the Hunter Biden story. That, according to one report, was disturbing higher-ups. There was also speculation that she might have had information that could impact a wrongful termination action. She also was involved in an important First Amendment case where she was standing her ground and not giving up her sources. The files reportedly "most likely contain confidential material from Herridge's stints at both Fox and CBS."

Herridge then posted an important update from her union, SAG-AFTRA, who condemned the seizure of her files and said that they had gotten an outreach from CBS and were hoping to be able to resolve the matter and get her files.

CBS News has returned the notes it seized from a high-profile reporter the network fired for 'investigating Hunter Biden.'

Herridge covered investigations into the Biden family, and the network seized her personal notes after her termination in a move her union calls 'completely inappropriate' and 'very unusual.'

We recently highlighted the story of the journalist Catherine Herridge, who was fired by CBS News, after which the network seized her confidential files. Herridge had been working on stories that might be negative for Joe Biden and the administration, so people were naturally suspicious and outraged.

Now, after public scrutiny and pressure from members of Congress, the network has returned the files.

The New York Post reports:

    CBS News returns confidential files of reporter covering Hunter Biden laptop scandal

    CBS News on Monday finally returned confidential files belonging to fired investigative reporter Catherine Herridge amid mounting pressure from the House Judiciary Committee and the union representing the journalist, The Post has learned

    Herridge — who is in the middle of a key First Amendment case — had been probing the Hunter Biden laptop scandal when the acclaimed journalist was shockingly fired as part of mass layoffs by parent company Paramount Global nearly two weeks ago.

    Her personal files — along with her work laptop, which may have contained other confidential info — were immediately confiscated and locked away at the CBS News office in Washington, DC.

    “Catherine Herridge’s union representative picked up her materials this morning,” a CBS News rep confirmed to The Post on Monday.

    A spokesperson for SAG-AFTRA, the union representing CBS News employees, confirmed that several boxes containing Herridge’s reporting materials were returned.

CBS News Returns Seized Confidential Files of Reporter Catherine Herridge After Uproar

We recently highlighted the story of the journalist Catherine Herridge, who was fired by CBS News, after which the network seized her confidential files. Herridge had been working on stories that might be negative for Joe Biden and the administration, so people were naturally suspicious and outraged.

Now, after public scrutiny and pressure from members of Congress, the network has returned the files.

The New York Post reports:

    CBS News returns confidential files of reporter covering Hunter Biden laptop scandal

    CBS News on Monday finally returned confidential files belonging to fired investigative reporter Catherine Herridge amid mounting pressure from the House Judiciary Committee and the union representing the journalist, The Post has learned

    Herridge — who is in the middle of a key First Amendment case — had been probing the Hunter Biden laptop scandal when the acclaimed journalist was shockingly fired as part of mass layoffs by parent company Paramount Global nearly two weeks ago.

    Her personal files — along with her work laptop, which may have contained other confidential info — were immediately confiscated and locked away at the CBS News office in Washington, DC.

    “Catherine Herridge’s union representative picked up her materials this morning,” a CBS News rep confirmed to The Post on Monday.

    A spokesperson for SAG-AFTRA, the union representing CBS News employees, confirmed that several boxes containing Herridge’s reporting materials were returned.
