A watchdog group is demanding documents from the Biden administration after whistleblowers alleged that a regulation is under development that would effectively ban private gun sales.

The group, Empower Oversight, said Wednesday that two sources have claimed that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is preparing to propose a rule requiring background checks for most or all gun sales.

President Biden has campaigned for stricter gun laws and in August proposed a regulation to clarify that people who “repetitively” sell guns must register as federally licensed gun dealers subject to background checks.

The revised rule purportedly being crafted by the ATF would be even broader, Empower Oversight president Tristan Leavitt said in a series of posts on X.

Empower Oversight “has learned through whistleblowers within ATF that at the direction of the White House, ATF has drafted a 1,300-page document to justify a rule effectively banning the private sale of firearms,” Leavitt wrote.

At least a few of the mass shooters in the past few years purchased their guns legally, after passing background checks. Somehow, that didn't prevent any of the violence.  :shrug:

The Bryan Malinowski AFT execution thread.
Bryan Maliownski was being investigated for "dealing in firearms without a license" which is a private sale and "unlawful acquisition of a firearm" which he acquired firearms also in a private sale.  To simply put this in short terms, the AFT is saying that private sales are illegal.

Texas, Kansas Lead Lawsuits Against ‘Unconstitutional’ Rule Restricting Private Gun Sales

Attorney General Ken Paxton is leading one of two multi-state coalitions suing Biden’s Bureau of Alcohol, Tobacco, Firearms and Explosives for Second Amendment violations.

Republican attorneys general in multiple states, including Texas and Kansas, are suing to stop the Biden administration from imposing new restrictions on the rights of gun owners.

Texas Attorney General Ken Paxton and Kansas Attorney General Kris Kobach announced the new lawsuits against the Bureau of Alcohol, Tobacco, Firearms and Explosives during a press conference Wednesday at the Frisco Gun Club.

The lawsuits challenge a new ATF rule that redefines “engaged in the business” as a firearms dealer.

The 126-page rule would have the effect of criminalizing law-abiding Americans for private gun purchases and sales.

The attorneys general argue that the rule is unconstitutional because it is vague, violates the Second Amendment, and circumvents Congress.

“The war on Second Amendment rights must be stopped. My message to Biden is ‘Come and Take It,’” Paxton told reporters.

“When the Biden administration can’t get a bill through Congress, it uses administrative rules,” said Kobach.

Biden’s latest attempt to strip away the #2A rights of Americans through ATF regulations will make many law-abiding gun owners felons if they sell a firearm or two to family or friends. This rule is blatantly unconstitutional.
