What is important to remember is Trump has NOT been found guilty. So, how can they file a brief based on insurrection??
Right...that's the weakness in their argument, since nearly all the high-ranking Confederate politicians were ultimately allowed to return to federal office in Washington, and a few even to the U.S. Army (most notably Joe Wheeler and Fitzhugh Lee during the Spanish American War). That provision was NEVER enforced.
